instructed to prepare a written recommendation about how to solve the problem at
the culvert an Meadow Lane at Molen St. He stated that the lay-out for the base-
ball field and soccer field at McCowin Park has been done.
Other matters which the Engineer was asked to follow through on included: Make a
cost estimate for paving in front of the city building including a siphon for the
irrigation ditch; make a cost estimate for paving part of the swimming pool parking
lot; provide a plan for storm drainage on Midway Avenue along side of McCowin Park;
complete the sewer hook-up fee evaluation.
Parks and Recreation - Councilman Anderson reported that plans axe being made
by the L. D. S. Ammon 5th Ward to have a picnic in McCowin Park for the people
of Sugar City on Tuesday, July 20, and it was decided that .the Sugar City guests
w_ould be invited to swim at the pool at no charge. that evening. A review of infor-
mation regarding replacing the tennis court lights was presented by Councilman
Anderson, and Mayor Wehmann requested that a firm cost estimate for this work
be obtained before authorizing the work to be done. Councilman Lee agreed to con-
tact Capitol Glass Company about a possible reimbursement to the City on the
plastic shields for the tennis court lights that proved to be unsatisfactory.
During further discussion by the Mayor and Council, it was stated that the School
Board would like to meet regarding the library situation as soon as possible so that
a decision can be made in time to plan for the coming school year. Also, with refer-
ence to moneys in the Revenue Sharing fund, it was noted that the amount just re-
ceived is to be invested in a Time Certificate of Deposit for 92 days and that uses
for the funds available during this year will be studied and determined August.
Claims were approved for payment. Councilman Swensen moved to adjourn at
9:50 P. M., seconded by Councilwoman Dille. Meeting adjourned.

Minutes of the regular meeting of the Mayor and City Council:
The meeting was called to order at 7: 35

Others present during the meeting were: Gary Davidson, Vilate George, Valerie
Beardall, County Engineer Robert Gray, Mike Townsley, Vern Fowler, Dean Crofts,
and George Peterson.
Gary pavidson, Chairman of Ammon Day, 1976. introduced Vilate George and
Valerie Beardall as members of the Co-Chaj.rmen committee, then proceeded
to outline the celebration events as planned, which will include a ribbon cutting for
the newly completed 17th Street reconstruction project, a youth parade, skits, games,
contests, midway events, dancing, etc.
As a representative of the L. D. S. Ammon 5th Ward, Gary :Davidson expressed
appreciation to the City officials for the use of the McCowin Park facilities during
the picnic for the Sugar City people, which was held on Saturday, July 17, instead
of July 20 as mentioned in the last meeting.
County Engineer Robert Gray and H-K Contractors foreman Vern Fowler answered
- questions and reviewed the progress of the 17th Street reconstruction project.
Mayor Wehmanp. requested that temporary railings be put on the Sand Creek bridge,
and it was noted that the paving and concrete work are nearly finished, while clean-
up, striping, and additional signing still needing to be done are expected to be com-
pleted during the next week. The new street lights still need to be installed by the
power company also. Items mentioned which need special attention by the contractor

are leveling the piles of dirt which were dumped on the north side of the street and
-solving the driveway problem on the Cook property on the south side of the street,
both just east of Sand Creek. Regarding the size of additional signs which the City
officials felt are needed, it was suggested that the City Maintenance Supervisor go
into the County Engineer's office to get information.
Considerable discussion with Dean Crofts and associate of Alpine Development
Company regarding a request to have the Mayor sign an acceptance of the improve-
ments in the Barbara Jean Estates subdivision resulted in the following motion:
Councilman Lee moved to authorize the Mayor to sign Federal Housing Administra-
tion form D-I after the City Attorney has come up with a letter of agreement which
will as sure that the City is protected relative to corrective action required in the - I
Barbara Jean Estates. The motion was seconded by Councilman Swensen; voting
- was all in favor; motion carried. It was felt that the necessary letter of agree-
ment could be prepared at the City Attorney's office the following morning.
COMMITTEE REPOR TS
Mayor: With reference to arranging with the Corps of Engineers to have a tour
of the Ririe Dam, Mayor Wehmann pointed out that the officials of the City of
Idaho Falls and the Bonneville Council of Governments are also interested in this,
and County Engineer Robert Gray is to present the necessary request. Mayor
Wehmann reported that the Lions are working on the wiring for the McCowin Park
shelter.
Police and Fire Department - Councilwoman Dille reviewed information received
fr0m Mr. Hayes and Karl Goble of the State Rating Bureau, noting that a survey
on the fire rating was completed last November which indi cated that the City
remains Class 7 for insurance purposes, but .this could be changed to Class 6 if the
rating could be brought down 145 points. Copies of recommendations for corrections
which can be made for this purpose were distributed to the Council members for
study so the matter can be reviewed again at the next meeting.
Regarding livestock animals being kept on several residential lots at the west end
of Rawson Street, it was determined from lot size information presented by I
Councilwoman Dille that all of the property owners on the south side of the street
there are in violation of the zoning ordinance and reasonable health standards.
Consequently, the Health Department will be contacted about writing letters to the
residents under discussion, and also the people involved will be invited to meet
with the City Council about the problem.
Mayor Wehmann and Councilwoman.Dille re:ported that undesirable activities are
going on in Lions Park during the night, and the other Council members agreed
that action needs to be taken. Mrs. Dille was authorized to work with the City
Attorney to prepare an ordinance for closing of the parks during certain hours.
It was also felt that another street light in the area would be helpful, so Council-
man Swensen moved that the City contact Utah Power &: Light Company relative
to the installation of a 20, 000 lumen street light on the northeast corner of the
Curlew and Salmon Street intersection, to be installed as soon as possible. The
motion was seconded by Councilwoman Dille; voting was all in favor; motion carried.
Public Works - Councilman Lee reviewed bids received from Mountain States Fence
Co., Salt Lake City, ($4825.00), Anderson Lumber Co., Idaho Falls, ($4568) and
Haddon's Fencing, Blackfoot, ($4347) for a fence (9 gauge) around Well No.6, and
moved to accept the bid of Haddon Fencing of Blackfoot .to do the job in accordance
with plans as drawn up by the City Engineer for the bid price of $4347. ~he motion
was seconded by Councilman Swensen; vot ing was all in favor; motion carried. I
Councilman Swensen moved that the completion date for the fence around Well No. 6
be on or before September 15,1976; seconded by Councilman Lee; voting was all in .
favor; motion carried.
According to Councilman Lee, one bid was received on the sidewalk, curb, and
gutter repairs connected with City waterline work, and he moved to accept the
bid of Burton Concrete Company to replace specified broken sidewalk, curb and
gutter over waterlines at the bid price of $6.-50 per lineal foot for curb and gutter,
$6. 50 per lineal. foot for 5-foot sidewalk, and $5.40 per lineal foot for 4-foot side-
walk, and that this be completed on or before September 15, 1976. The motion was
seconded by Councilman Swensen; voting all in favor; motion carried.

Reference was made to a bill from H-K Contractors for re-locating a ditch along
17th Street on 'the McCowin property, and Engineer Benton explained that this should
be returned with instructions to present it to -Bonneville County as a change order on
the 17th Street Project. In response to a question by Councilman Lee regarding
the weeds and piles of dirt arount Well #6, Maintenance Supervisor LaVern Williams
indicated that this had resulted from trying to make a road for the new storage
building located nearby. It was noted that bids have been received for some items
of equipment which are no longer in use by the City, and Councilman Swensen moved
to accept the bid of $75 from Reuben Waters on the Wisconsin Gas Pump, and to
accept the bid of $25 from Rodney Ragan on the Bantam rotary lawn mower pre-
viously declared surplus. The motion was seconded by Councilman Lee; voting was
all in favor; motion carried.
Bonneville Council of Governments - Councilman Swensen reported that BCOG had
approved Bonneville County entering into the Eastern Idaho Economic Development
District (EIEDD)at the meeting on July 14. Regarding the responsibility of the
larger city to approve plats of any subdivisions where jurisdiction overlaps with
a smaller city under the new land use law, Mayor Wehmann expressed a desire
to have the City of Idaho Falls take the lead when this situation occurs so that it
will give the City of Ammon an opportunity to see what that City is doing.
City Attorney - It was noted by Attorney Smith that he had not been able to make
contact with Rasmussen Realty about the sewer connection at 1890 Eagle, as
authorized by Councilman Lee, but will do so and make sure who is responsible
for the property before a complaint is filed in the court.
City Engineer - The $/:orm drainage on Midway along McCowin Park was discussed.
Engineer Benton explained that the present system which allows the storm water
to pond behind the homes on the block was drawn up by his firm and approved by
the City while Donald Ellsworth was City Engineer. He pointed out that a regular
French drain would not be adequate to handle the amount of water that is involved.
Mayor Wehmann suggested that, since the west side of the street is not paved, it
could be dug up to install a long perforated pipe which would serve as an elongated
French drain. Engineer Benton was instructed to check into the matter further
and come up with a definite plan and cost estimate. There was no comment from
the Mayor and Council to Engineer Benton's suggestion to create a Local Improve-
ment Storm Sewer District to install a drainage system which would drain into
the storm sewer now in on 17th Street.
Engineer Benton reported that, at $4.40 per square yard, it would cost approximately
$10, 692 to pave a portion of the swimming -pool-tennis court parking lot. A cost
estimate for paving in front of the City Building is to be ready by August 4, 1976, along
with the information on the sewer hook-up ,fee evaluation, and a written recommenda-
tion about the culvert at Meadow Lane and Molen Street.
According to Engineer Benton, the inspection report of the sewer project concrete
defects has been prepared and will be presented to Mayor Wehmann as soon as it
has been confirmed with Engineer Robert Butler.
Regarding the failure of the 70-horsepower booster pump at Well #6, Engineer
Benton reported that the water storage tank was pumped down several days ago,
and it was found that the float control that was supposed to turn off the pump was
lodged in sand so it was impossible for the pump to turn off which may have caused
the pump to fail. Consequently the City officials need to be aware that the con-
tractor, Hartwell Excavating Co., (now H-K Contractors), might not be liable for
the repair of the pump since it was operated under those conditions, and that any
problems which develop in the deep-water pump might also be bec-ause of the sand.
It was the feeling of the Mayor and Council that the contractor should be asked to go
ahead and get the pump repaired, with the City people witnessing the work so that
a determination can be made as to whether the contractor or the City is responsible.
The obs'e.rvation was made that the City officials are not prejudicing themselves by
authorizing the project contractor to go ahead and make the repairs if the only other
choice is to have the work done by a private contractor. Engineer Benton recommended
that the tank be drained down again, then have someone put on clean sterile boots
to go in and raise the float to a higher level so the pump can be used after being
repaired until a time when there is not so much demand for water, at which time
the sand can be cleaned out of the tank by hand.
Fiscal Operations - Councilman Swensen presented a draft of a. proposed billing
C,.oupon book for the Mayor and Council members to study and consider at a future

meeting.
Planning and Zoning Commission - According to Councilwoman Dille, the Planning
and Zoning Commission members would like to have some extra copies of the
Zoning section of the City Code Book, and the clerk was asked to see if there are
any of these available. Regarding a request for a variance which the Planning
and Zoning Commission had reviewed, Councilwoman Dille reported that the
Commission recommended granting the variance to Von Dee Bowen, 1790 Avocet
Drive, which would allow him a variance of 5-1/2 feet on the required 15 foot
side yard so that he can build a garage-storage shed to 9-1/2 feet of the property
line. It was explained that Mr. Bowen's property is at the corner of Avocet and
Sawtooth, and that Sawtooth Street is dedicated to be a 60 -foot street but is only I
paved to 32 feet at that location, so there will actually be 19-1/2 feet from the
existing sidewalk to the proposed building; also Mr. Bowen has obtained the
signatures of his immediate neighbors indicating no objection. Councilwoman
Dille moved to grant the requested variance; the motion was seconded by Council-
man Lee; voting was all in favor; motion carried.
In response to questions asked by the Hanning and Zoning Commission through
Councilwoman Dille regarding sewer in the Utterbeck Addition and cul-de-sacs
on the deadend streets of Wanda Street, Circle S Drive, and Southwick Lane,
Engineer Benton noted that there is no sewer at the mentioned loc-ation because
it is not within 200 feet of the main line and was not in existence when the sewer
project was planned, and that Mr. Utterbeck had agreed to put in a turn-around
at the end of Wanda Street as shown on the final plat of the Utterbeck Addition.
Councilman Swensen agreed to contact Horace Smith about obtainin temporary
use of land for cuI-de -sacs on the other two streets.
Parks and Recreation - It was recommended that individuals be allowed a
single session of free swimming at the pool on Ammon Day, Saturday, August 7,
during the two afternoon sessions, with a stamping system to be used to be sure
the same people do not get into both sessions. Comments were made about
management ,problems at the pool since life guards have been observed at times
being outside the pool area when on duty.

City Clerk - Copies of the Financial Report for the first six months of the year
were distributed to the Mayor and Council for study and review at the next meeting.
It was noted that revenue from the business licenses so far this year is normal.
Regarding the charcoal grills for the park which were mentioned at the last
meeting, the Clerk reported that these hav~ been ordered but not delivered yet.
The list of delinquent accounts was reviewed, and Councilman Lee moved to request
the Attorney to proceed with collection through the Small Claims Court for any bill
that is three months or more overdue. Inasmuch as the motion died for lack of a
second, instructions wer.e given to shut off the water for those who are delinquent
who do not pay as promised by July 26.
New Business - In response to an inquiry by Mayor Wehmann regarding the feeling
of the Council as to whether City employee Danny Hoyle should be kept on by the
City considering that his driver's license has been taken away due to his having
received a citation for wreckless driving, it was expressed that an employee with
this problem would not be very useful to the City.
Mayor Wehmann presented the Council members with a copy of a job description
for a City Superintendent (Public Works DirectDr) to be studied for taking action
at the next meeting.
Old Business - Councilman Swensen reported that he did not yet have a cost on
rods for cleaning out ditch culverts.

seconded by Councilman Lee. The meeting was adjourned at 11:55 P. M.
