October 1, 1977, Mayor Wehmann stated that good faith intentions to that
effect could be given. The Mayor of Idaho Falls is to be contacted
before setting up a public hearing on this matter.

The meeting was called to order at 7:35 P.M. by Mayor George Wehmann

Minutes of the meeting
Larry Felt and Randy Waite were present to discuss the settlement on the
cost of waterline installed to serve the Felt and Waite Addition as agreed
upon at the meeting of January 19, 1977. Mayor Wehmann st.ated that he
would like to check on whether or not the 8-inch waterline which the City
had on hand was taken to apply on the cost and if the required valve was
installed before payment is made, and it was requested that an itemized
claim be submitted. Reference was made to the matter of ownership on the
installed pipe which is on the north side of Sunnyside Road and presently
outside of the City limits to the west, and it was decided that a record-
able document should be prepared by the City Attorney giving the develop-
ers retention of the waterline in the location mentioned, with the City
having the right to hook on at either end. It was suggested that the
agreement should require the owners to stand the expense of any needed
repairs for such time as the agreement is in effect with the City to do
work.
It was noted that a detailed review of the recently completed Annual
Audit was presented to the Mayor and Council on Tuesday, July 12, and
that approval of the audit would be appropriate. Councilman Lee moved
to approve the Audit for 1976 as prepared by the firm of Galusha, Higgin~
and Galusha, Certified Public Accountants. The motion was seconded by
Councilwoman Dille; voting was all in favor; motion carried.
Information to be used in the Annexation Agreement for the 17th Street
North Addition was reviewed, and it was pointed out that the official
agreement is needed for signature no later than the meeting of August 3,
1977. Councilman Lee moved to accept the Annexation Agreement of the
17th Street North Addition subject to required corrections and changes.
The motion was seconded by Councilman Swensen; voting was all in favor;
motion carried.
Ordinance No. 149, an ordinance to annex the 17th Street North Addition,
was considered for action. Councilman Lee moved to waive the first and
second readings of Ordinance No. 149, and to place the ordinance on the
third reading. The motion was secondeGi. by Councilman Swensen; voting
was all in favor; motion carried. Ordinance No. 149 was read in full
by Mayor Wehmann. Councilman Swensen moved to adopt Ordinance No. 149.
The motion was seconded by Councilman Lee; votion was all in favor;
motion carried.

REPORTS
According to Councilman Swensen, a representative of the State Employment De-
partment should be here around the first of August t6 work out details for
funding the City's application for CETA VI employees. He noted also that a
bid has been submitted for fixing the roof of the City Building.
Councilman Anderson reported that another new backstop has been started in
the north part of McCowin Park. In response to an inquiry by Mayor Wehmann
about having former employee, Gordon Totten, do the welding for the backstop
benches, it was indicated that this work should be done by the regular City
men~
A report on a meeting with a representative of the State Hiqhway Department
was given by Councilwoman Dille, with special reference being made to a
new program for funds to stripe City streets and the traffic accident rec-
ord for 1975 and 1976. Mrs. Dille noted that she had c~ecked out the proce-
dure for follow-up on unpaid tickets and learned that warrants for arrest
must be submitted within 90 days of the date of the ticket in order to be
accepted for action by the court. Regarding Planning and Zoninq Commission
business, it was indicated that a p~blic hearing is scheduled on August 16
for rezoning and a new development proposal of the Robert Nixon property
west of Sand Creek, and the preliminary plat for annexation and initial
zoning of the Whitaker property (Mountain Valley Estates) located east of
the railroad on an extension of Wanda Street; also the Commission requests
that the City Attorney give advice on a timetable and items needed for com-
plying with the State Land Use Planning Act. Mayor Wehmann suggested that
it might be well to contact the Bonneville Council of Governments about
compliance procedures for land use planning, and mentioned that there is to
be a meeting on this subject in Rexburg on July 27. Other items which Coun-
cilwoman Dille reported as recommendations of the Planning and Zoning Com-
mission were to amend Section 11-5-24(D-10) of the Zoning Ordinance to re-
quire two parking spaces per unit.for 1,2,3, and 4 family dwellings, and to
require that the developer of Tie Breaker Village (Russ Wallace property)
put in and pay for all utilities. The Council indicated approval of amend-
ing the zoning ordinance relative to parking spaces, and the City Attorney
was instructed to prepare the necessary ordinance. Providing water for Tie
Breaker Village, if annexed, was discussed, and Mayor Wehmann read a letter
from the P.E.G. Corp. (Russ Wallace) agreeing to the annexation of Division
No. 1 and the other divisions as they are made ready for development, noting
that a public hearing on the annexation of Tie Breaker Village is set for
Wednesday, August 3, 1977.

The City Clerk reported claims to pay in the amount of $13,031.64, with a
checking account balance of $13,215.33 and additional property tax funds
expected shortly. Permission was given for the Clerk to attend an election
workshop in Idaho Falls during the coming week.
Mayor Wehmann presented a budget schedule which was approved by the Coun-
cil. Announcement was made that Gerald Hale has been hired on a temporary
3-1 scale to fill the vacancy left by the resignation of Gordon Totten. A
recommendation was made by Mayor Wehmann that the Ammon Day celebration
should be re-scheduled for Saturday, August 20, since there has been a prob-
lem arranging for a Chairman for that activity. Mayor Wehmann gave a short
report on the recent hearings for the Utah Power & Li9ht rate increase, in-
dicating that the Idaho Public Utilities Commission members have made a I
tentative recommendation for somewhat less than the original request, and
noted that efforts against the rate increase have saved the City $48,000
so far this year inasmuch as an intermin increase was not granted while
the hearings have been in progress. With reference to the audit review
comments regarking Local Improvement District bonds, Mayor Wehmann explain-
ed that L.I.D. #5 and #6 bonds have not been sold, but the L.I.D. #5 bonds
have been prepared and need to be signed by former Mayor Keith Turnbow.
Mayor Wehmann requested that Councilman Anderson check on an accident claim
concerning a City truck being backed into a vehicle at the swimming pool
parking lot, and asked Councilwoman Dille to see about having the Traffic
Safety Commission make a recommendation on painting of crosswalks, and to
obtain information regarding funds for the Fire Department under the Rural
Communitv Development proqram. It was mentioned by Mayor Wehmann that there

is a need to come to a decision on the Impact Area for land use planning,
and the City Attorney was requested to advise on what action would by need-
ed in order to modify the plan as presented at the hearings by moving the
boundry for impact to one-half mile north of 1st Street. It was also poin-
ted out that the County Planning and Zoning Commission request a non-
binding review of all plats submitted to the City ofA.mmon. Mayor Wehmann
reported that an answer has been received from Senator Church in response
to an-inquiry about the safety uf the Ririe Dam which was sent to Cecil
Andrus, Secretary of the Interior, with a copy to Senator Church.
Mayor Wehmann agreed to check on a report that City trash is being dumped
on the Robert Nixon property. He also noted that two water service lines
on Bittern Drive were repaired this week.
Claims were approved for payment. Councilman Lee moved to adjourn; the
motion was seconded by Councilman Swensen. The meeting was adjourned at

Minutes of a Special Public Hearing before the Mayor and City Council:
The meeting was called to order at 7: 30 P. M. by Counci L Presiden t

Development of Salt Lake City, Don Ellsworth and Garth Cunningham rep-
resenting Ellsworth Engineering, Inc., George Klomp of Bonneville County
Planning and Zoning, Bobbie Stephens from the Post-Register newspaper,
and property owners Leonard McDonald, 850 S. 3500 East, Jacob Johnston,
400 Amy Lane, John S. and Polly G. Stiba1, 440 Amy Lane, and Howard W.
Spa1etta, 460 S. 3500 East.
Council President Swensen explained that he was conducting the meeting
in the absence of Mayor Wehmann who is expected to be in attendance
later upon his return from a meeting in Boise. He noted that the pur-
pose of the meeting was to hear comments from the public regarding the
final plat and a proposal for the annexation and initial zoning of the
property known as Tie Breaker Village, Division No.1, containing 23,75
acres, and also the annexation of another small tract of the same sub-
division containing 8.34 acres, both of these being located between 1st
Street aud the present City Limits north of 17th Street. Engineer Benton
reported that comments of the different reviewing agencies have been
given to the developer's engineer and incorporated into the final plat,
except for the size of several lots which will be changed in order to
meet the frontage requirements of the City of Ammon zoning ordinance.
Councilwoman Dille reviewed the comments and recommendations of the
Planning and Zoning Commission from the minutes of the Public Hearing
held in April, 1977, noting that the subject was discussed again at the
July meeting, and that the final plat as now presented and the zoning as
now requested !we taken care of matters which were considered objection-
able by the adjoining property owners who were present at the Planning
and Zoning hearing. A letter from William M. Brinton, Bonneville County
Zoning Administrator, was read to make a matter of record the fact that
the County Planning Office feels strongly that the annexation of Tie
Breaker Village to the City of Ammon would not be orderly or in accordance
with the County or City of Ammon comprehensive plan. It was pointed
out by Engineer Benton that the Iona-Bonnevi1~e SlitWeB District system
has been designed to be able to serve this proposed subdivision, and
Councilman Swenson explained that the City of Ammon would have no problem
providing law enforcement, fire protection, and an ample supply of water
:from the five operating wells and the updated water system. In resRonse

power) in Ammon as compared to the rates if the area were to become part
