Minutes of a Special Meeting of the Mayor and City Council:
The meeting was called to order at 8:05 P.M. by Mayor George Wehmann,
with the following City Officials present:

Others present during the meeting were Deveaoper Joseph Groberg, and
interested residents Reynold Chambers, 2863 E. 17th St., and Charles
Carr, 2880 E. 17th St.
Mayor Wehmann explained that the purpose of the meeting was to hold
a Public Hearing, as advertised and notified by mail, on the annex-
ation and initial zoning of 18.528 acres and a request for zone changes
on 28 acres, with the combined property being presented as a platted
subdivision with the name of Ammon 17th Street North Addition and
being located north of 17th Street across from Avocet Drive.
Engineer Benton, representing the developer, pointed out the differe'nt
areas on a copy of the preliminary plat, and listed the requested zon-
ing as R3A to Lori Street, R2A on the north side and abutting Lori St.,
and, ~2 and R1 north of that. The zoning recommendation of the Plan~
ning and Zoning Commission was reported to be R1 on the north lots,
R2A on both sides of Lori Street, and R3A from there south to 17th St.
Comments by the residents in attendance indicated that there was no
objection to annexing the described property as requested. Council-
woman Dille moved that the City annex that portion of Ammon 17th St.
North Addition not presently in the City, subject to final approval
by the Council of an annexation agreement for that property. The
motion was seconded by Councilman Swensen; voting,was all in favor;
motion carried.

su iV1s10n, tne-public hearing discussion brought out expressions of
concern about the large full-block lots in the area bordering 17th
street because of objections to the possibility of motels or mor~
turaries being built there, which would be allowed if zoned R3A.
Suggestions to have the developer do additional platting or sign a
special agreement on this subject were felt to not be satisfactory,
but it was determined that approval to the zoning could be given
with a provision that sub-h~adings No.4 and No.6 of Sections 11-16-2
of the zoning ordinance be omitted in this instance. An inquiry made
by Mr. Chambers about whether or not his property, which is adjacent
to the Ammon 17th Street North Addition, would be approved for R3A
zoning also if requested met with mixed reaGtion on the part of the
Council members. In response to a comment about the size of apart-
ment buildings that would be allowed and the resulting density of
population, Mayor Wehmann pointed out that square-footage and off-straa
parking space requirments will restrict the number of apartment units.
It was noted that there were no comments made at the Planning and Zonmg
Commission hearing about leaving the area along 17th Street zoned R1
as it is, but rather it was recommended that the zoning be consistent
with that in the nearby l\lonty Howell Addition. Councilman Lee moved
that the City accept the zoning for Division No.1 of the Ammon 17th
Street North Addition as recommended by the Planning and Zoning Com-
mi~~~~~J~bth the exception that the provisions of Section 11-16-2(4)
and~be oM~tted from the R3A Zone just north of 17th Street, and with
R2A---ZOne-'ju~ t north of 17th Street, and with R2A Zoning on both sides
of Lori Street and R1 on the remainder of the lots to the north. The
motion was seconded by Councilwoman Dille; voting by roll call was
Lee, yes; Dille, yes; Swensen, yes; Anderson, yes; motion carried
unanimously. Attorney Anderson requested that Engineer Benton furnish
a revised legal description since the initial zoning and zone

changes that were approved are different from what was advertised. In
connection with approving the plat, there was some discussion about wheth-
er or not the motion should mention the required improvements since this
is to be covered in the annexation agreement and the review of the plans
by the City of Idaho Falls. Mr. Benton stated that the developer has al-
ready agreed to put in water and sewer lines, curb and gutter, and storm
sewer, and it is presumed that sidewalks will be required. Councilwoman
Dille moved to approve the platting as presented in Division No.1 with
curb and gutter and sidewalks. The motion died for lack of a second.
Councilman Lee moved to approve the plattinSJ of Division No. 1 of the Amron
17th Street North Addition as presented, including streets, sidewalks,
curbs, gutters, and storm sewer. The motion was seconded by Councilman
Swensen; voting was all in favor; motion carried unanimously.

The meeting was called to order at 8:00 P.M. by
the following City Officials present:

Others present during the meeting were Ed Turner of the City of Idaho
Falls Engineering Dept., Rance Bare of Ellsworth Engineers, Kent Wood,
Mr. and Mrs. Glen Southwick, and Jack Peterson.

The pledge of allegiance to the flag was led by Councilman Lee; the in-
vocation was offered by Mayor Wehmann. The minutes of the regular meet-
ing on June 1,1977, and the special public hearing meeting of June 8,
1977, were approved as prepared.
Glen Southwick of 2650 Ammon Road presented a complaint about d09s in
his neighborhood, stating that he had signed a non-commercial kennel
license application at 3440 Rawson St. for Brent Dees for three dogs,
but now he has more than that number of dogs. Also he said that the
people at 3490 Rawson St. have three dogs without a non-commercial ken-
nel license, and that he had called the animal control officer about the
barking of the dogs at that address, but was not given any satisfaction
that something could be done. Mayor Wehmann agreed to check these matters
and get back with Mr. Southwick.
The Mayor and Council reviewed an application for a variance which was
filed by Jack R. Peterson of 3665 Brookfield Lane requesting permission
to build a 2-car garage within 10 feet of property line in an R-P Zone
(which requires 20 feet of sideyard for all buildings). It was pointed
out that the neighbor, Mardee Burtenshaw, had already signed a note in-
dicating no objections to this proposal. Councilman Lee moved to approve
the application for a variance for Jack R. Peterson as presented. The
motion was seconded by Councilman Swensen; voting was Lee, yes; Swensen,
yes; Anderson, yes; Dille, yes; motion carried.

Councilman Swensen explained that Martha Johnson, 478 North 3rd West,
Rigby, has filed a claim for repair of a vehicle which she alleges was
damaged by hitting a trench which was being repaired at Sunnyside Road
