New Business- Councilman Swensen reported that he had called Senator
Dick Egbert to ask his support against Senate Bill No. 1234 which
would prohibit lobbying by the AIC on city-related legislation.
Mayor Wehmann stated that he may try to set up a public meeting on
the Utah Power & Light Company rate increase at the Ammon School
Auditorium. It was mentioned that special summer watering regulations
need to be discussed as soon as possible. Notice was given that the
Budget Hearing is scheduled at 7:30 P.M. next Wednesday, March 23, 1977.
Claims were approved for payment. Councilman Lee moved to ad~ourn
at 11:45 P.M.

Minutes of a SPECIAL MEETING of the Mayor and City Council:
The meeting was called to order at 7:34 P.M. by Mayor George Wehmann,
with the following City Officials present:

The meeting was opened as a _ Public Hearing on the
budqet for fiscal year 1977. Mayor Wehmann pointed out that, in accor-
dance with Federal regulations, a special hearing on the budgeting
of Revenue Sharing funds was held on March 16, and the proposed
expenditures of the receipts from Revenue Sharing are included in the
total budget as documented in the minutes of that hearing. The budget
figures as advertised were reviewed. Reference was made to a letter
from the Bonneville County b-ngineer's Office listing certain costs on
the 17th Street Improvement Project on which there is an amount due from
the City of Ammon of $28,727.87, with comment being made by Mayor
Wehmann that it may be necessary to notify the County that only part
of this can be paid this year. There being no chang~s proposed in the
budget and no interested citizens present to protest or make comment,
Mayor Wehmann declared the Budget Hearing closed, and opened a special
meeting of the Mayor and City Council for the purpose of approving the
budget and passing Appropriation Ordinance No. 145. Councilman Lee
moved to waive the three separate readings of Ordinance No. 145, known
as the Annual Appropriation Ordinance for Fiscal Year 1977 (January 1
Through September 30, 1977) and to place it on the third and final read~
ing. The motion was seconded by Councilwoman Dille; voting was all in
favor; motion carried. Ordinance No. 145 was read in full by Mayor
Wehmann, and it was noted that the Notice of Public Hearing on the
Budget was published in the newspaper on March 21 and March 28, 1977.
Councilman Lee moved to adopt Ordinance No. 145 kn0WTI as the Annual
Appropriation Ordinance for Fiscal Year 1977. The motion was seconded
by Councilwoman Dille; voting was all in,favor; motion carried.
Relating to other business, Councilwoman Dille was asked to make
arrangements to get the Law Enforcement Contract for this year signed.

Minutes of a Special Public Hearing before the Mayor and City Council: The
meeting was called to order at 7:30 P.M. by Mayor George Wehmann with the
following City Officials present:

Mayor Wehmann explained that the purpose of the hearing, as required by
law and published in the legal notices of the newspaper on March 21 and March
28,was to consider a request submitted by Mr. Nixon to rezone a portion
of land on the east side of Sand Creek fromR1 to R3 and another portion
on the west side of Sand Creek from RSC-1 to R3 (to allow multi-family
dwellings). It was noted that a public hearing had been held on thes matter
before the Planning and Zoning Commission on March 15, where a petition
signed by 55 individuals indicating objection to the proposed development
on the east side of Sand Creek was presented, and the Commission had recom-
mended that the rezoning for that parcel of land be denied. Regarding the
requested zone change on the west side of Sand Creek, the Planning and
Zoning Commission had reported that there was no objection and approval
was recommended. Mr. Nixon read a letter, signed by himself and addressed
to the Mayor of the City of Ammon, which stated his desire to withdraw
the request which had met with objection, and it was determined that this
was an acceptable procedure and no further action was necessary. Mr. I
Nixon displayed a drawing of the layout for .condomimium units which he
proposes to build in the area on the west side of Sand Creek, and those
present expressed satisfaction with the plan. Reference was made to the I
existing signed easement for the sewer line that crosses Sand Creek and
extends into the property under discussion. Regarding the easement for
Eastgate Drive which has never been .signed, Mr. Nixon stated his willing-
ness, which is hereby made of: record, to dedicate Eastgate Drive to the
City from 17th Street to the north end of the trailer court (but not into
the trailer court). Mayor Wehmann made note that the City will have no
responsibility to repair any damage which may be done to the street during
the construction of the proposed development there.
Councilman Swensen moved that the request from Robert Nixon (Cornwall Assoc-
iates) in regard to a zone change from RSC-1 to R3 on the property west
of Sand Creek and south of the Eastgate Shopping Center to the north
perimeter of the Eastgate Mobile Village be approved as recommended by
the Ammon City Planning and Zoning Commission. The motion was seconded
by Councilman Lee; voting was Swensen, yes; Lee, yes; Dille, yes; Ander-
son, yes; motion unanimously passed.
Mayor Wehmann offered the facilities of the City Building to Mr. Nixon
for meeting with the residents on the east side of Sand Creek in aa
endeavor to work out some agreeable use of the undeveloped land which
he owns there. The public.hearing was closed by motion made by
Councilman Swensen at 8:40 P.M.; seconded by Councilwoman Dille; voting
all in favor.
