Council Minutes 09/01/1976 I o ~ ~ CO W CJJ I I 213 Parks and Recreation - Councilman Anderson reported that the church group has made considerable progress in getting the land prepared for planting at the new . park located in the Peterson Park Addition. LaVern Williams and Engineer Benton were asked to get the necessary fittings for the sprinkling system for the new park and have them installed as soon as possible before the grass can be planted. Mayor Wehmann mentioned that the weel:l killing which was done in L~ons Park early in the summer was not effective so it should be done again, that the fire department men - have been taking care of fixing up the restrooms in Lions Park, and that the City employees planted grass by the swings in Lions Park. He recommended that arrange- ments be made to get a sickle mower to cut weeds along streets. Acc;ording to Councilman Anderson, the City has been offered $175 for the flail mower which was purchased new for approximately $1200 in 1974, and it was felt that decision on this should wait until it can be determined if there is any way to use the equipment for trimming weeds along the streets. Police and Fire Department - Councilwoman Dille reviewed the July law enforce- ment report which showed a total of 459 hours worked in Ammon by the County Sheriff's Department personneL She noted that the July Animal Control Report was not available at this time. Mrs. Dille pointed out that it may be possible to get reimbursement for the cost of the paint for crosswalks if application is made to the proper funding agency; also the deadend signs are now available to be put up on Southwick and Citcle S Drive. Public Works - A report by Councilman Lee indicated that the extension for the fire hydrant on Ross Avenue has been ordered, that bids on a snow plow will be in by September 1, and that he intends to make a telephone call to check on the latest information about the delivery date for the new garbage truck. He requested that the City Maintenance Supervisor have the "No Parking'" signs cemented in where necessary., Old Business - Reference was made to the Ammon Day celebration to the effect that proceeds from the dance amounted to $188.82, and it was felt that setting the speakers far the music on the south side of the tennis courts so that the sound was aimed to the north helped to eliminate complaints. Mayor Wehmann recommended that a date be set for the 1977 Ammon Day since he would like to get the Chairman position filled right away and make arrangements for a concert by the Navy Band. The calendar was checked, and Councilman Lee moved that the next Ammon Day be held on Satur- day, August 6, 1977. The motion was seconded by Councj.lman Swensen; voting was all in favor; motion carried. Claims were approved for payment in the amount of $5, 935. 96. M. by Mayor George Wehmann with the following City Officials present: Mayor George Wehmann Councilman Russell N. Swensen Councilman Marvin J. Anderson Councilman Francis Lee Not present: Councilwoman Carol A. Dille, Clerk Deon Hemingway Asst. Attorney Franklin Smith Engineer David E. Benton Maint. Supervisor LaVern E. excused due to illness Williams Mayor Wehmann led the pledge of allegiance to the f lag; prayer was offered by Councilman Anderson. Minutes of the meeting of August 18, 1976, were approved as prepared. Prior to the opening of the meeting, several matters were discussed unofficially as follows: 214 Mayor Wehmann reported that he had written to the Havenhurst Corporation about the delinquent account for the Eastgate Mobile Village, and a ch~ck for $1, 181 has been received, but there is still a balance due for the July and August services. It was felt advisable for the Mayor to make an appointment for a personal contact with Mr. Quayle Dutson of the Havenhurst Corporation since he expects to go to Salt Lake City next week. Those present agreed that funds on hand derived from Ammon Day activities should be placed in a Time Certificate of Deposit until needed for appro- priate projects yet to be determined. Regarding City manpower needs, Mayor Weh- mann indicated that he is getting some data together to study before some decisions can be made. He mentioned that he has a meeting with Phil Worlton of Utah Power & Light Co. scheduled for 1 P. M.on Tuesday, September 14, to' review the contract situation for street lights on 17th Street and other street light matters which need I attention. It was noted that the State inspection of the 17th Street reconstruction project was done on August 24 and listed as a final inspection subject to corrections needed. Engineer Benton recommended that the County Engineer, Robert Gray, be requested to check the drainage problem areas by running some water into the gutter along the street, and pointed out that additional designing is planned to facilitate cleaning out at the Sand Creek storm sewer lift station. Maintenance Supervisor LaVern Williams asked that the 17th Street contractor be reminded that there are two waterline valves on Eastgate Drive near the Circle K Store which have never been brought to the surface, and Engineer Benton stated that Robert Butler, Asst. Engineer, is aware of this. Recent repair work done on the sump pump at Eagle Drive and Salmon Street was mentioned. The first item of business in the official part of the meeting was a review by Mayor Wehmann of the inspection on August 24 of the sewer project concrete and asphalt deficiencies, which resulted in the following responsibilities being accepted: City ? Hartwell Excavating Co. 392 lineal ft. 96 lineal ft. 164 lineal feet 63 lineal ft. 126 "'1 242 lineal feet 78 square yards 0 661 square yards Walk Curb Asphalt It was explained that Burton Concrete Company had been contacted and had given a bid to do the cement work at the same cost as quoted on a previous job (see I minutesof July 21, 197.6 meeting), which figured to be somewhat more than the bids received from C. Reinhart & Son of $2198.70 for replacement of sidewalk and curb and gutter and $924.00 for removal of the defective concrete by H-K Contractors, making a total of $3,122.70. There would be an additional $511. 00 for the cost of repairing the concrete listed as questionable if the City accepts an offer by HooK Contractors (forme'rly.Hartwell Excavating Company) to share the expense at these locations. Councilman Lee moved to accept the joint bid of H-K Contractors and C. Reinhart & Son, Inc., for removal and replacement of 392 lineal feet of.sidewalk and 63 lineal feet of cm-b and gutter and further to accept the offer regarding paying for half of the 96 lineal feet of sidewalk and 126 lineal feet of curb and gutter as proposed by Leonard Foster of HooK Contractors. The motion was seconded by Councilman Swensen; voting was all in favor; motion carried. Councilman Swensen moved that the necessary funds to pay for replacement of the sidewalk and curb and gutter in the City come from additional revenue sharing monies due the City. The motion was seconded by Councilman Lee; voting was all in favor; motion carried. Councilman Swensen moved that Mayor Wehmann be authorized, along with the City Engineer, to negotiate with HooK Contractors on a price. for replacing the 78 square yards of asphalt at the time that the contractor replaces the 661 square yards. The motion was seconded by Councilman Lee; voting was all in favor; motion carried. COMMITTEE REPORTS - Mayor Regarding making arrangements to employ a City Administrator, Mayor Wehmann informed the Council that he had checked with the Association of Idaho Cities and others and was advised to advertise for someone to fill the position, then a more meaningful job description could be written as the duties are worked out. Copies of wording for the advertisement similar to that fourd in the Western Cities Magazine were distributed to the Council members by Mayor Wehmann, and he recommended advertising in the local newspaper and the AIC magazine. Councilman Lee moved to give Mayor Wehmann authority to advertise for a City Administrator as per the prepared announcement. The motion was seconded by Councilman Swensen; voting was all in favor; motion carried. I In response to an inquiry by Mayor Wehmann about the Building Permit: for a house being built off the west end of Wanda Street, Engineer Benton explained that the I o 00 l'- c:Q t:x.:l t:1J I I 215 Planning and Zoning Commission had reviewed the situation with the property owner O. R. Birch and had recommended that the building permit be issued as requested. He noted that the plat plan as presented with the application for the building permit showing the future proposed extension of the street was in order, but the excavating for the basement was not done in the exact place shown on the plan,- so the street location is now a problem, Mr. Birch has not yet agreed to dedicate the land for the future street, and approved arrangements to hook up the water has not been taken care of. Engineer Benton is to contact Mr. Birch and endeavor to work out these matters and also to arrange for a turn-around for the deadend of Wanda Street on the Birch property since it is net !).ow feasable to make this cul-de-sac at the end of the Utterbeck Addition. The City Attorney was asked to be prepared to give counsel about where the City stands legally in relation to having issued a- building permit in this situation. City Attorney - Attorney Smith reported that Ordinance #140 and the notices re- garding public hearings on proposed annexations and zoning have been published. He mentioned that a letter of agreement or intent is to be prepared regarding the breakdown of the 70 horsepower pump at We-ll #6; however, Engineer Benton reported that he had just been advised by Cliff Fitzsimmons of Waterworks Company that arrangements have been made to have Ed Walker of B-W Electric, a company which was not involved in the installaction of the pump, come and check to see what the problem is. Councilman Lee reminded Attorney Smith that there is still a need to write to Arland Rasmussen about the sewer connection for the house at 1890 Eagle Dr. City Engineer - According to Engineer Benton, Jerry Hoggan has brought in a satisfactory plan for hooking on to the sewer for the house he is building in Jennie Jean Acres which is adjacent to the City Limits, and he was informed that he would have to wait until the City has accepted the sewer line in Barbara Jean Estates before this work can be done. Mr. Benton reported that the City of Idaho Falls has completed the camera inspection of the sewer line in Barbara Jean Estates and found a problem which the contractor will have to correct. Regarding the sprinkler system for the new park, Engineer Benton indicated that a design: is being worked out, and it may be possible to use the facilities of the pumphouse at Well #4 for this purpose. It was noted that all of the water system deficiencies which the City was asked to correct by the State earlier in the year have been taken care of except putting in a vacuum breaker for the sprinkler system at the church in Hillview, and the appro- priate church official has been notified about this. Fiscal Operations - Councilman Swensen-reported that the water fountain is on hand to be installed, and that he is waiting for the new garbage truck to determine what size is needed before contacting Horace Smith about land for a turn-around at the end of Circle S. Drive. Planning and Zoning Commission - Arrangements have been made to hold the re- quested public hearing on proposed annexations and zoning for properties north of 17th Street and south of Sunnyside Road as mentioned in the City Council meeting on August 23. Parks and Recreation - Mention was made that signs showing hours for the parks are to be made and posted on all sides of Lions Park and McCowin Park. Mayor Wehmann reported that city cmployee, Garth Staggs, has gone to Salt Lake City with the Jacobsen lawn rriower so that needed parts replacement can be done by the company from which the equipment was purchased. Councilman Anderson indicated that the Pool Manager has not provided him with any information about the closing date for the pool. Councilman Swensen recommended that some regulations for the tennis courts be established and posted, and it was noted that the concrete at the tennis courts. needs to be painted. City Clerk - A financial report was made as follows: $5, 047. 61 claims to pay, $9,493.62 checking account balance, $30, 000.00 General Funds invested, $48,000.00 Sewer Revenue Bond funds invested, $14, 717.44 Revenue Sharing funds invested. It was mentioned that water service was turned off at 2180 Dove Dr. (Dell Denning) and 3175 Rawson St. (Jay Reynolds) on July 30 due to delinquency, but it has been learned that Jay Reynolds has be'en able to turn his water back on some way, so further action may be necessary in this situation. Police and F~re Department - The problem of parking on the sidewalk along 17th Street was dlscussed, and Mayor Wehmann stated that he intends to write a letter thanking the residents along 17th Street for their patience during tre construction 216 time and calling attention to the neces sity of obeying the parking regulations. The need to follow up on parking tickets which are not paid in a reasonable length of time was mentioned. Public Works - Councilman Lee reported on several matters as follows: He has talked to Waters Construction Company about the g.rading that needs to be done on Meadow Lane; no bids have been received on a snow plow; work on the fence at Well #6 has been started; the cement work contracted to Burton Concrete Company is being done; the new garbage truck should be delivered by September 10; the fire hydrant extension on Ross -Avenue is not in yet because the fitting for this has not been received; there are several "No Parking II signs which need to be cemented in so they cannot be turned around. Pertaining to garbage col~ction, the Mayor and Council instruct-I' ed that, when the garbage truck is being backed up on any street (referring espec- ially to Circle S Drive) an employee is to walk behind on the driver I s side to give warning if there are any children or vehicles, etc., in the way. Regarding obtain- ing a tractor which can be used with the flail mower to cut weeds along streets, etc., Councilman Swensen indicated that he has located a used tractor that might be satisfactory and will follow up on that. Attorney Franklin Smith Councilman Carol A. Dille Asst. Engineer Robert Butler Councilman Marvin J. Anderson (7:55 P. M. )Maint. Supervisor LaVern E; Williams Mayor George Wehmann was out-of-town; arrived at 8:40 P. M. Others present during the meeting were Jean Livermont, Joyce Holbrook, and Gail M. Snider, President of Bonneville County Humane Society. Councilwoman Dille led the pledge of allegiance to the flag; the invocation was given by Councilman Swensen. Minutes of the meeting of September 1, 1976, were approved as typed. Councilwoman Dille explained that the Animal Control Officer, Deputy Ciro Rustic~, has asked, for guidance from the Council regarding the disposition of a dog, a "Heeler" belonging to Jean Livermont, 1905 Falcon Drive, which bit the owner's son with the resulting injury requiring 5 stitches, noting that the dog is now impounded, as re- quired by law, and the officer h~s been informed that the dog had previously bitten a neighbor boy but only breaking the skin. Attorney Smith mentioned that Deputy Rustici had reviewed the situation with him at his office, and he advised that the I City, being aware that the dog may be potentially dangerous, has a responsibility to take action so that, if the dog is not destroyed,. the owner will be held liable if any serious harm should come from the dog biting anyone in the future. The City Ordinance was check~d (Section 6 -3-1) and found to include a definition indicating ,that~a dog which has bitten two (2)or ,more persons without provocation or a, dog that has a known propensity to attack or b.ite human beings is considered a vicious dog, but there is no. provision in the code for penalty or disposition of such an animal. Mrs. Livermont stated that the dog in question is confined in the backyard by a redwood fence with the gate securely locked and is protective of the property, and he did bite the neighbor boy when he was near the fence and teasing the dog, also that, when her son was bitten, he was trying to release the dog's,foot from a place where it was caught. Joyce Holbrook, a friend of the Livermonts vouched for the nature of the dog, stating that he had never bothered any members of her family.
