their thanks to Ellis for his commitment to the City and getting the job done.

Esther Allen, 5781 South Ammon Rd, provided comment with permission of Mayor Coletti on the
proposed changes to the Hidden Valley Subdivision proposal. Allen provided a visual aide of what the
subdivision would look like and detailed changes requested by residents in the surrounding areas.

Finance Director Jennifer Belfield invited Judy Bower of WiPFLI Consultants to present the details of the
audit to Council. Bower informed Council that the audit was good and the financial state of the City was
strong. Bower reviewed highlights of the audit and clarified items for Council. Bower noted that any
issues that were found were responded to by City staff quickly and paths were made toward resolution.
Council commended Staff for the hard work.

City Administrator Micah Austin explained the reasoning for the resolution in place of Technology
Director, Bruce Patterson, who was unable to attend. The resolution ties up the public hearing that was
held at the previous meeting taking into account any comments from the public. Austin noted that the
resolution will allow the bond related to the LID to be sold off and the process to move forward.
It was moved by Council President Slack and seconded by Council Member Tibbitts to approve
Resolution 2020-003R, thereby confirming the sufficiency of the Assessment Roll. aƚƷźƚƓ ƦğƭƭĻƭ

Austin and Cindy Donovan, City Planner, reviewed the changes that had been proposed by the developer
and presented Council with the revised development agreement for the subdivision. Traffic impacts of
particular concern were addressed by the developer and discussed by Council. Council discussed the
layout of the subdivision and the implications it would have on existing neighborhoods and travel as well
as the requests made by the City on the developers to include road updates and widening, access to the
subdivision, and connecting roads. Austin added further that the agreement did not contain language
pertaining to the ask for fencing and read information provided by the developer regarding the issue.
Council discussed previous discussions regarding the need for fencing and reviewed previous minutes
related to the issues at hand and questioned if the need for fences should be included in the agreement,
and if they had been in the past, or if the developer should be allowed to respond to the request of his
own accord.
It was moved by Council Member Thompson and seconded by Council Member Wessel to continue the
discussion on the Final Plat and Development Agreement for the Hidden Valley Subdivision until a

Donovan presented Council with the layout and plans for the Villas 4 Subdivision Plat and Development
Agreement. Donovan noted the Development Agreement was fairly standard but provided further detail
on the specific special conditions that would include fiber hookups, pressurized irrigation, special
conditions for land in the flood plain, and a paved walking path to be later deeded to the City, among
others. A representative from the developing firm addressed the need for pressurized irrigation even
though previous developments had not been required to use them, the developer noted that studies
have shown the available water sources in the area were not sufficient to provide irrigation to the
subdivision. Council discussed the issues at hand with the developer. It was added that often the cost of
additions to development agreements are passed on to lot buyers and discourages buyers from
developing in the area. Developers and Council discussed the implications for future developments in the
area and whether or not the same argument could be made. City Engineer, Tracy Bono, added that he
believed future developments in the area would not have similar issues. Developer asked that SC 8 be
changed to easement and not right-of-way and that SC 9 be amended to include that the developer
would provide supplies and City will complete the project.

principal permitted uses in the R-1 Residence Zone shall be single family dwelling units and certain
other public facilities which are necessary to promote and maintain stable residential neighborhoods.
This zone falls under the medium density designation and does not allow density that will exceed 4
living units per acre.
10-14A-1: GENERAL OBJECTIVES AND CHARACTERISTICS OF ZONE: The objective in establishing the

J.DISCUSSION ITEMS:
1.Staff Reports
i.WaterSmart
Belfield presented the new WaterSmart system to Council, the system will allow residents to
learn more about their water usage, give ideas for conservation, and detail bills.
ii.Communities Master Plan
Austin reviewed the current Master Plan and provided a one sheet summary of the plan and
what actions are upcoming. The plan would develop streets, sewer, and fiber for listed areas
including Hillview and the original Townsite. Austin will move forward with a grant
application to get items funded.
iii.Water Meter Grant Award
Austin reported that Ammon had received a $300,000 grant for meter installation. Austin is
also working out details with the grant authorizer to finalize plans.
iv.COVID-19 Plan
Austin reviewed the plans in place should the City of Ammon need to respond to an outbreak
of the COVID-19 virus in eastern Idaho. Communication has already begun with the public
and will continue throughout the length of the epidemic.
v.LID3 Financing
Austin reviewed the memo and proposal for the financing of the LID3 project. Technology
Director, Bruce Patterson, answered questions for Council. The recommendation is to move
forward with a fifteen-year bond with a lower interest rate. The proposal in front of Council
was reviewed and Staff recommended that they move forward.
2.City Council Reports
Wessel reviewed issues brought to his attention by citizens, they will be responded to be the
appropriate department.
Thompson discussed traffic issues due to school pickups. Traffic Commission will discuss at
their next meeting.
Wheeler updated Council on plans for increased social media awareness about the City. He is

A.CALL TO ORDER: Council President Slack opened the meeting at 4:30 p.m. at the Ammon City Hall building
located at 2135 South Ammon Road.
B.PUBLIC COMMENT:
Members of the Parks, Recreation & Trails Commission presented to Council on their list of priorities for
citywide paths. Sarah Jones of the Ammon Parks, Recs & Trails Committee and Parks and Recreation Director
Ken Knoch reported on latest commission meeting that was attended by a large group of residents. S gave a
list of priorities to the Council for consideration and noted that safety of pedestrians was the largest concern
of the commission. Discussion of location of paths and the connections that would be made throughout the
City. Knoch will work on grants for this project. Council discussed the cost of the projects proposed with
Knoch adding that he hopes to incorporate some of the cost into the upcoming budgeting cycle with
continued work on the grant applications.

C.DISCUSSION ITEMS:
1.Strategic Plan (Micah Austin, City Administrator)
City Administrator Micah Austin presented Council with the most current version of the Ammon
Strategic Plan and added that path proposals could be added to the plan to begin work. Council
requested that a rank of items in each category be created to allow for focus on priority items.
Council discussed specific areas of the plan with clarification by City Staff. Council noted projects that
ought to be higher priorities, the Master Plan was moved to a higher priority with the addition of
other unlisted projects and comments regarding departments involved in each project.
2.Bonneville County Fire District (Stacy Hyde, Fire Chief)
Fire Chief Stacy Hyde led the continued discussion regarding the potential to join into the Bonneville
County Fire District. Council was joined by the three commissioners of the District, Dan Gubler, Dave
Long, and Ralph Isom. Mayor Coletti, via teleconference, added his thoughts to the discussion noting
that he believed this was an ideal team to make the transition as there would be little to no change in
cost for residents due to current levy rates. President Slack added that he would like to see an
extensive effort to inform the community, through town halls and public hearings, prior to a vote
happening by Council. Council and Commissioners discussed the pros and cons of Council approving
or taking the initiative to the public for a vote as well as the changes that would happen to the
District Commission and what role Ammon would play in the leadership of the Commission, as well as
clarification of what role current Ammon Fire employees would play in the District. Council directed
City Staff to begin developing plan for information and transition to be presented to Council at a later
date.

WHEREAS,theCity of Ammon, BonnevilleCity,is a municipal
corporation operating and existing under and pursuant to the provisions of the Constitution and
laws of the State of Idaho,and as such is authorized and empowered to create local improvement
districts and to construct improvements pursuantto

WHEREAS, the City Council of the CityCity Council,by Ordinance No. 616,
adopted on January 17, 2019,duly created Fiber Optic Local Improvement District No.3for
Ammon,Idaho(Fiber LID No.3thecostsand expensesof
design, acquisition, construction and installation of certain fiber optic system improvements and
withinFiber LID No.3tobenefitthose
certainproperties within the boundaries of Fiber LID No.3whose owners have affirmatively
elected tobe benefited by the Improvements and to incur the related assessment necessary to pay
for the same;
WHEREAS, theCity Engineerhas prepared and provided to the Cityhiscertified report
detailing the total cost and expenses of the Improvements and the amounts payable from
assessments and other sources, as applicable,together with theform of assessment rollattached
hereto as Exhibit Aand incorposhowing the
amount chargeable to each lot or parcel of propertywithinFiber LID No. 3according to the
benefits derived methodofassessment,subject to the City recommended variations
therefrom,if any;and such AssessmentRoll has been filed in the office of the Clerk oftheCity
and madeavailable for public inspection;
WHEREAS, notice of the time and place of hearing (Notice of Hearing)on the
Assessment Roll was duly and regularly given to all property owners within Fiber LID No.3by
publication thereof and by mailing to all property owners in the manner required by law, and the
hearing was duly and regularly held on February 20, 2020,pursuant to said notice, at the time
and place fixed for said hearing;
WHEREAS,theCity Councilhas considered and disposed of all objectionsduly filed by
property owners,if any,and,ifapplicable,has correctedtheAssessment Roll in relation to the
benefits accruing thereon as a result of the Improvements,in the manner required by law; and

the assessments.
NOW,THEREFORE, BE IT FURTHER RESOLVED AND ORDAINED BY THE
CITYCOUNCILOFTHE CITY OF AMMON,BONNEVILLE COUNTY,IDAHO, AS
FOLLOWS:
Section 1.Confirmation of Assessment Roll;Levy of Assessments.TheCity
Councilhereby approves and confirms the Assessment Roll for Fiber LID No.3attached hereto
asExhibit A,and the assessments set forth therein are hereby levied and assessed against each
lot, tract and parcel of property described in the Assessment Roll.
Section 2.Property Affected. Each lot or parcel of land and other property shown
uponthe Assessment Roll is hereby found to be benefited to the amount of the assessment levied
thereon.Nosingle assessment has been increased in an amount greater than twenty percent
(20%) of the amount of the assessment as set forth in the Notice of Hearing.In establishing
assessment amounts, the City -1711,
the value of
similar properties, as provided by the County Assessor.
Section 3.Certification of Assessment Roll;Recordation of Notice. The City
Clerk,upon passage of this Ordinance, is directed to certify and fileinthe recordsof the
the confirmed Assessment Rolland,uponsuch
filing, the amount of each assessment set forth in the Assessment Rollshall be due and payable
totheCity Treasurer,and shall become a lien against the property soassessedinthe amount of
each assessment together with any interest or penalty imposed from time to time.The City Clerk
shall cause to be recorded in the records of BonnevilleCounty, Idaho, a notice of adoption of this
Ordinance, thedate of the Ordinance, and the description of the boundaries of Fiber LID No. 3.
Uponrecordation of such notice, theassessments shall constitute liens uponthe property
assessed paramount and superior to any other lien or encumbrance whatsoever, theretofore or
thereafter created, except a lien for general taxes.
Section 4.DueDate of Assessments; Payment in Installments.Said assessments
shall become due and payable to the City Treasurerwithin thirty (30) days from the date of the
adoption of this Ordinance (April 18,2020),or, if such date is not a business day for the City, on
next business day thereafterpassage of this Ordinance, the ity Treasurerll mail

notice of the assessment amount due to each property owner assessed at his/herpost office
address,ifknown, or if unknown, to the post office in Ammon,Idaho, stating the total amount of
theproperty owner's assessment, plus the substance of the terms of payment of the same (the

ExhibitBattached hereto and incorporated herein by this reference. An affidavit of mailingthe
foregoing noticesinsubstantially theform attached as Exhibit Chereto,incorporated herein by

Any property owner who has not paid his assessment in fullwithin said thirty-day (30)
period shall be conclusively presumed to have chosen to pay the same in up to fifteen (15)equal
annual installments, the first of which shall become due and payable one (1) year from the date
ofthe passage of this Ordinance,with a like amount due on the same day of each year thereafter
until the full amount of the assessment, with interest due thereon, shall be paid in full.
Assessments paid in installments shall bear interest on the unpaidamount of the assessment from
thedate of adoption of this Ordinance.The rate of interest per annum which such installments
shall bear is hereby fixed attherate of interest to be borne by the bonds issued to finance the
Improvements, which rate is anticipated not to exceed fivepercent (5%).If any installment is not
paid within twenty (20) days from the date it is due, the same shall become delinquent andthe
City Treasurershall add a penalty of two percent (2%) thereon. Installments may be prepaid in
the manner provided by Section 50-1715,Idaho Code, at the City

Section 6.Cost and Expenses. The total cost and expenses of theImprovements
include the contract price of the Improvements, together with any costsor expenses incurred for
engineering, clerical, printing and legal services as well as for advertising, surveying, inspection
ofwork, administration and collection of assessments, interest upon bonds or warrants, and an
amount for contingencies as may be considered necessary by the City Council.
Section 7.Final Determination and Finding;Appeal Rights.The confirmation of
theAssessment Roll for Fiber LID No.3herein made is a final determination oftheregularity,
validity and correctness of said Assessment Roll, of each assessment contained therein, and of
theamount levied on each lot or parcel of land or other property within Fiber LID No.3,subject
to the right of appeal as set forth in Section 50-1718, Idaho Code.
Any person who has filed a protest to the Assessment Roll, or any other person who feels
aggrieved by the decision of the City Councilthen confirming said Assessment Roll, shall have
the right to appeal. Such appeal shall be made within thirty (30) days fromthe date of publication
ofthis Ordinanceor a summary hereof,by filing a written notice of appeal with the City Clerk
andwiththeclerk oftheDistrict CourtofBonnevilleCounty, Idaho, describing the property and
objections of the appellant.
After said thirty-day (30) appeal period has run, no one shall have any cause or right of
action to contest the legality, formality, or regularity of any assessmentfor any reason
whatsoever and, thereafter, said assessments and the liens thereon shall be considered valid and
incontestable without limitation.
Section 8.Ratification of Proceedings.Allproceedings heretofore had in
connection with the creation ofFiber LID No. 3,the preparation and adoption oftheAssessment
Roll, and hearing thereon, and the giving of notice of said hearing on objectionstosaid
ssment Roll, are hereby in all respects ratified, approved, and confirmed.
