Commissioner Steve Taylor led the Pledge of Allegiance. MINUTES: May 1, 2019 Commissioner Steve Taylor moved to approve the May 1, 2019 minutes. Commissioner Jones seconded. Roll call vote: Commissioner Steve Taylor – yes, Commissioner Jones – yes, Commissioner Rydalch – yes, Commissioner Hunsaker – yes, Commissioner Malone – yes, and Commissioner Robert Taylor – abstain (absent). The motion passed. 06.05.19 Planning and Zoning Minutes Page 2 of 4 PUBLIC HEARINGS: 1. 2019-013 White Pines Charter School Conditional Use Permit: The request is for a conditional use permit to allow a school to operate out of the log building and place four modular classrooms on the 4 acre property located south of 1st St, east of S. 25th E. (Hitt Road), north of John Adams Parkway and west of Curlew Dr. The current zoning is CC-1. The property has been used in the past for educational purposes and has been leased for two years, Chairman Malone explained the public hearing procedure to the audience. There was not any written comment or requests to testify received. Chairman Malone opened the public hearing. Nick Burrows – 2959 John Adams Pkwy – White Pines Charter school is adding 9th grade in the fall and would like to move 7th and 8th grade to this location at 2664 E. 1st St. The current John Adams location will house K-6th grade. They are requesting a conditional use permit to use the building for educational purposes and add four two classroom modular buildings. They are anticipating the total usage, students and staff, 165 in the Fall of 2019 and growing to 230 students and staff by Fall 2020. They have been working on the site plan with Harper Leavitt and had many meetings with the City to create adequate parking that will not impact or back up traffic on 1st St. They will shuttle students from the current John Adams location to the property to minimize carpooling in the morning and afternoon. Cindy said the buses will be allowed to make a left turn from 1st St. going into the property and a right turn only onto 1st St. to exit the property. The buses will not be using the existing day care’s entrance. Cindy displayed the site plan with the location of the four modular units and emergency access road. Nick said the land to the East is owned by the same landowners. They have agreed to allow the emergency access road to the east and will issue an easement to make sure emergency services can go from one parcel to the other. The modular units will be used for classroom instruction and the log building will be used as common space and cafeteria. This is a temporary site; long-term the Board of Directors pursuing options for new construction. Commissioner Malone closed the public hearing and opened the discussion. The Commission discussed traffic on 1st street and how it will be effected by the school. ACTION ITEMS: 1. Action on White Pines Charter School Conditional Use Permit Commissioner Steve Taylor moved to recommend approval to City Council the White Pines Charter School Conditional Use Permit for a term of two years. Commissioner Rydalch seconded. Roll call vote: Commissioner Steve Taylor – yes, Commissioner Rydalch – yes, Commissioner Hunsaker – yes, Commissioner Malone – yes, Commissioner Robert Taylor – yes, Commissioner Torman – yes and Commissioner Jones - yes. The motion passed. 2. 2019-013 Recommendation on additional public hearing – Commissioner Hunsaker moved an additional hearing is not needed for the White Pines Charter School Conditional Use Permit. Commissioner Steve Taylor seconded. Roll call vote: Commissioner Hunsaker – yes, Commissioner Steve Taylor – yes, Commissioner Rydalch– yes, Commissioner Malone – yes, Commissioner Robert Taylor – yes, Commissioner Torman –yes, and Commissioner Jones - yes. The motion passed. 3. 2019-013 Adoption of Reasoning Statement: Commissioner Robert Taylor moved to provide the following findings to the City Council as the reasoning for the recommendation to approve the White Pines Charter School Conditional Use Permit. Commissioner Steve Taylor seconded the motion. Roll call vote: Commissioner Robert Taylor – yes, Commissioner Steve Taylor – yes, Commissioner Rydalch– yes, Commissioner Malone – yes, Commissioner Torman –yes, and Commissioner Jones - yes. The motion passed. 06.05.19 Planning and Zoning Minutes Page 3 of 4 Findings for Recommendation: The site was previously used for education purposes; fits with zoning ordinance; providing mitigation for traffic during peak periods. There was not any input from the public (written or testimony). 4. Final Plat – Kartchner Simplicity Division 2 Cindy displayed the Final Plat. The property location is west of Fox Hollow Drive, south of E. 14th N, north of 1st St. and east of S. 25th E. (Hitt Road). The total acreage is 4.13 acres zoned R-1 in a PUD. The PUD has been granted special setbacks. These homes are trying to have less yard space with larger home. The target buyer is 55 or older. They will have 55 lots. Cindy reviewed the required setbacks in the PUD. This will help with water conservation. The parcel will be built out as single family detached dwellings. Commissioner Robert Taylor moved to recommend approval to City Council the Final Plat – Kartchner Simplicity Division 2, subject to technical review. Commissioner Torman seconded. Roll call vote: Commissioner Robert Taylor – yes, Commissioner Torman – yes, Commissioner Rydalch – yes, Commissioner Steve Taylor – yes, Commissioner Hunsaker – yes, Commissioner Malone – yes and Commissioner Jones - yes. The motion passed. 5. Preliminary Plat – Ammonside Division 7 Cindy displayed the preliminary plat. Property is located west of South 25th East (Hitt Road), south of Judy Street, north of South 49th (Township). east of Taylorview Lane. The total acreage is 11.203 acres zoned HC-1. The parcel will be divided into 8 lots built out as commercial buildings. The parcel does not show access to the property to the south. This could cause public safety issues. Leith Sheets, 911 Pier View Dr. Ste. #205 – Horrocks Engineers – The owner is looking to develop more commercial lots south of Sandcreek Commons. They have tenants interested in the area. Regarding the access to the south he would like to convey his client learned about this mid-May, the cross access agreement is between two private parties not necessarily a public right of way. The client is not against the connection to the south, their concern is having to show placement now. They are still developing a land plan on how the lots will layout. In Sandcreek Commons you can drive through the whole development to avoid Hitt Rd. They are able to do this because they own all the acres and they have a cross access agreement between all the lots on the development; so people can drive through without any issues with liability insurance. The client will have a blanket agreement in this development to allow cross access one lot to another. They cannot say where the access will be to the south because they must have a mutually agreeable term with the property owner to the south. They must work together to determine where that location will be. To date, the developer to the south has failed to contact them. They would like to avoid a denial which could lead to the loss of tenants, but they cannot show the location for the south access until they meet with the property owner to the south. Discussion ensued to regarding the southern access. Commissioner Hunsaker moved to recommend approval to City Council the Preliminary Plat – Ammonside Division 7, subject to technical review and subject to the final plat showing where the common access point will be from Ammonside Division 7 to the property to the south plus additional wording to development agreement that may be needed. Commissioner Robert Taylor seconded. Roll call vote: Commissioner Hunsaker – yes, Commissioner Robert Taylor – yes, Commissioner Rydalch – yes, Commissioner Steve Taylor – yes, Commissioner Malone – yes, Commissioner Torman – yes and Commissioner Jones - yes. The motion passed. Final Plat – Schneider Property (14th North/Terrill) A portion of the property was annexed into the City in April, 2019. This plat combines the annexed property with the two lots that were already part of the City. The total acreage is 4.882 acres zoned I&M 1. The property will have two accesses onto Terrill Dr. the location has not been determined. The property is located south of Lincoln Rd., east of N. 25th E. (Hitt Rd.), north of 14th N. and west of Terrill Dr. Commissioner Jones moved to recommend approval to City Council the Final Plat – Schneider Property (14th North/Terrill), finding it is in compliance with the Comprehensive Plan and meets the City ordinance. 06.05.19 Planning and Zoning Minutes Page 4 of 4 Commissioner Torman seconded. The motion passed. DISCUSSION ITEMS: Comprehensive Plan Land Use Map – Work Session: The Commission discussed a date to hold a work session to discuss the Comprehensive Plan. The Commission will meet for one hour on June 27th. Cindy asked the Commissioner that cannot attend please send her any comments. REPORTS: City Council – Cindy reported on the May 2nd, May 9th and May 16th City Council meetings. City of Idaho Falls – Cindy said the only thing near the Ammon area was the approval of Brookside division 2. Bonneville County – Tom shared points of interest from the County meeting. Parks, Recreation and Trails Commission – Sarah said the active living park is high on their agenda. They are putting together a presentation and will have a booth at Ammon Days. They are working towards getting a parking lot put in at Woodland Hills Park and improvements to the tennis courts at McCowin Park this year. The sail shades at McCowin Park will be next year. Commissioner Jones would like to be on the City Council agenda to discuss connectivity in the subdivisions and the subdivision ordinance.
