CITY OF AMMON
March 2, 1977
Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7: 30 p. m. by Council President Russell N.
Swensen, with the following City Officials present:
Councilman Russell N. Swensen Clerk Deon Hemingway

Councilman Francis Lee Asst. Engineer Robert Butler
Councilman Marvin J. Anderson Maint. Supv. LaVern E. -Williams
Not present: Mayor George Wehmann - out of town
Also present during the meeting was C. Jordan Smith, Sales Representative of
-Boyd Martin Company.
The pledge of allegiance to the flag was conducted by Councilwoman Dille and the
invocation was offered by Councilman Lee. Minutes of the previous meeting were
not ready for approval.
Inasmuch as it has been determined that the City will accept credit rather than
having the lawn mower repaired which was badly damaged in an accident last fall,
C. Jordan Smith of Boyd Martin Company was given time to present cost and per-
formance information on several mowers which he felt would meet the City's
needs. He pointed out that, if the City were to purchase the Hustler mower which
was left here several months ago, it could be paid for by the insurance settlement
plus the credit allowance on the damaged mower. However, if a larger mower is
desired, financing arrangements can be made without interest if the balance is
paid within the next two years or with interest if payments need to be spread out
over a longer time. He made note that there is to be an increase in the cost of
mowers 'from the factory after February 10th, so it would be to the city's advantage
to make a decision before that time. Councilman Lee moved to accept the pro-
posal from Boyd Martin Company ',on a Jacobsen F-IO 5-gang Fairway Mower with'
the price as quoted of $11,690 les s $700 credit on the wrecked F -133 mower les s
an additional discount of $612 leaving a balance of $10, 378, with payments to be
worked out after further discussion with the Mayor and City Council. The motion
was seconded by Councilman Amerson; voting was all in favor; motion carried.
Mr. Smith said that he would place the order at the factory and would expect to
be notified by Monday of next week about the final decision.
COMMITTEE REPORTS
Mayor (Council President) - Councilman Swensen made note of a reminder from
Mayor Wehmann that the notice of public hearing on the Revenue Sharing Budget
which is to be at the next regular meeting on March 16 needs to be in the news-
paper as a news article within the next few days (on or before March 9).
Fiscal Ope"rations - According to a report by Councilman Swensen, explanation
has been obtained from John Homer, the City's insurance agent, that the check
for $3, 454. 52 which was sent in settlement of the claim on the damaged lawn mower
represents the amount of the repair estimate given to the insurance company by
Boyd Martin Company of $3,704.52 (which is a little less than the figure given to
the City) less $250.00 deductible which was agreed upon in order to reduce the
premium when the insurance was reviewed last year, so it would appear that this
settlement should be accepted. Regarding temporary use of land belonging to Horace
Smith for a turnaround at the east end of Circle S. Drive, Councilman Swensen
reported that Mr. Smith has been contacted and he feels that this would take too
much of his land"so he is not willing to give the City permission to put in the re-
quested turnaround. Inasmuch as this means that the hazardous condition will
still exist when the garbage truck has to be backed up on that street, it was
decided that no parking on the block would eliminate some of the problem, so
Engineer Butler agreed to take some width measurements on Circle S Drive to
determine if the parking restriction regulation would be enforceable there. Council-
man Swensen indicated that he is still working on getting sane pamphlets on energy
conservation to distribute to the people of Ammon.
Planning and Zoning - It was reported by Councilwoman Dille that the notice has
been published for the public hearings to be held by the Planning and Zoning Com-
mission on March 15, but there will be no hearing on March 8 since the developer
of the proposed Westwood Addition did not get the legal description in on time.

Parks and Recreation - In connection with an application filed for match-
inq funds for park development from the Bureau of Outdoor Recreation,
Engineer Butler noted that comments made at a short meeting with repre-
sentatives of the State Parks Department indicated that approval of the
application looks favorable, that the grant term would go over the two-
year period of 1978 and 1979, and that the City's share of the cost can
be partly by in-kind labor. A suggestion was made by Mayor Wehmann that
Councilman Anderson give consideration to making arrangements to save
gas for heating the water at the swimming pool during the coming season
by keeping the water five degrees cooler and covering the pool with
plastic at night.
City Clerk - A report by the Clerk listed claims to pay in the amount
of $3,996.13, a balance in the General Fund checking account of $7,706.96,
and $362.10 in accounts delinquent for more than 60 days at the end of
February.

Police and Fire Department - Councilwoman Dille reported that a case of
false alarm has been checked out, and the law enforcement officer has
recommended that no charges be pressed since the investigation itself
has impressed the person involved with the seriousness of such action
and there were no money damages to the City in this incident. It was
the feeling of the Attorney and the Council members that this recommen-
dation should be accepted. At the request of Councilwoman Dille aBd in
response to an inquiry made by County Animal Control Officer Ciro Rustici,
matters concerning the activities of the city employee who has been sworn
in as City Animal Control Officer were clarified to the effect that he
is not to go house to house to sell dog licenses, that he need not wear
a police jacket and badge, that he should sign citations along with the
County officer for violations having to do with dogs which he picks up,
and that dogs should not be picked up on days that the County officer
is off duty which would require that the animals be kept overnight in
the City impound cages. The Council approved a request that the City
Animal Control Officer be allowed to purchase a pair of heavy gloves to
wear while picking up dogs, and took under advisement an inquiry about
whether a City-owned gun should be declared surplus and sold by calling
for bids.

Library - Regarding the library situation at the VoTech School which
Councilwoman Dille was asked to check out, she explained that there have
been some books collected but there is no space for a library at this
time, so it will be at least two years before any facilities can be
available unless something different comes up.
Public Works - Copies of proposed increases in the water service connection
charqe and sewer hookup fee were distributed by Councilman Lee. Attorney
Nelson advised that there should be cost figures to support these increases
since the fees should be based on a reasonable service and not used for
revenue producing purposes. It was decided that the City Engineer should
make some calculations on the costs as a basis for determining what the
water connection charge should be and that the Sewer Agreement with the
City of Idaho Falls requires the City of Ammon to have a sewer hookup
fee of an amount not less than what that City has, which is now $300.
No official action was taken in this matter.
Attorney - A letter written by the City Atrorney to Mr. O. R. Birch regard-I
ing street dedication on his property and a response to that letter from
the Birch's attorney were read, noting especially that the Birches have
taken the position that their dwelling site has frontage on the Ammon-
Lincoln Road so they are not prepared to dedicate land for an extension
of Wanda Street and desire to take water service from Ammon-Lincoln Road.
The City Attorney was instructed to notify the Birches that claiming
frontage on Ammon-Lincoln Road will require compliance with the City Ord-
inance (Section 8-4-12) which requires that every parcel of land in the
City improved for occupancy which is within 200 feet of the public sanitary
sewer must connect to the sewer within 90 days.
Engineer - According to Engineer Butler, the sewer meter station situation

is still pending. He reported that he has been trying to locate equip-
ment that can be rented to clean out the water storage tank, and that
he has not been able to get any information on emergency lighting for
the Well #6 pumphouse.
Old Business - Councilman Anderson suggested that consideration be
given to a-proposal that the City enter into an arrangement in which
the School-District would mow the lawns on the two parts of McCowin
Park for credit on the school water bill, which would mean that pro-
bably a small lawn mower would be adequate to take care of the other
park areas. Councilman Swensen reported that the part needed to com-
plete the repair of the damaged dump truck has still not been received.
New Business - A request by Councilman Swensen that the Council make a
recommendation on whether the City Clerk's office should use the services
of the Credit Bureau to collect on amounts still due the City by people
who have moved was taken under advisement. The Council also agreed to
think about a suggestion from the Maintenance Department that radios
be installed in the City vehicles so that the employees can make contact
with the City office in case of fire calls, etc.
Council members indicated approval of the proposed budget for the 1977
9-month fiscal year. Claims were approved for payment. Councilman
Lee moved to adjourn at 10:50 P.M., seconded by Councilman Anderson.

In accordandance with notice which was given in the newspaper (The Post-
Register), the meeting was opened as a public hearing on the Revenue
Sharing Budget for the 1977 9-month fiscal year. Mayor Wehmann re-
viewed the figures as follows:
