Planning Minutes 08/16/2006 CITY OF AMMON PLANNING AND ZONING COMMISSION August 16,2006 MINUTES The meeting was called to order by Chairman Cindy Donovan at 7:00 p.m. in the City Building at 2135 South Ammon Road, Ammon. Idaho Members Present: Cindy Donovan, Chairman Jarin Hammer, Vice Chair Tom Hunsaker Rodney Allen Leslie Folsom Greg Maeser Richard Jaussi Steve Crandall Robert Gustafson Members Absent: Tristan John City Officials Present: Ron Folsom, Planning Director Bill Manwill, City Engineer Gay Leming, Deputy Clerk Bob Gustafson led the Pledge of Allegiance to the Flag. Minutes: None PUBLIC HEARINGS: Doves Landini! Request for Annexation with Initial C-I. R-2 and RP-A Zonine City Planning Director Ron Folsom presented slides of the location and vicinity. The property is located at the east end of 17th Street, along the east side of 45th east and, north of 21 st South. Chairman Donovan explained the hearing process and opened the hearing. Jason Crofts, 7103 S., 45th West, Idaho Falls, of Schiess and Associates, presented the request for the developer. The Developer is looking to do a Planned Unit Development on the R-2 portion. The C-I and RP-A zoning requests are consistent with the Comprehensive Plan. They are aware that about 2/3' s of the property is in the flood plain and have completed an engineering study that will mitigate flooding of the property and provide for a flood channel. Paul Mangelson, 11110 Old Saddle Road, Draper, Utah, the Developer, testified in support of the request. They plan to shift the single family dwellings away from the high traffic roads and provide a greenbelt between the connnercial and residential portions by using the flood channel as a buffer. The Channel will be built as they go. Jason Crofts stated that a 100 foot channel will work; however, they have planned for 120 feet. Mary Taylor, 4825 East 21 st South, Idaho Falls, asked for clarification about what types of development are allowed in C-1, R-2 and RP-A zones. Frank Schwartz, 4823 E. 21 st South, Idaho Falls, testified that he wants to make sure that the irrigation to his property is not affected. He has animals and will still have them. He asks the Developer makes provisions so that nobody comes on his property from the development. John Seedall, 6747 North 45th East, testified that he is concerned that the flood control channel will not be maintained. He wants to know who will maintain the channel. He is also concerned that the property has not been studied for the flood plain. Carolyn Cook, 1366 South 52nd East, Idaho Falls, urged the Developer and the Connnission to listen to the farmers who know the land so they can help. Planning & Zoning 08/16/2006 - 1 Max Olsen, 1165 South 45th East, Idaho Falls, owner of the property north of the proposed annexation. There is an irrigation ditch running through the subject property and he is concerned that it is not being addressed. Mr. Olsen asked what is going to stop the water from the north running through his property from flowing into the development. Jason Croft addressed the irrigation ditch. The ditch is being rerouted east up 17th Street from Crowley and along the flood channel down to 21 st. They anticipate it remaining an open ditch. Paul Mangelson testified that they know there are drainage and irrigation ditches and they will make provisions for them. They will not change the design whether a flood channel is needed or not. He assured the individuals who testified and the Commission that irrigation drainage will not be overlooked and will be maintained. Chairman Donovan closed the public hearing. The Commission discussed the requested annexation and initial zoning. Leslie Folsom motioned to recommend approval of the Doves Landing annexation and initial zoning as proposed. Greg Maeser seconded. Seven in favor, two opposed. Steve Crandall voted against as he feels there needs to be more planning done prior to the annexation. Bob Gustafson is opposed the R-2 zoning. ACTION ITEM: Doves LandinI! Preliminarv Plat: City Planning Director Ron Folsom presented slides of the proposed Final Plat. The property being platted is that discussed in the foregoing public hearing. The Commission discussed the proposal, focusing on the flood channel and on green space. Most felt that the flood channel could be considered as green space. Jarin Hammer motioned to recommend approval of the preliminary plat with the following stipulations: 1. That a 15 foot walking trail be included and dedicated to the City as part of a trail system; 2. That the Council and City Engineer address the access to Crowley from the C-l section; 3. That landscaping ofthe channel be considered as a whole (since no park has been required); 4. That the approval is not an approval for the building sites that are shadow-lined on the R-2 section; 5. That the Council address the possible need for a signal light at 17th and Crowley; and 6. That the Council address if it would be better to have the developer covers the ditch/canal in the subdivision. Leslie Folsom seconded. All in favor, the motion carried. Tom Hunsaker motioned to recommend the Council hold a hearing for the Doves Landing annexation and initial zoning. DISCUSSION ITEMS: City Planning Director Ron Folsom recommended that the Commission table discussions of the pending Comprehensive Plan Changes until a Planned Unit Development Ordinance is drafted. He also distributed packets to the Commission which contained ideas regarding regulation of Planned Unit Developments.
