A. CALL TO ORDER: Mayor Sean Coletti opened the meeting at 7:00 p.m. at the Ammon City Hall
building located at 2135 South Ammon Road. Council Member Wheeler led the Pledge of Allegiance
and Council Member Thompson offered a prayer.

C. PROCLAMATIONS AND ANNOUNCEMENTS:
Mayor Coletti presented and signed the small business Saturday proclamation for 2020.
Small Business Saturday November 28
Whereas, the government of AMMON, IDAHO, celebrates our local small businesses and the
contributions they make to our local economy and community; according to the United States Small
Business Administration, there are 31.7 million small businesses in the United States, they represent
99.9% of all firms with paid employees in the United States, are responsible for 65.1% of net new jobs
created from 2000 to 2019; and
Whereas, small businesses employ 47.1% of the employees in the private sector in the United States,
62% of U.S. small businesses reported that they need to see consumer spending return to pre-COVID
levels by the end of 2020 in order to stay in business, 65% of U.S. small business owners said it would
three-quarters of U.S. consumers are currently looking for ways to Shop Small® and support their
community; and
Whereas, 96% of consumers who shopped on Small Business Saturday® agree that shopping at small,
independently-owned businesses supports their commitment to making purchases that have a positive
social, economic, and environmental impact and 97% of consumers who shopped on Small Business
Saturday agree that small businesses are essential to their community; and
Whereas, 95% of consumers who shopped on Small Business Saturday reported the day makes them
want to shop or eat at small, independently-owned businesses all year long, not just during the holiday
season; and
Whereas, AMMON, IDAHO supports our local businesses that create jobs, boost our local economy,
and preserve our communities; and
Whereas, advocacy groups, as well as public and private organizations, across the country have
endorsed the Saturday after Thanksgiving as Small Business Saturday.
Now, Therefore, I, SEAN COLETTI, Mayor of AMMON, IDAHO do hereby proclaim, November 28, 2020,

D. PUBLIC COMMENT REGARDING ITEMS NOT ON AGENDA (5-minute limit)
Randy and Donetta Severinson, 3877 Taylorview Lane, spoke to Council regarding the flooding
issue in their neighborhood. They explained the issues they had experienced in their home and
with the driveway. Council reviewed the area in question and discussed with the Severinsons.
City Engineer Tracy Bono spoke to the concerns in the area. Council asked Staff to add the
concern to the Strategic Plan for future project completions and continue discussions to address
the issue.
E. PUBLIC HEARING:

1. 2020-031 1 Street Urban Renewal Plan and District Formation
Before beginning the hearings, Mayor Coletti provided instructions for those on Zoom with
comments on the hearings. Administrator Austin gave a brief introduction to the plan presented
for the public hearing.
Mayor Coletti opened the Public Hearing.
Administrator Austin read a letter from the Bonneville County Commissioners.
Ryan Armbruster, legal counsel for the district, responded to the letter and clarified questions
for Council with discussion.
Steven Lovell, 3635 E Greenwillow, Idaho Falls, spoke on behalf of the Lincoln Cemetery District
and asked a few clarifying questions regarding the Plan.
Tom Hunsaker, 2925 Carolyn Ln, questioned what the impact of the Plan would be on law
enforcement. Council discussed.
Mayor Coletti closed the hearing seeing no other comments

1. The Ammon Urban Renewal Agency has submitted the proposed Urban Renewal Plan for

Planning and Zoning Commission for review and recommendations concerning the

conformity of said 1 Street District Plan with the Ammon Comprehensive Plan (the
-2008(b).
3. On October 7, 2020, the Planning and Zoning Commission found the 1st Street Urban
Renewal Plan in harmony with the Comprehensive Plan and approved Resolution 2020-01PZ
affirming their findings, according to § 50-2008(b).
4. On October 16 and October 31, notice the public hearing for November 19, 2020,
according to State Code.
5. Adoption of Ordinance 651 is the last remaining step for the City Council for creation of

the 1 Street Urban Renewal District.

The first district is the Hitt Road Urban Renewal Project, which encompasses Albertsons,
Target, and the adjacent shopping areas. The Hitt Road Urban Renewal Project was created
in 1994 and will close in 2024.
7. The Ammon City Council has discussed the 1st Street Urban Renewal at public meetings
numerous times over the last three years as an item on the agenda and as a discussion item
for providing direction to staff.
Financial Impact
- The Ammon Urban Renewal District is a separate entity from the City of Ammon with its
own financial accounting.
It was moved by Council Member Slack and seconded by Council Member Wiscombe to with the rule
requiring the reading of the ordinance on three different days and that the three readings be waived.

Austin reviewed the proposed amendments to the Code with Council.

3. Approval/Rejection of Proposals BMPO Consultant (Tracy Bono, City Engineer)
Administrator Austin and City Engineer Tracy Bono explained the purpose of the proposal and the
potential benefit to the City for with BMPO. Bono detailed the responses that were submitted and
outlined the next steps that would be taken by staff to implement the

1. The RFP was to get proposals from engineering firms to help the City in preparing projects to
submit to the BMPO for considerations to receive federal funding.
2. According to state statute, the Request for Proposal (RFP) was advertised on October 16 and October
23, 2020 with October 29, 2020 at 4:00 pm the deadline for all responses
3. Based on the following criteria, Staff recommends hiring Horrocks Engineers for the project:
a. Past experience and familiarity with Ammons future street designs.
b. Competency of the listed team members.
c. Experience dealing with federally funded projects

Discussion and Approval of Resolution 2020-015R to initiate the formation of Fiber Optic LID #4 and
Resolution 2020-16R to authorize the public notice process of intention to create Fiber Optic LID #4

- Staff recommends approval of Resolution 2020-0015R and 2020-16R.
Summary of Analysis
1. The formation of Local Improvement Districts require specific public processes as outlined by
law.
2. The adoption of Resolution 2020-0015R publically initiates the formation process.

4. The adoption of Resolution 2020-0016R authorizes the public notification process for property
boundaries.
5. Approval and adoption of these two resolutions simply starts the process, it does NOT create
the LID.

FIBER OPTIC LOCAL IMPROVEMENT DISTRICT NO. 5
A RESOLUTION INITIATING THE FORMATION OF FIBER OPTIC LOCAL
IMPROVEMENT DISTRICT NO. 5 FOR AMMON, IDAHO, FOR THE
DESIGN, ACQUISITION, CONSTRUCTION AND INSTALLATION OF
CERTAIN FIBER OPTIC SYSTEM IMPROVEMENTS AND RELATED
ITEMS AND DESCRIBING THE (i) KIND AND CHARACTER OF THE
PROPOSED IMPROVEMENTS; (ii) THE BOUNDARIES OF THE PROPOSED
LID; AND (iii) THE PROPERTY TO BE ASSESSED WITHIN THE
PROPOSED LID.
WHEREAS, the City of Ammon, Bonneville CountyCitymunicipal
corporation operating and existing under and pursuant to the provisions of the Constitution and
laws of the State of Idaho;
WHEREAS, the City desires to finance the costs of design, acquisition, construction and
installation of certain fiber optic system improvements and related appurtenances as hereinafter
WHEREAS, pursuant to Title 50, chapter 17, Idaho Code, the City is authorized and
empowered to create local improvement districts and to construct improvements pursuant
thereto, and, in accordance with Section 50-1706, Idaho Code, the City desires to adopt this
Resolution to initiate the organization of a local improvement district to finance the construction
and costs of the Improvements.
NOW THEREFORE, IT IS RESOLVED by the City Council of the City as follows:
Section 1. The City hereby initiates the creation of a local improvement district to be
known as Fiber Optic Local Improvement District No. 5 for Ammon, IdahoFiber LID No.
5, for the purpose of financing the construction and costs of the Improvements.
Section 2. The boundaries of proposed Fiber LID No. 5 are particularly described in
Exhibit A attached hereto and incorporated herein by this reference. Only the property of those
landowners situate within the boundaries of proposed Fiber LID No. 5 who have specifically
elected to be benefited by the Improvements will be assessed.
Section 3. The general description of the Improvements to be constructed within
proposed Fiber LID No. 5 is set forth on the attached Exhibit B attached hereto and incorporated
herein by this reference.
Section 4. This Resolution shall take effect and be in full force from and after its
passage.

WHEREAS, the City of Ammon, Bonneville Citymunicipal
corporation operating and existing under and pursuant to the provisions of the Constitution and
laws of the State of Idaho;
WHEREAS, the City desires to finance the costs of design, acquisition, construction and
installation of certain fiber optic system improvements and related appurtenances as hereinafter
described (c as hereinafter defined);
WHEREAS, pursuant to Title 50, chapter 17, Idaho Code, the City is authorized and
empowered to create local improvement districts and to construct improvements pursuant
thereto, and, in accordance with Section 50-1706, Idaho Code, the City desires to adopt this
Resolution to initiate the organization of a local improvement district to finance the construction
and costs of the Improvements;
WHEREAS, the City Council of the City City Council is of the opinion that it is
in the best interest of the owners of property and of the inhabitants within the proposed local
improvement district that the proposed local improvement district be created for the purpose of
financing the construction of the Improvements;
WHEREAS, Sections 50-1707 and 50-1708, Idaho Code, provide that the City Council
give notice of its intention to create the local improvement district to finance the Improvements,
and to levy assessments to pay all or a part thereof.
NOW THEREFORE, IT IS RESOLVED by the City Council as follows:
Section 1. The City hereby determines and states that it is the City
local improveFiber Optic Local Improvement District No. 5 for
Ammon, Idaho (Fiber LID No. 5), to construct the Improvements and to levy assessments to
pay for all or part of the Improvements.
Section 2. The boundaries of proposed Fiber LID No. 5 are described in Exhibit A,
attached hereto and hereby made a part hereof. The City Council is of the opinion that said
description is sufficient to inform the owners that their property is included within Fiber LID No.
5 and available to be assessed. Property owners desiring to receive installation of a fiber optic
line to their property, and thereby be benefited by the Improvements (hereinafter defined), must
affirmatively opt-in to incurring the related assessment necessary to pay for the same. Only the
property of those property owners situate within the boundaries of the proposed Fiber LID No. 5
who have specifically elected to be benefited by the Improvements will be assessed. Property

Section 3. A general description of the improvements to be constructed (the

(i) The design, acquisition, construction and installation of fiber optic system
improvements and related appurtenances, including, but not limited to: (a) fiber optic cable, duct,
vaults, pedestals, enclosures and terminations, (b) premise equipment, (c) remote office switch
equipment and optics, and (d) installation labor;
(ii) Acquisition of easements and/or rights-of-way, as necessary; and
(iii) Engineering, legal, accounting, costs of bond issuance, costs of interim financing,
costs of financial advice, the funding of a guarantee fund and/or reserve account to secure
payment of financing, and other costs incidental thereto. It is anticipated that all work will be
performed by the City and that all materials will be supplied pursuant to the sole source
procurement provisions of Idaho Code § 67-2808 after publication of proper notice.
Section 4. The City presently estimates that approximately 700 properties within Fiber
LID No. 5 will elect to receive the Improvements and be assessed, although this number may
vary depending on property owner opt-in rates. Based on this estimate, the total cost and
expenses of the proposed Improvements, exclusive of costs relating to interim warrants, reserve
and guarantee funds, issuance and financing, is projected to be in the range of $2,310,000 to
$2,590,000, all of which shall be borne by and assessed against the properties specially benefited
by such Improvements in proportion to the benefits derived by such properties by said
Improvements as set forth in Section 50-1707, Idaho Code. Accordingly, the estimated per
property cost and expense of the Improvements, exclusive of costs relating to interim warrants,
reserve and guarantee funds, issuance and financing, is in the range of $3,300 to $3,700.
Section 5. That protests against said Improvements or against the creation of said Fiber
LID No. 5 shall be in writing and filed in the office of the City Clerk located at 2135 South
Ammon Road, Ammon, Idaho, on or before 4:00 p.m. on January 7, 2021; and such protests
shall be heard and considered by the City Council at a public hearing to be held in the City
Council Chambers at City Hall located at 2135 South Ammon Road, Ammon, Idaho, on January
7, 2021, at 7:00 p.m.
Section 6. That the City Clerk is hereby directed to (i) give notice of the passage of this
Resolution and the time within which protests will be heard and considered by the City Council
as herein provided, in the form attached hereto as Exhibit B, which describes the general
character of the Improvements to be made and the estimated total cost thereof, and includes a
reference to this Resolution on file in the City Clerk

newspaper of general circulation within the City and the official newspaper thereof, in three (3)
