CITY OF AMMON October 21, 1993 I Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:30 P.M. by Mayor Bruce Ard. It was held at the Ammon City Hall. 3270 Molen Street. Ammon. Idaho. The Pledge of Alleg- iance to the Flag was led by Councilman Harvey Crandall with the prayer being given by Councilman Ira K. Wayne Hansen. 3785 Geneva Drive, Ammon Alan Obray. 3475 Taylorview Lane, Ammon Jerrolyn Crandall, 3550 Brookfield Lane, Ammon Rex Shurtliff, 3575 Brookfield Lane, Ammon Alice Shurtliff, 3575 Brookfield Lane, Ammon Lynn Goldman, 3615 Wanda Street, Ammon and a total of 25 Scouts and Cub Scouts I Mayor Ard asked each Scout to introduce himself and what his purpose was in attending the City Council meeting. The first item of business was a request by Shelene D. Larsen, 2039 East Eastgate Drive, for a home occupation permit. She addressed the Council, stating her business consisted of wedding consultation. She stated she would not have employees. She would not do catering or decorating, just helping through the planning of weddings. Councilman Maeser motioned to approve the application of Shelene Larsen for a home occupations permit to conduct a wedding consultant business at 2039 East Eastgate, Ammon. The motion was seconded by Councilman Hall. Roll call vote: Maeser - Yes; Hall - Yes; Crandall - Yes; Anderson - Yes. The motion carried. The second item of business was a request by Jay Johnson to convert a single family dwelling to multiple family. Mr. Johnson explained the house is presently being built for a single person, Sheryl Moss. It is situated in an R-2 zone at 2200 South Ammon Road. He would like to request for her that she be allowed to rent the basement as it would help her out a little. The opinion of the Council was that it is properly zoned, therefore there is no problem. Mr. Johnson thanked the Council before leaving. Mayor Ard stated a date needed to be approved to canvass votes of the municipal I election. Councilman Crandall motioned to approve November 4, 1993, as the date set to canvass the votes. The motion was seconded by Councilman Maeser. Roll call vote: Crandall - Yes; Maeser - Yes; Anderson - Yes; Hall - Yes. The motion carried. Councilman Maeser reported on the AIC Legislative Meeting. He stated most of the meeting consisted of discussion of what to do about the water quality fee assessment. It was discussed paying the fee either on a monthly or quarterly basis under protest, with a request for an opinion of the Attorney General's office as to the legality of the fee. He further stated there is an argument that it is a fee, not a tax, because they are assessing a usage. Five voted to not pay at all, with the majority voting to pay under protest. Councilman Maeser also stated at the AIC Legislative Meeting, they wanted to lower the vote of two-thirds to sixty percent on bonds. Also, on October 27th the Mayors have been asked to call a press conference for the declared mandates the City might have. This would be Federal Unfunded Mandate Day and provides the City an opp- ortunity to educate the public. I I I 75 October 21, 1993 Mayor Ard introduced Ordinance No. 235 for the third reading, AN ORDINANCE TO AMEND THE ZONING CLASSIFICATION AND THE ZONING MAP FOR CERTAIN LANDS: PARTICULARLY DES- CRIBING SAID LANDS AND DECLARING THE CLASSIFICATION OF ZONING FOR EACH SUCH PARCEL OF LAND: AND PROVIDING FOR AN EFFECTIVE DATE. This is a rezone in Trailwood Village Division No.1. Councilman Crandall moved that Ordinance No. 235, a rezone of Trailwood Village Division No.1, be passed. The motion was seconded by Councilman Maeser. Roll call vote: Crandall - Yes; Maeser - Yes; Anderson - Yes; Hall - Yes. Voting was unanimous. The motion carried. The next item of business was the delegation of Lynn Goldman, Jerrolyn Crandall and Rex Shurtliff regarding the Ammon Road Project. Mr. Goldman expressed concern over the fences that were not replaced belonging to himself and also the Crandall's. Mr. Goldman explained that Devin Rigby of the State Highway Department referred him to Pete Demitropoulos who informed them they were just fixing that which had been broken or damaged. Mr. Goldman stated that Pete was not willing to fix it according to his satisfaction. Also Mr. Goldman stated he wanted the ruts cleaned up in his field now, although, he admitted they did not hurt anything. However, he feels it has now become an issue. He stated Mr. Demitropoulos said that was Utah Power's problem. Jerrolyn Crandall stated posts and gates had been broken and/or damaged. When they made the road into Brookfield, some of their pasture was taken. They said everything would be put back the way it was, but this agreement had not been kept. She didn't feel it was right that with all the fencing they had put in that they had completely ignored this section belonging to the Crandall's, Goldman's, and Shurtliff's. She further complained she had been unable to use their pasture all summer because of the fence condition. Mr. Goldman stated fences had been put in all along Ammon Road where there had been none previously. He wondered what could be done at this point. Public Works Director Wadsworth stated the job would not be considered complete until next year because of the guarantee on the trees. Rex Shurtliff asked why his fence had just the posts set and nothing else. Mr. Goldman stated he felt a lot of verbal agreements were made that have been forgotten. He stated Mr. Rigby listens but ultimately refers you to Mr. Demitropoulos who does not follow through. Attorney Anderson suggested to ask for an answer. Councilman Hall stated he felt it should be fixed this year, not wait until next year. The contract is for about 4000 feet of fence, it was stated. Some of that should be used in these areas. Engineer Benton stated the contractor has not contacted the City about a list of things that should be done. The approved method is for City, Contractor, and State to walk down the street with a check list and note the finished and unfinished. This, he stated, is standard procedure. Mayor Ard agreed to make some calls to see what can be done. Reports: Attorney Anderson reviewed the ordinance concerning fuel tanks as the leak detection program is to be in place in December of this year. The ordinance only allows up to 500 gallons above ground. The Uniform Fire Code is alright as it allows up to 25,000 gallons. There is a need to amend the ordinance. Mayor Ard stated the area by McCowin Park in the fenced area by the boxcar would be an ideal place for these tanks. The zoning allows it. He stated they were thinking in terms of two - 1000 gallon tanks. Councilmen Hall and Anderson suggested investigating some of the stores for this service. It was stated this was impractical in case of emergency. Engineer David Benton stated H&K were behind schedule for the paving of Williams Street, but planned for it for next week. Glenn Peterson of District fl93 had stated they would take care of their $6000 costs as it is authorized by the School District. While he spoke with Mr. Peterson, he asked about the extension of the water lines according to the annexation agreement on the high school. He was told they did have money budgeted and available now but it was too late in the season. Benton reminded him there were two lines--one on Owen and one on Sunnyside--to be extended to the west property lines. Cal Smith, Fire Chief, stated there is no date yet on delivery of the fire truck. He further stated the pump testing needs to be done in Idaho. The question was asked about having fund raising for the Fire Department. Chief Smith stated they didn't seem to bring in much. They usually just broke even with such attempts. 76 October 2lt 1993 Mayor Ard reported Cantlon Properties were ready to proceed with rezone hearings. The meeting at the Westbank showed some interesting propposals with many controversial feelings being expressed by the residents. On the canalt if they couldn't get permission to pipe itt they would fence and landscape that area. They discussed shielded lighting and landscaping in and around the parking lot. They suggested using a block wall with willingness to deed people an extra ten feet to landscape on their side. Councilman Crandall reported he had received a thank-you note from Debbie Hall for the running of the swim pool. Mayor Ard stated he had received positive expressions from several people also. Mayor Ard stated he had received a request from Kathy Dansie for a proclamation declaring Halloween on SaturdaYt October 30t 1993. He stated he did not feel the City should make such a proclamation. It was brought out the schools usually had their parties at the end of the school week or on Saturday. The Council agreed with the Mayor that the City did not want to declare Halloween on Saturday t but would encourage people for Saturday. Mayor Ard asked if there was any other business.
