PLANNING AND ZONING COMMISSION
MINUTES
September 6, 1994
The meeting was called to order at 7: 30 P.M. by Chairman
Dick Bybee. It was held at the Ammon City Building located at
3270 Molen Street.

The Pledge of Allegiance to the Flag was led by Brian Taylor
after which the Minutes of August 2, 1994 were presented for
approval. Jim Southwick motioned they be approved as written.
Roger Stommel seconded the motion. Voting was unanimous. The
motion carried.
The first item of business was a request dated September
1, 1994, by Kevin Hungate, Jackie Chambers and Ren Chambers to
the City of Ammon to vacate, abandon and otherwise return to the
present owners that parcel of land located on the west boundary
of the Chambers Addition which is dedicated as a public
right-of-way. (letter of request attached.)
After reading the letter of request and studying the issue
at hand, Jim Southwick quoted from zoning ordinance 11-5-10,
further explaining to those requesting abandonment that this
ordinance requires all residences to abut upon a public street.
As the configuration of the addition would not conform to this
ordinance, specifically Lots 1, 2, & 3, the abandonment of said
right-of-way would be in violation of this ordinance.
It was stated that as this property is zoned C-1 with the
potential to develop it as such in the event it is sold, Jackie
Chambers asked why it couldn't be changed now before it's sold.
Kevin Hungate further stated they would maintain the drive way
even with the right-of-way abandoned.

Brian Taylor explained about the residences not being
located abutting a public street if the right-of-way is vacated.
Mike Marlatt suggested several alternatives to the property
owners, however they declined these at this time.
