M. by Mayor Keith C. the following City Officials present: Mayor Keith C. Turnbow Councilman Russell N. Swensen Councilman Marvin J. Anderson Councilman Gerald B. Cheney Councilman James H. Southwick Turnbow with Clerk Deon Hemingway Attorney Franklin Smith Engineer David E. Benton (arrived later) Prayer was offered by Councilman Anderson. The minutes of the meeting of August 15, 1973, were approved as typed with one correction. Attorney Franklin Smith, representing City Attorney W. Joe Anderson, reported that a thorough review of the proposed recodification of the Municipal Code as recommended by the Study Committee earlier this year is still in process and resulting in a considerable amount of deletions and changes. The opinion of the Mayor and Council on a few areas of the recodification was requested and received by Attorney Smith. (See insert of minutes prepared by Attorney Anderson regarding resolution tO~::}e~-.::~tr provide interim financing for the sewer and water improvement comtruction. ) ";--:-/e ~",q.'t Mayor Turnbow reported that official approval of the Water and Sewer Project bids has been received from HUD, FHA, and the State Health Department, and approval is expected from EPA at any time. A pre-construction conference is scheduled for Thrusday, Sept. 13, 1973, at 1:00 P. M. in the Ammon City Hall. A request from Upper Valley Telecable Company- to have the City pass an ordinance making damage to their lines, obstructing service, unauthorized use of the service, etc., illegal was referred to the City Attorney to make a recommendation. The Attorney was also asked to advise the Council on a request made by KID Broadcasting Company to have the City act on a petition of waiver which regulations require them to have in order that they might own an interest in the cable television business. Approval was given to a proposal made thrOugh Mayor Turnbow by the City Mainten- ance Supervisor to remove the drinking fountains in Lions Park since they are not usable due to damage by the public. Charges against a new boy, who lives across the street from the park, for recent destruction to one of the fountains is being handled by the Attorney and the Sheriff I s Office. A copy of a request from the residents of Sabin Drive for further consideration of speeding problems on that street was presented to Council members and the attorney. The delegation will be scheduled to appear at the next regular meeting to receive informed answers to their questions and discuss the situation as needed. The pos sibility of making bicycle paths in certain places thrOughout the city because of the increased bicycle traffic was presented by Mayor Turnbow for the future con- sideration of the Council. Opening of such a path thrOUgh the Horace Smith property between Ammon Road and the Southwick Addition to provide more safe access to the Hillview School for Children living east of the Ammon Road was given special em- phasis, and suggested for a cost study, etc. Mayor Turnbow's proposal to start registering bicycles in the City beginning in 1974 was felt advisable by the Council, and the authority for this will be incorporated into the recodification. 20 The problem of the pumice which was spilled by Amcor on Sunnyside Road near the Ammon Road and pushed off. into the borrow pit was discussed. If the City maintenance has no use for this material, the responsibile company (Amcor) is to be notified to have it cleaned up. Councilman Swensen reported that the County Engineer has advised him that sealcoating work is scheduled for Sunnyside Road in the near future and will gO on through the Ammon City limits if desired. The feeling of the Council was that, if an estimate indicates a cost of $500 or less, the City would con- sider having the work done. The County Engineer also informed Councilman Swensen that the present plans for the major imporvements on 17th Street are for the first quarter of 1974 and the local participation in this project is now set at 22% rather than the 38% quoted previously. I In a report on the BCOG meeting. Councilman Swensen mentioned that sUgges- tions for a name for the "noise park" being developed west of the City of Idaho Falls are requested. Also, the Farmers Home Administration has y' some money for purposed such as fire stations, etc., with a meeting about this to be held on September 12. BCOG personnel indicated to Councilman Swensen that procedures for carrying out the building inspection agreement are going all right except for complaints from some contractors concerning the inconvenience of waiting for plan checks before permits are is sued. Mayor Turnbow again requested that the matter of placement of mob ilehomes in the county be brought to the attention of the BCOG, specifically asking if the fact that there are now six such homes on the hill east of Ammon means that there is going to be a trai1ercourt there. f Councilman Anderson presented a problem of a fire hydrant apparently having been located inside the property line on Ross Avenue north of Sunnyside Road when installed by the developer several years ago. Engineer Benton was asked to check into this and make a recommendation as to the proper placement and the city's responsibility~ in moving the fire hydrant. Contractors involved in leaving a hole along the curb and gutter on the east side of Ross Avenue are to be notified by Engineer Benton to get this filled in. I The previous month's fire department activities were reported by Councilman Southwick, along with several items which have been brought to his attention that need to be taken care of by the. city maintenance crew. He presented for discussion a Bui1'ding Per.mit application for setting a trailerhome on a lot at Owen Street and Romrell Lane, noting that this application had been reviewed by the Planning and Zoning C ommi s s ion Building Pe rmit Committee and re- commended for disapproval since it does not meet zoning requirements. Councilman Southwich moved that Building Permit #1521 be denied as recom- mended by the Planning and Zoning Commission Building Permit Committee unless it would meet the Uniform Building Code of the State of Idaho. Seconded by Councilman Cheney; voting all in favor; motion carried. Councilman Southwick reported that the residents of Blocks 6 and 8 of the Original Townsite have made a proposal through the Planning and Zoning Commission to have turn-arounds (cul-de-sacs) put in the middle of those blocks rather than opening the dedicated alleyways for through streets as planned by the City. It was understood that the property owners would provide property for the turn-arounds and the City would abandot'l the right-of-way through I the remainder of the block. A suggestion was made that, perhaps the City should retain part of the right-of-way to put a sidewalk path through from the turn-arounds to the next street. It was decided that this matter should be referred to the Planning and Zoning Commission for consideration, and Engineer Benton would work out the necessary details for obtaining deeds for the property needed for the turn-arounds plus 5 feet additional for a sidewalk easement surrounding the cul-de-sacs. A. Wm. Brunt Jr. did not appear, so no action was taken on the written re- quest he had submitted dated Aug. 16, 1973. Mayor Turnbow proclaime d that a General City Election will be held on Nov- ember 6. Petitions of Nom- ination are available from the City Clerk and must be filed between September 27 and October 9. After everyone had been welcomed by Councilman Swensen and introductions had been made, the meeting was turned to Mr. Hurst of HUD who asked Larry Perkins to direct the business. Inquirer!; and comments were invited from the representatives of the utility companies. Utah Power&: Light Co. needs a set of plans and will work with the contractors in moving poles if necessary. Mountain Bell representatives received prints recently, but are nots yet familiar with them. In response to a question about shoring of trenches, they were advised that contractors must meet safety standards and trenches will be shored or caged. Assurance was given that preliminary planning has tried to eliminate as much as possible interference with telephone poles and buried cables so the telephone company should not be called upon excessively for relocating and repairing lines. The Intermountain Gas Company men requested all possible nttice when construction will be in the vicinity of gas line s, and would like to try to work a day ahead rather than on an emergency or way ahead. Mr. Hansen of the Department of Labor advised the contractors that he would like to receive a copy of wage rates monthly. Two copies of certified payrolls are to be supplied to the City.
