They set up the permit fees accroding to an amount per square foot (con-
forms with the Uniform Building Code). On other construction for remodel~
ing, repairs, sheds, storage buildings, etc. the owner places a valuation,
and the cost of permit is based on this valuation. The Mayor recommends
that Ammon establish some uniform fees because it is unrealistic that
buildings could be built for some of the valuation figures. The dis-
cussion on National League of Cities Meeting was tabled until the Mayor
knows more information. There have been complaints about water pressure
in Petersen Park area and the Mayor asked if anyone could give a reason.
The Engineer stated there could be a circulation problem. There will be a
traffic meeting tomorrow morning (County Traffic Safety). The County will
be responsible for the signs on Hoss Street. A representative of Inter-
mountain Gas Company and the Mayor conducted a survey of the heating in the
Well pumphouses. The gas company refuses to hook up the furnace at Well #1.
The other w~lls are using normal household thermostats to regulate the tem-
perature and the lowest setting is 55? A thermostat is available which can
be set at 35~ The gas company recommended we could obtain different ones
and set them at 40~ uick Weimer has been contacted to get Well #1 legal
and to change the thermostats. When Dermont Hicks sent in his water pay-
ment, he commented that the water charge was too much and what about spray-
ing ditches. Marian Perrenoud noted that the City gets a lot of bad checks.
She wondered if the City couldn't charge people extra if they wrote an
insufficient funds check. The Attorney said no. Councilman Swensen said
let the bank assess the charge--just keep the check going back to the bank.
There is a problem with Brent Petersen parking a boat and trailer in the
street. The street is not posted for no parking but he leaves the boat &
trailer parked there indefinitely. The IV1ayor will investigate Vlhat can te cbne.
~ttorneY Anderson did a tremendous job on the Utah Power & Light rate in-
crease hearing. He has been left unpaid for his service. IV~yor Wehmann
asked Council approval to pay Attorney Anderson $1,000.00 out of the 1978
monies for his services on Utah Power case. The Council was agreeable and
felt that no approval was necessary since it had been budgeted. Unfinished
business--the_roof still needs to be fixed. Councilman Lee moved that the
meeting be adjourned and Councilman Anderson seconded it. Meeting adjourned

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7:30 P.M..by Mayor George Wehmann, with
the following City Officials present:

Others present during the meeting were City Councilman Candidate David R.
Rowberry, Pack 307 Cub Scouts David Fullmer, Brock Van Orden and Kevin D.
West, and their leader W. Reed Fullmer.
The pledge ofallegiance to the flag was conducted by the Cub Scouts; prayer
was offered by Councilman Anderson. Minutes of the meeting of October 5,
1977, were approved as prepared. Mayor Wehmann acknowledged the presence
of Mr. Rowberry.
An ~pplication for a variance submitted by Larry Clark, 1900 Eagle Dr.,
was7taken under consideration, and it was noted that the request was to
build a separate garage at a location in the backyard which would be ten
feet from the back of the house in order to place the structure within one
foot of the side property line (the zoning ordinance requires that a separate
building in an R-1 Zone should be at least 12 feet back from the house before

it can be placed closer than 71 feet from the side property line). It was
explained that this two-foot variance is needed due to a gas main in the
backyard easement. Councilman Lee moved to grant the variance as stated
in the application. The motion was seconded by Councilman Swensen; voting
was Lee, yes; Swensne, yes; Dille, yes; Anderson, yes; motion carried.
Mayor Wehmann tnformed the Council that word has been received that the
City's application for matching funds from the Bureau of Outdoor Recreation
for improvements in the parks, which was filed some time ago and which
is for the total amount of $14~ms been approved by the State and is
expected to receive Federal approval. It was pointed out that the project
is to be spread out over two years, and Mayor Wehmann expressed concern
about how the City would finance a portion of this project this year since
the City is to expend the money then be reimbursed for one-half of the
costs, and he was not made aware of the timing on the application when
the budget was prepared so the expenditure was not allowed for. He suggested
that some thinking be done on this and perhaps call a special meeting to
determine what can be done to handle this situation.

with reference to the Director of Public Works position for which the City
has advertised for applicants, Engineer Benton suggested that the City
Officials consider requiring that this job be filled with a qualified
engineer since the City is growing rapidily and there is often a conflict
of interest with his firm in the matter of representing bo.h the developer
and the City in quite a few instances, which are always declared but do
not make for the best situation. The Council members indicated approval
of this suggestion. Mayor Wehmann pointed out that the need for the em-
ployment of an engineer by the City is demonstrated in the fact that there
are approximately 770 residential lots in the planning at this time, in
addition to the condominium project for which a permit was just issued for
the first phase of 94 units. He mentioned that he is recommending that
the City plan to require water meters,in these and other new developments I
in the future, with this requirement being included in the terms of
annexation agreements.
Mayor Wehmann reported that the Idaho Public Utilities Commission has pre-
pared a rate schedule which Utah Power & Light Company will put into effect
based on the ruling made as result of the hearings which have been going
on for several months in which the City of Ammon has been an official inter-
venor. He noted that the rates on the schedule are, in effect, a flat rate,
and represent an average increase of 8.15% which is somewhat less than the
original request of 29.27%.
REPORTS
Councilman Anderson requested that the next City newsletter include an an-
nouncement that a volunteer .is needed to manage the City-sponsored basketball
Eroqram for the coming season. He recommended also that there be an item
in the newsletter asking for suggestions for a flame for the park which is
being developed in the eastern part of the City, and Mayor Wehmann mentioned
the name of Re~Molen Park.
Councilwoman Dille reported that the littering problem at Simpson's, 2045
Dove Drive, is bad again, and that Attorney Anderson has cited them in for
.a hearing before the City Council at the November 6th meeting; also the I
Attorney has written a letter to Alton Nebeker, 2895 E. 17th Street, about ..
the unsightly condition of his yard, and a complaint has been made on the
same problem at Smout's, 2706 E. 17th Street. A report by Councilwoman
Dille about action taken at the Planning and Zonin9 ~ommission meeting on
the previous night indicated that public hearings were scheduled at the
next meeting on a zone change requested by Reynold Chambers on his property
north of 17th Street, on Monty Howell Addition Division No.2, and 'On
Felt and Waite Addition Division No.2. Also it was recommended that a public
hearing be held on amendments needed in the City Zoning Ordinance in order
to comply with the State Land Use Planning Act and that the section of the
City Zoning Ordinance relative to Dwelling Groups (Planned) be amended to
change the title and other references as needed to Planned Unit ~e~elopment
(PUD). Planning and 20ning Commission members reviewed t,he p~eI1~1nary plat
of the Lincoln Park Subdivision, which is in the County out w1th1n the Ammon
Impact Area, and conc..rred with the County Panning and Zoning Commission's

recommendation that the. plat and r~quested zoning be approved. Council-.
woman Dille noted that the Planning and Zoning Commission also reviewed
the proposed plat of Tie Breaker Village Division No.2, and recommended
that the school site be lett at this time and included in the development
of Division No.4. Mayor Wehmann indicated that he would write to the
School Board about planning for schools in the City's impact area. It was
mentioned that the Planning Commission members suggested that a policy be
established relative to areas for parks, such as having developers give
land to the City for parks or having buyers of lots pay a surcharge for the
purchase of park property. Mayor Wehmann pointed out that there is a need
for a water connection fee such as is charged for sewer connections, in or~
der to accumulate funds for future additions to the water system. Engineer
Butler was asked to make a study on the projected needs for water as a
basis for determining what would be appropriate as a water connection fee.
According to Councilman Lee, he has been informed by the County that there
will be no trucks large enough to mount the snow plow on released until
spring. Also, he talked to the County people about taking care of traffic
signs in Ammon, as was mentioned in a previous meeting, and was told that
a letter of agreement would be needed in order to make aggangements on that.
Councilman Swensen pointed out that the coupon books for the City's utility
billing will be ready by November 10, and it was recommended that 2000 of
these be printed. A report given by Engineer Butler indicted that the ease-
ment agreement for access to Well #5 has been signed by property owner
Darryl Harris and will be put in the City files as soon as it is recorded.
Regarding cleaning the sand out of the water storage tank, Engineer Butler
mentioned that he will try to get a pump from an industrial rental business,
and that it has been suggested that the use of a crane and bucket be tried,
so this possibility will be in/estigated. In connection with the sewer me-
tering equipment, Engineer Butler noted that it has been in operation for
some time, but the representative of Waterworks Equipment Company has never
taken care of getting it properly calibrayed, and Mayor Wehmann expresed the
feeling that this matter should be taken to court. It was mentioned by
Mayor Wehmann that he has written a letter to the City Engineer outlining
a schedule for the paving work on Southwick Lane and Midway Avenue.
The City Clerk reported claims to pay in the amount of $6,475.95 and a
balance in the General Fund checkino account of $15,795.02.
The need to set an ending date for the summer watering regulations was
brought to the attention of the Council by Mayor Wehmann. Councilwoman
Dille moved to take the watering regulations off as of November 1. The
motion was seconded by Councilman Swensen; voting was Dille, yes; Swensen,
yes; Anderson, yes; Lee, no; motion carried. Mayor Wehmann pointed out
that the law enforcement contract for fiscal year is being readied for
signature. He mentioned that there is work needed to be done around the
ditch culvert clean-out on Romrell Lane, and that the arrangements have
been made to fix the gas heater in Well #1 pumphouse so that it will meet
safety standards. Regarding the boat that w~s parked in the street at the
Brent Peterson residence, 2255 Midway Avenue, Mayor Wehmann reported that
it was moved after a letter was sent to Mr. Peterson. In other business,
Councilman Lee inquired about the amount and cost of extra concrete which
was poured at Lester fovey's.laO Bittern Drive, and it was mentioned that
the County has installed stop signs on the streets in Jennie Jean Estates.
Claims were approved for payment. Councilman Lee moved to adjourn, seconded
by Councilman Anderson; the meeting was adjourned at 10)00 P.,M.
