Old Business
According to Mayor Wehmann, City of Idaho Falls employees have inspected the
sewer lines in Barbara Jean Estates finding one defect which has already been
corrected, and notice was sent with the billing from the City of Idaho Falls that
the lines were so filled with debris that they had to be flushed 4 times. (It was
pointed out that the cost of this inspection is at the expense of the developer as will
be the case for the inspection in the Meadow Lark addition and all future developments.)
As a matter of interest, Robert Butler mentioned that he was on hand when the sewer
inspection was made and noticed that all of the debris was near manholes so had re-
sulted from the street work having been completed after the contractor had cleaned
the sewer lines.
Announcement was made by MayorWehmann that the problem with the 70 h. p. pump
at Well #6 was apparently a defect in the impellor as discovered by B- W Electric
personnel in the presence of representatives of H-K Contractors and the City of
Ammon, and the pump has been sent in for repairs which will likely be at the
expense of the manufacturer.
Regarding the sidewalk and curb-and-gutter work which is under way, Mayor
Wehmann indicated that there are some problems which are being worked out,.
that he is in full agreement with the Engineer about who is responsible for costs,
and that he cannot see replacing the curb and gutter along the property owned "!:>y
Thayle Monson at 2090 Eagle Drive.
New Business
Mention was made that there have been complaints about parking on Circle S Drive,
so that street should be posted for IlNo Parking'l if it is less than 36 feet wide.
Councilwoman Dille reported that Reynold Chambers of 2.863 E. 17.th St. has asked
that the City take action on getting the owner of the partially torn-down house
adjacent to his property to finish the job, and Mayor Wehmann agreed to write to the
Hatch Investment Company about this. Several items of information were reviewed
by Mayor Wehmann as follows: A letter was written to the County Commissioners about
a 4-way stop on Ammon Road at 17th Street, and a reply was received that their
intentions are to do this very shortly at that location as well as at Sunnyside and
Ammon Road. The sump pump on Eagle Drive failed recently, but is now repaired.
Utah Power and Light Company has prepared a contract for furnishing electricity for
storm sewer lift station pump at Sand Creek, but the records are being checked to
to see if the City agreed to accept this responsibility before the contract will be
signed. The company of C. Reinhart & Sons have been notified by letter of the
Cityls position concerning their failure to clean up the debris left on Samuel Street,
and a bill was included for the City having taken care of this.
Mayor Wehmann asked that the Council members plan to meet in an executive meeting
at 7 P. M. on October 6 just prior to the next regular meeting for the purpose of
interviewing an applicant for City Administrator.
Councilman Swensen suggested that all City officials plan to attend the AIC Annual
Academy on November 19-20 at Idaho State University in Pocatello and the AIC
District Meeting in Idaho Falls on November 9. He also mentioned that the~ill
be an accounting institute for City Clerks on October 15 in Idaho Falls.

Mayor Wehmann explained that the first item of business was to consider the
annexation and zoning of a subdivision to be known as the Felt & Waite Addition
located south of Sunnyside Road and adjacent to the west City Limits, the property
measuring 460.6' x 1350. 10' and comprising 14.244 Acres. Developer Larry
Felt displayed a copy of the proposed development plat and stated that an RPA
Zoning is requested. He pointed out that all lots are at least 150' x 200' (no less
than 2/3 acre), the streets are to be dedicate.d to 60 feet wide with the paving
finished on 28 feet and without curb and gutter as allowed by City of Ammon I
policy, and a temporary cul-de-sac will be installed at the dead end of the street
to facilitate the garbage truck, fire trucks, etc. Mr. Felt mentioned that he
and Mr. Waite intend to build homes for themselves on two of the lots and there
will be restrictive covenants to make this a nice development. A report by Tom
Chriswell, Chairman of the Planning ,and Zoning Commission, indicated that there
were no interested citizens present at the public hearing on this matter held the
previous evening, and that the Commis sion members had voted unanimously in
favor of recommending that the Felt & Waite Addition be annexed and zoned RPA as
requested. It was no.ted that, since Engineer Benton represents both the City
and the developer, the plat and specifications are to be checked by some other
engineer in accordance with the City's present conflict-of- interest policy. In
response to an inquiry by Mayor Wehmann, Attorney Anderson explained that there
is no legal restriction which would prevent the lots from being divided into less
than 120 feet of frontage as long as the zoning requirements are bing met except
to have the developers make a commitment in the annexation agreement which is
to be finalized before an official annexation ordinance would be adopted. Council-
man Swensen moved to approve the. annexation of the Felt & Waite Addition with
zoning of RPA as presented and as recommended by the Planning and Zoning
Commission. The motion was seconded by Councilwoman Dille; voting was:
Swensen, yes; Dille; yes; Lee, yes; motion ca.rried. Mayor Wehmann asked that
Mr. Felt and Mr.. Waite plan to come back to the next City Council meeting on I
October 6, 1976, to work out an agreement on a proposal to have the City
participate in the cost of extending the water main to serve the new subdivision.

Street and just east of Sand Creek, was brought before the public hearing.
Mr. Howell displayed a copy of the proposed plat, consisting of 19.62 acres,
and pointed out that zoning of R3A is requested on Lot I Block I and Lots I
and 2 Block 3, with R2A zoning for the balance of the subdivision. Mayor
Wehmann indicated that individual notices had been sent to all who live within
300 feet of the property under discussion, even though this is not required,
and it was acknowledged that most of the citizens present were from that area,
while only two individuals who were .interested in this subdivision were in attendance
at the public hearing conducted by the Planning and Zoning Commission the night
before. The developer explained that he would hope to sell the property directly

along 17th Street for professional business buildings, noting that this is adjacent
to the land which was recently zoned to allow the construction of a nursing home,
and plans for multi-unit housing on the other lots. In response to considerable
objection expressed by the people in attendance about the possibility of government
subsidized apartments being built in the addition if the R2 A zoning is approved,
Attorney Franklin Smith, representing a prospective buyer in the subdivision, des-
cribed the standards and guidelines which would be required by the Farmers Home
Administration in order for the dwelling units to be occupied by people who-qualify
for interest-credit rent. Tom Chriswell, Chairman of the Planning and Zoning
Commission, reported that the voting of the Commission members regarding the
Monty Howell plat as proposed resulted in a tie, with 3 in favor and 3 not in favor.
It was noted by the developer that the streets in the addition are to have a 60-foot
right-of-way, that a fence is required along Sand Creek, and that the frontage along
17th Street is planned to be a green area. Comments by the Mayor and City Council
members indicated the feeling that there is a need for some of the requested type
of zoning in the City, and that there is an advantage to annexing this particular
area so that its development can be controlled by the City of Ammon rather than the
City of Idaho Falls which has jurisdiction under the one -mile statute. Councilwoman
Dille moved to approve the annexation of the Monty Howell Addition with zoning of R3A
on Lot I Block I and Lots I and 2 Block 3 and zoning of R2A on the balance of the sub-
division as presented. The motion was seconded by Councilman Lee; voting was
Dille, yes; Lee, no; Swensen, yes; Anderson, no; tie-breaking vote by Mayor Wehmann,
yes; motion carried.
Councilman Lee moved to adjourn; seconded by Councilman Swensen; public
hearing meeting adjourned at 9:45 P. M.

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7:45 P. M. by Mayor George Wehmann with the
following City Officials present:

The pledge of allegiance to the flag was conducted by Councilman Anderson; the
invocation was offered by Councilman Swensen. The minutes of the meeting of
September 15, 1976, were approved as prepared. It was noted that the Mayor
and Council members had met in an executive session from 7:00 to 7:45 P. M.
just prior to the regular meeting.
Lester Ager, who lives on.Romrell Lane between Molen St. and Sunnyside Road,
inquired about getting the remainder of the street in that block paved. He was in-
formed that such improvements would have to be done under a Local Improvement
District, and that the property owners had not been in favor when it was proposed
to include paving and curb and gutter on that street in Local Improvement District
#6 last year, but.it would be kept in mind for the future. A problem with the
grating over the ditch on Romrell Lane was also mentioned by Mr. Ager, and
insJructions were given to the City Maintenance Supervisor to get this fix ed.

but the response so far has only resulted in the wood being burned leaving the
brick walls standing which makes a safety hazard, so it may be necessary to
