Kurt Roland led the Pledge of Allegiance. th MINUTES: February 17, 2010: Commissioner Steve Richards motioned to accept the Feb. 17 minutes, as presented. Commissioner Tom Hunsaker seconded the motion. All in favor - the motion passed. rd March 3, 2010: Commissioner Greg Maeser motioned to accept the March 3 minutes, as presented. PUBLIC HEARINGS: 2010-004 – Conditional Use Permit – District 93 – Hillcrest High School – Modular’s: Ron explained where the location is and why the school needs the modular’s. Roger Hill, 3497 N Ammon Rd from District 93 stated they would like the modular’s placed on the north end of the vocational wing of the building. Hillcrest was built for 1200 students, there are currently 1296 attending and with the freshman coming in next year there will be about 65 more students than this year. The modular are 2007 models and they will add 4 classrooms. There is no plumbing in the modulars. The school district purchased them in January. They have two buildings scheduled for Hillcrest and two for Iona Elementary; however, the latter two might change to Bonneville High School. They will be placed during the summer after school is out. There are two classrooms in each modular. The school hopes to have a new high school built in the fall of 2014-2015. They are looking at several options. Ron stated that the Council has a limit of 9 total temporary school buildings in the City; however, this would move them to 11. There was discussion about extending the amount of time for the Conditional Use Permit, as long as they aren’t used for storage. Commissioner Hunsaker mentioned that modulars were viewed as a sign of prosperity from where he was raised. Commissioner Taylor stated that the students and teachers meeting in modulars feel like second class citizens, the buildings aren’t hooked up to the intercom system and sometimes the emergency system. It was discussed that this trend has reversed and modulars now tend to have more modern amenities than the main building. Commissioner Greg Maeser motioned to recommend to City Council approval of the Conditional Use Permit as requested by District 93 for two modulars for a term of five years, subject to technical review, at the location shown on the site plan as Site B. Commissioner Tom Hunsaker seconded. All in favor – the motion passed. 2010-005 – Conditional Use Permit – Turtle Bay Pool and Tennis Courts, Rick Adolpho – Renewal Request Ron explained this is located on the corner of Stafford and Bungalow. The Conditional Use Permit (CUP) expires April 30, 2010. The Council put conditions on the CUP, due to concerns of traffic from the first public hearing. Conditions include operating hours no earlier than 5 a.m. and no later than 11 p.m., no lighting on the tennis court, two year review and renewal, minimum of a six foot sight obscuring fence, no parking on the Public Street, and insurance policy in the amount of $1 million with the City named as an additional insured. There have been 3 complaints in the last 2 years, with the last one being August 2009 concerning loud noise. The request is to renew the permit with the current conditions. Rick Adolpho, 2658 Stafford Drive would like to renew the Conditional Use Permit and would like to extend the permit longer than the 2 year period (permanently, if possible). He was not aware of any complaints. Ron said staff handled the complaints, so there was no reason to contact Rick. There is no parking on the street. Rick stated the facility is for the convenience of the neighborhood. Ron said all statements on the recording tapes from the original hearing show it was the intent of both the City Council and the owner that memberships would not be sold outside the neighborhood. Rick said this limitation wasn’t included as a condition of the CUP. Tom said the reason for the limitation was partly due to the parking. Rick would like to be able to sell out side of the cottages, so that he could fill his memberships. He would like to have 80 household memberships. Rick stated he extended the parking lot, so you can enter into two different sides – one on the east and the other on the north. Lance said you could probably park approx. three vehicles, if it was striped. Rick said it can handle ten with four on the east, and four to five along the edges. Lance said you could physically get more in, but it would impact how cars can come in and go out. Rick stated he has had 3-4 parties there with approx. 20 people at one time. Darrell Grebb, 2606 Stafford Cove, said he has been a member, since day one. He really enjoys it. It is a chance to get to know your neighbors. He has never noticed cars parked on the street. Fawn Zirker, 5073 Tildy Lane said she wanted to let the Commission know what a wonderful place it is, where people in the community can get together. She does not understand why people can’t park on the street, if you can park on the street in front of your house. It is very rare that there are cars parked on the street. She would like to see people outside of the Cottages buy into this venture. She would like the City to support this, so that it doesn’t become an empty property that becomes an eyesore to the neighborhood. Stephanie Bales, 2720 Bungalow said she has concerns with the parking on the street, since it is a very busy corner. She has called the police to have the cars removed and the corner is not a good place to have one lane. She doesn’t want memberships to be sold outside of the Cottages, since she doesn’t want to live next to Gold’s Gym. There is a gap in the fence and children get under the fence into her property. She does not want it to be turned into a public access for anyone outside of the Cottages. She is concerned with the monthly or per use fees. She has seen signs that said “over Spring Break bring your friends and pay $5 per person”. She understood this wouldn’t be permitted and doesn’t want a City pool in the neighborhood. Rick Adolpho, 2658 Stafford said he will take care of the fencing issue. The members outside of the Cottages are only speculation. He feels that Mrs. Bales is only complaining, because they aren’t members and can’t afford it, so they complain. Ron stated that the City did not prohibit the total number of memberships that can be sold. The occupancy load is the capacity limit of the building. The Council also didn’t mention that they couldn’t sell monthly memberships within the Cottages. The Council doesn’t feel they should be concerned in the business aspect of this venture. The public hearing was closed and discussion ensued to the parking issues, time limit of the CUP, memberships sold in or outside of the Cottages and a commercial venture in a residential area that had been raised. Several members wanted the membership limited to the neighborhood, if sold outside they feel this would be a commercial venture. Commissioner Greg Maeser motioned to recommend to the City Council renewal of the Conditional Use Permit for Turtle Bay Pool and Tennis Courts, with the same conditions as the original permit with the exception that the CUP would be for three years and renew automatically, unless the City receives a written complaint within that time period, which would trigger another Public Hearing. Commissioner Robert Taylor seconded. The vote was.4 in favor and 2 against. The motion passed. Commissioner Steve Richards voted no, because he thinks a recommendation should have been made whether memberships can be sold outside of the Cottages. Commissioner Kurt Roland agrees with Steve and adding that street parking is okay, as long as, they don’t park in the safety sight triangle, and maybe the City needs to put up no parking signs in that area. ACTION ITEMS: 1. Action on Public Hearing: Public Hearing 2010-004 and Public Hearing 2010-005 above. 2. Recommendation on Public Hearing: Commissioner Steve Richards motioned that no additional public hearing was needed for District 93 Hillcrest modulars. Commissioner Greg Maeser seconded. All in favor – the motion passed. Commissioner Greg Maeser motioned that no additional public hearing was needed for the Turtle Bay Pool and Tennis Courts. Commissioner Robert Taylor seconded. All in favor - the motion carried. th 3. Site Plan – 2844 E 14 N: Ron stated the staff has reviewed this site plan and it meets the City’s parking, sidewalks, meter and landscaping requirements. Ron’s understanding is this is a storage shop. Commissioner Greg Maeser motioned to approve the site plan as presented, subject to technical review. Commissioner Kurt Roland seconded. All in favor – the motion passed. DISCUSSION ITEMS: 1. Website Bios: Any Commission member that had not given his or her information to Ron was asked to please do so, as soon as possible. 2. Comp Plan Meeting – April 21, 2010: Ron advised the Commission of the date. 3. P&Z Appreciation Dinner: Ron asked the Commission if they had any preferences, besides Chuck-A- Rama. The City tries to rotate through the restaurants in town. The City has changed who will attend to the Commissioners, Council, City Clerk and City Officials who attend the Commission meetings with spouses. It was rd decided to try the Chuck-A-Rama Restaurant on May 3. 4. Misc.: Lance explained why some of the options that had been considered, but not recommended for Turtle Bay were not viable. If you allow memberships outside of the Cottages, it would become a commercial facility. Commercial facilities have required parking spaces and this does not have enough room for commercial parking. This subdivision has swales, so if parking is allowed either on the side of the road or in the swale, each time a car tire crosses between the asphalt and the dirt or grass of the swale, the edge of the road is broken down. These are City roads, which we have to maintain. “No parking” signs have been installed in Hawks Landing; however, the signs are ignored. It does, however, become an item the City can enforce. Another issue is snow plow operations with off-street parking, which causes problems. Ron said this building was built as a public use building, so it had to be built as a commercial building. Since it was built in a residential area, then parking and accessibility rules were not needed. If this is opened up outside of area, this would dramatically change. REPORTS: 1. City Council Action s - Ron advised the Commission of the actions taken by the Council during the previous month. 2. City of Idaho Falls Planning and Zoning Actions – Commissioner Donovan was not available for comment. 3. Bonneville County Planning and Zoning Actions – Commissioner Hunsaker stated the County did not have a Planning and Zoning meeting in March.
