Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order by Council President W. Lee Bean in the City
Building, 2135 South Ammon Road, Ammon, Idaho, at 7:30 P.M. with the following City
Officials present:

Councilmember Bohn led the Pledge of Allegiance to the Flag, and Council President
Bean offered the invocation.
Ron Folsom reported on the Planning and Zoning Commission meetings held May 6 and
May 14, 1997. Two public hearings were held on May 6. One hearing was to consider
a request filed by Big Tree Corporation for rezone from R-1 to R-2A of a strip of
land along the west side of the Tie Breaker Village subdivision. Residents opposed
the rezone because the zoning of the area for single family dwellings was in place
when they purchased their properties. The Commission recommended that the request
be denied. If the developer wants a transition zone, he could consider rezoning
some of his adjacent commercial property for multi-family units.
The second hearing was to consider a request of Jay Johnson regarding forty acres
of property located on the south side of Sunnyside Road across from Carolyn Lane
and Hillcrest High School. The property was divided into three parcels. Parcel
one contains ten acres and is already annexed to the City of Ammon. The request is
to rezone parcel one from R-l to R-2A. Parcel two and parcel three involve thirty
acres, and the request is for annexation with initial zoning. It was proposed to
zone parcel two as R-2A and parcel three as partly R-2A and partly R-l. There was
considerably citizen input from property owners in the Felt Waite Addition
objecting to the R-2A zone adjacent to their RPA zone. The Planning and Zoning
Commission recommended denial of the request for zoning to R-2A but they failed to
make a recommendation regarding annexation. A special meeting of the Planning and
Zoning Commission was called for May 14, 1997, to complete their recommendation on
Jay Johnson's request. The Commission reviewed the input received at the public
hearing and moved to recommend approval to the City Council of the annexation with
part of the property to be zoned R-l on the south end and next to the Felt Waite
Addition and the remainder of the property to be zoned R-2 instead of R-2A. Jay
Johnson determined that he can develop with townhouses in the lesser zone of R-2.
The City Council scheduled their public hearing for Thursday, June 5, 1997, to
consider Jay Johnson's request.
Kirk Peterson of Peterson Enterprises requested approval of their plans to develop
the property. on 17th Street south of Kmart so they can begin construction within
the next two months. Proposed buffer plans were discussed. The developer is
considering a block fence/wall to the back tied in with landscaping along Midway
Avenue and in front on 17th Street. He has been planning with Kevin Sommer who is
somewhat of a spokesperson for the adjacent property owners. Accesses were
discussed. Residents have expressed opposition to an access from Midway Avenue,
but there does not seem to be opposition to a Heather Lane access. The Council was
oriented to the general layout of the project. Rezone from R-l to C-l of the three
residential lots involved in the project was contingent upon an acceptable
development agreement. Kirk Peterson was asked to submit a development agreement
before approval is granted.
Larry Schuldt, Building Inspector, reported on building activity. April was a busy
month. Since the last report, seventeen permits have been issued, fifty-one
inspections have been made, twenty plan checks completed, and there have been
twelve other miscellaneous visits to job sites. Problems experienced with the two
manufactured homes on Rich Lane were pointed out. It was suggested the building
inspector talk with the owners and/or contractors to help them understand what is
required before a certificate of occupancy is issued. Also, there has been some
problems with contractors calling for inspections before they are ready, and this
causes unproductive extra visits.

Councilmember Bean moved to approve the minutes of
1, 1997. Councilmember Hall seconded the motion.

City Council Meeting held May

Councilmember Bean opened a discussion/report on Well No.8. Peak Alarm has
installed an alarm system in the well house. They are requiring the City to commit
to a year's maintenance agreement. The Council understood the specification
required an alarm system which would alert when the well had problems, but the Peak
Alarm, which has been installed, is a security system. Engineer Benton explained
the capabilities of the Peak Alarm system. The Peak system has potential, but the
City does not have the connection and the unit for transmitting. There was
considerable discussion about the value to the City of the Peak Alarm system. It
was decided to check out the bid specifications to determine if they called for a I
security system with a maintenance agreement. If the City is not obligated, the
Council is not in favor of entering into a maintenance agreement with Peak Alarm.
The City needs to be able to monitor it's own system.
Public Works Director Wadsworth reported on the status of Well No.8 according to
his observations. Water sample testing of the well may take three or four weeks.
Engineer Benton discussed pumping operations and what needs to be done before the
well can be put on line. He recommended additional purging to insure against sand.
The Council urged the engineer to expedite procedures to get the well on line. The
well is behind schedule. Chemical samples were taken May 14, and coliform samples
were taken May 15. Division of Environmental Quality (DEQ) will advise when test
results allow the City to put the well on line. Councilmember Bean asked Engineer
Benton to supply him with a list of the change orders. He, also, asked for an
estimate of the engineer costs on the well. Purpose for the cost figures was to
tabulate a total cost for Well No.8.
No action was taken on the dog ordinance because the Council had not reviewed the
revisions.
Engineer Benton reported that he is preparing to advertise for bids for an asphalt
overlay on 17th Street between Hitt Road and Ammon Road. The bid opening is
planned for Wednesday, June 4, 1997, at 2:30 P.M. in the City Building, 2135 South
Ammon Road. Plans for the 17th Street project were explained.
Councilmember Bean reported on the Cities-County Planning Meeting held May 14. I
Nothing major came out of the meeting. Bonneville County is going to start work on
Sunnyside Road up to the Bone Road, and they are working on an overlay proj ect
south of Sunnyside Road on Holmes. City of Idaho Falls is involved in a few street
proj ects.
Kurt Karst, architect representing Dennis Austad, submitted a request to the City
Office regarding Anderson Lumber Company. Mr. Austad proposes to build a facility
and lease it to Anderson Lumber. The proposed preliminary site plan is the same as
the original plan, but the building is much smaller. The architect has asked the
City Council to approve the revised preliminary site plan and to advise about the
required fees. City of Ammon Planning and Zoning Commission reviewed the Anderson
Lumber site plan. Ron Folsom reported on their findings. The Planning and Zoning
Commission does not have any problem with the revised site plan, but they are
concerned about how the rest of the property is developed. Since the building is
considerably reduced, it appears plans are to develop only the property abutting
17th Street which could result in land locking some of the property zoned GC-l.
Planning and Zoning recommends the developer present a plan to show how the rest of
the commercial property is to be accessed if it is not going to be used in this
development. The Council agreed that the developer needs to enter into another
acceptable development agreement.
A report has been received from the Bonneville County Sheriff's office and from the
Magistrate Court that they have received a citation issued in Teton County on an
old City of Ammon uniform citation form. Details about the citation are
puzzling. The only explanation City of Ammon could come up with is an old book
must have been found in the police car sold to the City of Driggs over ten years
ago. The Council recommended that all the old, unused police forms still retained
at the City Building be destroyed.

Councilmember Hall received an irate call from Bryce Anderson, 3855 Brookfield
Lane, regarding the use of the easement on his property to access Well No.5. The
City crew tries to use the easement only' as often as necessary, but it always
creates a problem with Anderson. The City has to be able to access the well. The
Council discussed how to resolve the problem. The City has the right to use the
easement. Councilmember Hall agreed to draft a letter to Anderson for Mayor Ard to
sign. The letter should state the City's position in use of the easement.
Councilmember Bohn discussed Fire Department policies. The department requests a
twenty-four hour notice for Fire Marshal inspections. The Building Inspector

also requests a twenty-four hour notice for a building inspection. Providing
adequate inspection notice is often a problem, but all concerned need to work
together to assure good service. Also, the Fire Department needs more review time
on commercial building permits. It was decided to require three sets of plans for
commercial buildings--one set for the building inspector, one set for the Fire De-
partment, and one set for the City Office.
City beautification was discussed. There are areas in the City that would benefit
by landscaping. Maintaining landscaped areas involves funding and manpower. No
plan was recommended.

complimented the crew for their good work on City Clean-Up Day.
Engineer Benton discussed a call he received from a developer interested in Ammon
Town Center. The developer wants a flow test after Well No. 8 is on line.
Fire Chief Clarence Nelson reported on Fire Department activities. Chief Nelson
has been working with Intermountain Gas Company on a gas training class. The State
Fire School is scheduled for June and representatives of the department plan to
attend.
Councilmember Bean reminded the Council that budget time is approaching. He
encouraged members to begin work on their wish list and to remember the 3% cap.
