Commissioner Torman led the Pledge of Allegiance. MINUTES: October 3, 2018: Commissioner Jones asked for an amendment to the language regarding the Parks, Recreation and Trails Commission Report. Commissioner Robert Taylor moved to approval the October 3, 2018 minutes as amended. The motion was seconded by Commissioner Steven Taylor. Roll Call Vote: Commissioner Robert Taylor – Yes, Commissioner Steven Taylor – Yes, Commissioner Torman - Yes, Commissioner Rydalch – Yes, Commissioner Hunsaker – Yes, and Commissioner Jones – Yes. The motion passed. PUBLIC HEARINGS: 1. 2018-017 – Annexation of property in Mountain Bend Estates: Vice Chairman Hunsaker explained the public hearing process to the audience and opened the public hearing. Cindy explained the property is located north of 49th South (Township Road). The total acreage is 0.581 acres. The parcel will be built out as a single family detached home. The proposed zoning is R-1. Planning and Zoning Minutes 11.07.18 Page 2 of 3 Brad Picket – 3943 Willow Ridge – The annexation is to clean up the County island in the subdivision. The property was not available is the past; he had first rights when it did become available. The 49th South access to the property will be closed. The property will be accessed through the subdivision. Vice Chairman Hunsaker closed the public hearing. 2 2018-018 – Comprehensive Plan Map Change (Ammon Road) PULLED 3 2018-019 – Rezone of Barry South Property PULLED ACTION ITEMS: 1. Action on 2018-017 – Annexation of property in Mountain Bend Estates: Commissioner Steven Taylor moved to recommend approval to City Council for the annexation of a single lot to Mountain Bend Estates, finding it has been noticed properly, and is in compliance with the Comprehensive Plan and City Ordinances. The motion was seconded by Commissioner Jones. Roll Call Vote: Commissioner Steven Taylor – Yes, Commissioner Jones – Yes, Commissioner Torman - Yes, Commissioner Rydalch – Yes, Commissioner Hunsaker – Yes, and Commissioner Robert Taylor – Yes. The motion passed. 2. Action on 2018-018 – Comprehensive Plan Map Change (Ammon Road) PULLED 3. Action on 2018-019 – Rezone of Barry South Property PULLED 4. Shangrila 2 Preliminary Plat: Cindy explained the property is located east of Ammon Road, South of Georgia Lane, North of Samuel Road and West of Geneva. The current zoning is R1 -A. The total acreage is 1.62 acres. The plat contains 7 dwelling units – 3 single family detached units, 2 single family attached buildings each with 2 units. Lee Gagner – 2865 Ammon Rd - This is the 2nd phase of a 55 and older community. The 1st phase is in construction. He is planning to have three holes of golf by the stream and a practice putting range. It will include a 5-foot asphalt path leading to a gazebo. It will be a nice attractive area. The homes will be around 1320 to1400 square feet. The water and sewer infrastructure has been planned; they are going to petition the City to do the sewer construction across Ammon Road at night. Commissioner Hunsaker asked how many accesses onto Ammon Road. Lee said they are requesting two. Cindy said she is going to investigate in the state statue if the density is calculated from the middle of the road or property lines. Commissioner Robert Taylor asked regarding the future upkeep of the property since the Greenspace will be commonly owned. Lee explained the home owner’s association will own 1/20th of the fence and property. They will control the maintenance. Commissioner Steven Taylor moved to recommend approval to City Council of the preliminary plat for Shangrila Homes Division 2, finding it meets with City Ordinances and will serve the future needs of the community. Subject to technical review by staff and replatted each building on its own lot. The motion was seconded by Commissioner Robert Taylor. Roll Call Vote: Commissioner Steven Taylor – Yes, Commissioner Robert Taylor – Yes, Commissioner Torman - Yes, Commissioner Rydalch – Yes, Commissioner Hunsaker – Yes, and Commissioner Jones – Yes. The motion passed. 5. Shangrila 2 Final Plat: Cindy said this is the same piece of property. Except for lot one, the plat does not show the individual lots. The first lot is the existing brick home. The second lot will contain the remainder of the homes. This will become a condominium plat. Clint Jolley - Harper Leavitt Engineering, 101 Park Ave. Idaho Falls, ID. Explained the benefits of the Condominium plat as defined in State statue title 55 chapter 15. Vice Chairman Hunsaker said planning to replat lot 2 without resubmitting it for approval by City officials is not in compliance with State statute and does not meet the City’s plat requirements. Vice Chairman Hunsaker said the final plat either needs to show all the lots or it would require a conditional use permit. Cindy displayed and reviewed the City’s final plat requirements. Discussion ensued regarding if approving the single lot slated for future division into the condominium project without any further approval by City council meets the City requirements. Cindy said a development agreement must be submitted before the final plat will go before the City Council. Commissioner Torman moved to recommend approval of the final plat for Shangrila Homes Division 2, finding it meets with City Ordinances and will serve the future needs of the community, subject to technical review. The motion was seconded by Robert Taylor. Roll Call Vote: Commissioner Torman – Yes, Commissioner Robert Taylor – Yes, Commissioner Rydalch - Yes, Commissioner Steven Taylor – Yes, Commissioner Hunsaker – No (the plat does not meet the requirement of City Code), and Commissioner Jones – Yes. The motion passed. 6. Godfrey Property Preliminary Plat: 7. Godfrey Property Final Plat: Planning and Zoning Minutes 11.07.18 Page 3 of 3 Commissioner Robert Taylor moved to continue the preliminary plat and final plat for Godfrey’s Subdivision, per owner’s request. The motion was seconded by Commissioner Rydalch. Roll Call Vote: Commissioner Robert Taylor – Yes, Commissioner Rydalch – Yes, Commissioner Torman - Yes, Commissioner Steven Taylor – Yes, Commissioner Hunsaker – Yes, and Commissioner Jones – Yes. The motion passed. 8. Eagle Park Preliminary Plat: Cindy said the property is located east of Eagle Drive, south of Derrald, north of Sunnyside Road and west of Carolyn Lane. They are combining four different lots into one lot. The current zoning is HC-1. The total acreage is 9.648 acres. The developer is asking for the Preliminary and Final plat continued so they can provide updated information. 9. Eagle Park Final Plat: Commissioner Rydalch moved to continue the preliminary plat and final plat for Eagle Park, until further details can be attained. The motion was seconded by Commissioner Robert Taylor. The motion passed. 10. 2018-017 – Recommendation on Additional Hearing: Commissioner Steve Taylor moved an additional hearing for Public Hearing 2018 -017-Annexation of property in Mountain Bend Estates is not needed. The motion was seconded by Commissioner Jones. The motion passed. 11. 2018-017 – Adoption of Reasoning Statement: Commissioner Jones moved to approve the adoption of the Reasoning Statement for Public Hearing 2018 - 017-Annexation of property in Mountain Bend Estates. The motion was seconded by Commissioner Torman. Roll Call Vote: Commissioner Jones – Yes, Commissioner Torman – Yes, Commissioner Rydalch – Yes, Commissioner Steven Taylor, Commissioner Hunsaker – Yes, and Commissioner Robert Taylor – Yes. The motion passed. Findings for Recommendation – No written or verbal input was received from the public. This clea ns up a county island, and changes access to the property from 49th South, an arterial, to an interior street. The requested R-1 zone is the same as the rest of the development to the west, north and east. 12. 2018-018 – Recommendation of Additional Hearing PULLED 13. 2018-018 – Adoption of Reasoning Statement PULLED 14. 2018-019 – Recommendation of Additional Hearing PULLED 15. 2018-019 – Adoption of Reasoning Statement PULLED DISCUSSION ITEMS: Cindy said the City Administrator and City Attorney have approved the rewrites on commercial codes. She will e -mail PDF’s of the proposed changes to the Commission. She would like comments back so she can bring the commercial codes to hearing in January. Cindy asked the Commission if they would like to move the January 2nd meeting to January 9th. The Commission said they would like to change the meeting date to January 9th. REPORTS: City Council – Cindy reported on the October 4th, October 12th, October 18th and November 1st. City of Idaho Falls – Cindy shared points of interest from the meeting that were not in the Ammon access area. Parks, Recreation and Trails Commission – Commission Jones said the Quail Ridge trail’s construction will begin tomorrow. Ken is worki ng on the grant proposal for the 21st street trail. They are collecting citizen’s input letters. She said if the any Commissioners would like to submit any letters of support please e-mail them to her. Bonneville County – Tom shared points of interest from the meeting. They did not impact the City of Ammon.
