changes that were approved are different from what was advertised. In
connection with approving the plat, there was some discussion about wheth-
er or not the motion should mention the required improvements since this
is to be covered in the annexation agreement and the review of the plans
by the City of Idaho Falls. Mr. Benton stated that the developer has al-
ready agreed to put in water and sewer lines, curb and gutter, and storm
sewer, and it is presumed that sidewalks will be required. Councilwoman
Dille moved to approve the platting as presented in Division No. 1 with
curb and gutter and sidewalks. The motion died for lack of a second.
Councilman Lee moved ~o approve the plattin9 of Division No. 1 of the Ammon
17th Street North Addition as presented, including streets, sidewalks,
curbs, gutters, and storm sewer. The motion was seconded by Councilman
Swensen; voting was all in favor; motion carried unanimouSly.

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 8:00 P.M. by
the following City Officials present:

Others present during the meeting were Ed Turner of the City of Idaho
Falls Engineering Dept., Rance Bare of Ellsworth Engineers, Kent Wood,
Mr. and Mrs. Glen Southwick, and Jack Peterson.

The pledge of allegiance to the flag was led by Councilman Lee; the in-
vocation was offered by Mayor Wehmann. The minutes of the regular meet-
ing on June 1,1977, and the special public hearing meeting of June 8,
1977, were approved as prepared.
Glen Southwick of 2650 Ammon Road presented a complaint about dogs in
his neighborhood, stating that he had signed a non-commercial kennel
license application at 3440 Rawson St. for Brent Dees for three dogs,
but now he has more than that number of dogs. Also he said that the
people at 3490 Rawson St. have three dogs without a non-commercial ken-
nel license, and that he had called the animal control officer about the
barking of the dogs at that address, but was not given any satisfaction
that something could be done. Mayor Wehmann agreed to check these matters
and get back with Mr. Southwick.
The Mayor and Council reviewed an application for a variance which was
filed by Jack R. Peterson of 3665 Brookfield Lane requesting permission
to build a 2-car garage within 10 feet of property line in an R-P Zone
(which requires 20 feet of sideyard for all buildings). It was pointed
out that the neighbor, Mardee Burtenshaw, had already signed a note in-
dicating no objections to this proposal. Councilman Lee moved to approve
the application for a variance for Jack R. Peterson as presented. The
motion was seconded by Councilman Swensen; voting was Lee, yes; Swensen,
yes; Anderson, yes; Dille, yes; motion carried.

Councilman Swensen explained that Martha Johnson, 478 North 3rd West,
Rigby, has filed a claim for repair of a vehicle which she alleges was
damaged by hitting a trench which was being repaired at Sunnyside Road
and Dal Avenue on June 6,1977. Statements signed by Mrs. Johnson and

the city employees involved were acknowledged to be on file, and it was
recommended that the advice of the City Attorney be obtained before a
decision made about whether or not to approve the claim.
The final plat and annexation agreement for the Westwood Addition were
discussed. It was noted that the plat did not show the access road
from AmmonLincoln Road into the area zoned R2, and the agreement as
prepared did not include some of the items which the Mayor and Council
felt to be necessary. Specific reference was made to designating the
previoulsy mentioned access road as a private street and defining the
City's involvement in the cost of water main where a larger size than
8 inches is required. Inasmuch as the developer stated that his
financing depends on timely action on this matter, it was agreed that
the documents should be revised as discussed and approval be obtained
by Mayor Wehmann making telephone contact with all Council members as
soon as the papers are ready. (Approval was given and the annexation
agreement signed by Mayor Wehmann on June 24, 1977.) FurtlJler discussion
was directed toward the need for working out a more efficient procedure
for bringing matters concerning plats, annexation agreements, and
annexation ordinances before the Mayor and City Council.
REPORTS
Councilman Swensen- reported that arrangements for a vehicle in which
the City Officials can ride in the 4th of July Parade in Idaho Falls
are being finalized.
Approval was indicated to a recommendation by Councilman Anderson that
the rates for public swimming at the pool be changed due to increased
costs for salaries and maintenance. Effective July 1, 1977, rates
will be $.50 for ages 1-11, $.75 for ages 12-17, and $1.50 for ages
18 and over, with no change in the season ticket or swimming lesson
rates. It" was also agreed that the salary for summer employee Rex
Williams should be $2.50 per hour effective June 27.
Councilwoman Dille had no report, but was asked by Mayor Wehmann to
contact the Sheriff about arranging for some of his officers to work
extra hours to write tickets on watering violations to be paid dir-
ectly by the City of Ammon.
According to Councilman Lee, a call for bids will be advertised for
2 French drains in the Southwick Addition, a fence around Well #5,
and a number of sidewalk repairs throughout the City, with the bid
opening set for July 20.
Engineer Butler was instructed to check the City's access to the storm
sewer pump station along Sand Creek since it has been noticed that sev-
eral residents in the area have been building backyard fences which may
be a problem. Mayor Wehmann noted that immediate action is needed on
the part of the City Engineer's office to provide an operating manual
for Well #6.
The City Clerk reported that there were claims to pay in the amount of
$8,836.49 and a checking account balance in the General Fund of $16,038.7~
A report by Mayor Wehmann indicated that the Cooperative Agreement for
Sewage Treatment is ready to sign and get to the City of Idaho Falls,
the new insurance policy has been delivered so the City will be getting
a bill for $3,038 for the premium payment, and the testimony to be
given at the Utah Power & Light Company hearing in Rexburg on July 19
had to be filed on the previous Tuesday.
