General Call for Adjournment: MINUTES The meeting was called to order by Chairman Scott Wessel at 7:00 p.m. in the City Building at 2135 South Ammon Road, Ammon, Idaho. Robert Taylor led the Pledge of Allegiance. Members Present: Scott Wessel, Chairman Tom Hunsaker Cindy Donovan Rick Butler Greg Maeser Quinn Simmons Robert Taylor City Officials Present : Ron Folsom, Planning Director Lance Bates, Engineer Gay Leming, Deputy Clerk Members Absent: Kurt Roland Steve Richards MINUTES: Amended March 7, 2012: Commissioner Quinn Simmons moved to accept the minutes as amended. Commissioner Tom Hunsaker seconded the motion. All in favor – the motion passed. PUBLIC HEARINGS: Chairman Scott Wessel explained the procedure for the public hearing. No written comment was received. 1. 2012-006 – CUP – Request to use SF Residence as Model Home and Two Offices: Ron explained where the property is located and the reason for the request. Shay Higley, 2236 Quail Ridge Drive, said he would like to use this house as a model home and have two people working there, one office manager and one sales rep. They will not allow any sub contractors to come to this property for any reason, to avoid adverse impact on access to the model home, and to avoid an increase in traffic. He would like to have the CUP for two to three years. Shay said he will fix the fence and put up a flag pole. Shay is going to ask the owners of East Gate Drug if he can use a few of the lots 12 Planning and Zoning Minutes 5-16-12 Page of on their property for parking. Shay said he will furnish the upstairs with the officer manager and a showroom in the basement. The hours will be from 9:00 a.m. to 7:00 p.m. The lot at this time is zoned RP-A. Josh Higley, 4615 E. Long Bow Bend, Idaho Falls, Idaho explained that they have a four man team so there will be no need for more offices in this home. Chuck Osterhout, 1845 Midway, said he is in opposition of the CUP. Chuck said he is opposed because, he doesn’t know what the finished product is going to look like. He doesn’t want it to be there for three years. He is worried about how the lighting of the show home will affect his house next door at night. He doesn’t want lights on at midnight shining in his house. Cheryl Osterhout, 1845 Midway said the problem is she does not know how many people will be coming to the house. Cheryl said that 17th street is close enough and she feels that it will bring 17th street even closer to their door. She would also like to know what will be dividing the properties between the 2 homes. Shay Higley, 2236 Quail Ridge Drive. Shay explained that the lighting will be recessed eave lighting, and that will be the only lighting besides the light at the flag pole, and that light can face toward 17th Street. Shay said there will be cement to the road from the garage .With the school down the road he is not sure that two or three more cars will really make a different with the parent traffic from the school. Tom Hunsaker asked if the light is 100 percent on the house. Shay said yes. Commissioner Robert Taylor said he thinks it will beautify the neighborhood and recommended a two to three year term for the CUP. Commissioner Cindy Donovan thinks it is great to have a house there. She believes that there should be no requirements on what they have to do to the property because we would not require anyone else to do the things the neighbor wants. Commissioner Rick Butler thinks this isn’t a traditional use so there so should be stipulations on the property. Commissioner Greg Maeser thinks the time frame should be two years. Commissioner Quinn Simons thinks that having a home there will be a benefit. He feels there will not be that much traffic, and a limit of three years is appropriate. Commissioner Tom Hunsaker likes what has been said. Good way to test the waters. Commissioner Scott Wessel said they can build a house there and they could have an open house every week and the City couldn’t do anything. The time limit is the only issue he had, and best business practice would be two years. Commissioner Quinn Simmons moved to recommend the City Council approve the CUP for the use of the property laid out in the CUP, with the condition that it retains a residential appearance for the time limit of three years. Commissioner Robert Taylor seconded the motion. 5 for and 2 against. The motion passed. Commissioner Cindy Donovan was opposed to the motion, because she thinks that a time limit of two years would have been enough. Commissioner Rick Butler agreed with Cindy. ACTION ITEMS: Recommendation on hearing: Commissioner Cindy Donovan moved for no additional hearing. Commissioner Robert Taylor seconded the motion. All in favor - the motion passed. DISCUSSION ITEMS: General Call for Adjournment: Commissioner Greg Maeser moved to adjourn the meeting. Commissioner Quinn Simmons seconded the motion. All in favor – the motion passed.
