Cindy Donavan led the Pledge of Allegiance. Members Present: Steve Richards, Vice Chairman Tom Hunsaker Cindy Donovan Greg Maeser Robert Taylor Scott Wessel City Officials Present: Ron Folsom, Planning Director Lance Bates, Engineer Gay Leming, Deputy Clerk Absent Members: Quinn Simmons, Chairman Rick Butler Kurt Roland MINUTES: April 7, 2010: Commissioner Greg Maeser motioned to accept the minutes, as presented. Commissioner Cindy Donovan seconded the motion. The motion passed with 5-1 for the motion. Commissioner Scott Wessel abstained, since he was not at this meeting. PUBLIC HEARINGS: #2010-007–Extension of Conditional Use Permits Ammon Elementary and Tiebreaker Elementary: Ammon Elementary: Commissioner Greg Maeser sustained from this hearing since he owns property within the boundaries of notification of this hearing and does not want the appearance of a conflict of interest. Ron explained where the modulars are in the City. Roger Hill, 3497 Ammon Road, School District 93 stated the modulars are being used for th the Gifted and Talented Program and 6 grade. They are requesting a renewal of at least 3 years. Discussion was held on the reasoning for a time frame on modulars that were really a part of a growing community. Commissioner Hunsaker feels they should not be given a time frame and that the District could then use them as needed. By both City and State standards the modulars cannot be considered as temporary buildings, but they still require a conditional use hearing because they constitute a change to the school property’s overall conditional use. A conditional use hearing should only be needed when changes are made to the site plan, such as moving in an additional building or moving an existing building to a different location on the property. Commissioner Richards stated he felt a time frame was in order, but was comfortable with a longer time frame such as 5 years. Several of the other Commissioners agreed. Commissioner Robert Taylor motioned to recommend approval of the Conditional Use Permit for Ammon Elementary for modular buildings for 5 years. Commissioner Scott Wessel seconded the motion. All in favor - the motion passed. Tie Breaker Elementary: Ron explained where the school is located and showed the location of the modulars. Roger Hill, 3497 N Ammon Rd., School District 93, stated there are 2 modulars at this school and they would like an extension for at least 3 years. Jeff Miller, 390 Advantage Lane stated that these buildings are run down and there are no restrooms in these buildings, which causes problems for the children. Mr. Miller feels that the life of a modular building is around 5 years and these modulars are older than that. The steps are not safe and the buildings need to be repainted. He stated the District said they would not be permanent, but they are now becoming an eye sore. He feels that these are being left there too long and they need to be removed. Roger Hill stated that the District is mandated to have a state inspector come through every year for safety purposes. They have gone to metal steps that are handicap accessible, instead of wooden. He does not believe that five or six years on a modular should mean they are unusable. They should be able to get 10 to 12 years of use out of each modular unit. Discussion ensued on if the length of renewal time on these units should be the original 3-year time frame. Commissioner Hunsaker stated he feels we should be consistent with time frames. Commissioner Greg Maeser motioned to approve the Conditional Use Permit for the modulars at Tiebreaker for 3 years. Commissioner Scott Wessel seconded the motion. The motion carried 5 in favor with 1 against. Commissioner Hunsaker voted no, because he feels all modulars should be treated equally so they both should be 5-year permits. The motion passed. ACTION ITEMS: 1.Action on Public Hearings: See previous motions. 2.Recommendation on Public Hearing: Commissioner Tom Hunsaker recommended that no additional hearings were needed for Hearing #2010-007 Conditional Use Permit on neither Ammon Elementary nor Tiebreaker School. Commissioner Greg Maeser seconded the motion. All in favor - the motion passed. DISCUSSION ITEMS: 1. Conflict of Interest Clarification: Ron explained the State Statute on conflict of interest and stated the City Council had met with a representative from ICRIMP. The City insurance underwriter felt that there should be discussion on this subject with the P&Z Commission. All conflicts of interest should be stated before the Public Hearing begins. There was a discussion on each point of determining if there is a conflict of interest. It was stated if a Commissioner feels there may be a conflict, they should contact the City Attorney or declare a conflict to be safe. 2. Legislative Change on Comp Map Amendments: Currently the State Statue says that the Comp Map can only be changed once every 6 months. The State is changing this, so that it can be changed at any time. Ron would like the commission to think about what they want to do concerning this change. We can amend our ordinance or keep it as is. REPORTS: 1.City Council Actions: Ron went over what happened during the City Council sessions in April and May. 2.City of Idaho Falls Planning and Zoning Actions: Cindy Donovan had nothing to report. 3. Bonneville County Planning and Zoning Actions: Tom Hunsaker went over the conditions with wind turbines. CALL FOR ADJOURNMENT: Commissioner Scott Wessel motioned to adjourn. Commissioner Greg Maeser seconded. All in favor – the motion passed.
