The Mayor proposed that discussion on the budget continue following the
Construction Meeting on February 25.' Also, he requested Engineer Bentm
to be prepared to discuss sewer and water rates and whether or not present
rate is actually covering cost. Mr. Benton was asked to estimate the number
of man hours necessary to operate the system. At the meeting following the
Construction Meeting, the Mayor would also like to review and set up personnel
policies.
Councilman Anderson advised that he had incteased the propo sad budget figures
for Parks & Recreation in the amount of $2625--$1325 for mower payment and
$1300 miscellaneous. Councilwoman Dille wanted her fi~ures increased $500
for the fire department.

Discussion was held on newsletters. Each Councilperson was asked their opinion.
Mayor Wehmann recommended that Councilman Swensen prepare his budget
figures on the basis of six newsletter's per year.
Councilman Swensen called attention to information from AIC that legislation is
still pending and encouraged increased support for House Bill 420.
Engineer Benton called attention to a recent news release concerning the removal
of the railroad line East of Ammon and wondered if the City had any interest.
Claims were approved for payment prior to the beginning of the meeting.
Councilman Lee moved that the meeting adjourn at 11:10 P. M. Councilman Swensen
. seconded the motion.

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7:40 P. M. by Mayor George Wehmann with
the following City' Officials present:

Others present during the meeting were LaDean Lee, John Homer, Phil Anderson,
Vern Fowler, and Earl Foster.
After the pledge of allegiance to the flag, the prayer was offered by Councilwoman
Dille. The minutes of the meeting of February 18', 1976, were approved as typed.
John Homer of the Homer-Koster Company met with the Council to review the
city's insurance coverage under the present pdlicy written by the Home Insurance
Company, which expires on April 7. It was felt that the Council Fiscal Operations I
Committee should study this matte'r and make a recommendation at the next
meeting.
Phil Anderson of 2005 Dove Drive was given time to present information concern-
ing a special meeting scheduled in the Idaho Falls Civic Auditorium on Saturday,
March 25, for the purpose of acquainting the public with a proposed amendment
to the U. S. Constitution, known as the Liberty Amendment. He encouraged the
city officials to attend this meeting 'which is ,'ponsored by the Freeman Institute.
Vern Fowler, of Hartwell Excavating Company (now H-K Contractors, Inc.), the
contractor for the recently completed Water and Sewer Project, answered

questions regarding the equipment at the sewer meter station. He explained
that his company does considerable business with the supplier of the device
(Waterworks Equipment Company), and he is confident that WECO will.stand
back of the equipment past the warranty date if its performance continues to
be a problem. Mr. Fowler agreed to have H-K Contractors provide the City
with a letter stating the warranty date on the sewer meter equipment and also on
the remainder of the project done under the contract.
In connection with the Water and Sewer Project, Engineer Benton noted that the
remainder of the grant funds have been received from EPA and the State Depart-
ment of Health, so final payment can be made to Hartwell Excavating Company.
Payment requests in the amounts of $107, 659.28 and $25,873.95, totalling
$133, 533.23, were presented for approval of the Council. Councilman Lee
moved to authorize Mayor Wehmann to sign the payment requests to make the
final payment to Hartwell Excavating Company on the Water and Sewer Project
contract as submitted by the City Engineer. The motion was seconded by
Councilman Anderson and carried by a unanimous voice vote.
The Council also indicated approval to pay the Water and Sewer Project Engineers,
David E. Benton & Associates and Forsgren, Perkins & Associates, for their
services in finishing up the project in the amount of $5, 567.85, which closes out
the funds in the project .account.
Earl Foster, of H-K Contractors, Inc., notified the City that the starting date
of the work on the 17th Street Project has been set back one week because of
cold weather.
COMMITTEE REPORTS
Police and Fire Department: Councilwoman Dille announced that there will be a
special training session for the city maintenance employees on operating the
fire trucks at 8:30 A. M. Monday, March 8, with Roger Terril of the Volunteer
Fire Department to be the instructor. It was noted that the insurance coverage
restricts the driving of the city fire truck to those 21 years of age or older and
that drivers of the district fire truck must be at least 25 years old. Mrs. Dille
also informed the Council that city officials are invited to a meeting on bicycle
safety at the Little Theatre in the Idaho Falls High School at 7:30 P. M. Wednesday,
March 10. She referred to an invitation to the Governor's Conference on Traffic
Safety for members of the Idaho Safety Traffic Commission, and pointed rot
that someone from the City Council should represent the City on thi5> commission
rather than the Sheriff of Bonneville County as has been done for the past few years.
The Council approved the appointment of Councilwoman Dille on the Idaho Safety
Traffic Commission, and authorized her to attend the conference in Boise later
in the month if funds are available.
Councilwoman Dille reported that the County Commissioners have asked for a
letter stating the city1s intention to cooperate with the County on the contract
for small animal coptrol, and the Clerk was instructed to prepare such a letter.
A suggestion from the Animal Control Officer that the City add wording to the
City Code relative to dogs which would cover emergency situations requiring
use of the tranquilizer gun or killing dogs suspected of having rabies was placed
before the Council for consideration by Councilwoman Dille. The matter was
referred to the City AttoJ:ney to advise the Council on whether or not action is
needed at the next meeting.
Councilwoman Dille presented a bail bond schedule for citations issued for
violation of the dog ordinance, as recommended by the committee on law
enforcement, as follows:

Councilwoman Dille moved to adopt the schedule as outlined. The motion was
seconded by Councilman Lee. Attorney Smith advised that setting bail bond fees

is a function of. the Court. Councilwoman Dille moved to amend the motion to
the effect that the City suggest the fee schedule as outlined to the magistrate
court. The motion was seconded by Councilman Lee and a voice vote indicated
all in favor; motion carried. Attorney Smith is to contact the judges of the
court regarding this matter. Advice was given by Attorney Smith that the
citation forms being used at present for violations of the animal control ordinance
are appropriate for directing the violator to the City Clerk to post bond.

Public Works: Councilman Lee reviewed the list of property owners who have
not yet had their sewer connections made. He noted that the property at 1890
Eagle Drive is .being sold, and the transaction includes arrangements to have I
the sewer line installed. Attorney Smith was asked to follow through with
citing Fred Blair, who owns the properties at 1900 Curlew -Drive and 2045 Dove
Drive, into court since he has failed to respond to any of the notices which have
been sent to him. Also, the attorney is to write a letter to Verne Parrish indi-
cating that the City is agreeable to his written proposal to have the sewer con-
nection work done in March or April at 1850 Avocet Dr.
Mayor: Mayor Wehmann mentioned that he will be asking the office staff to
prepare an information sheet to acquaint new residents of the City of the charges
for city services, garbage regulations, dog laws, etc. He announced that he will
be going to Boise on March 12, and is planning to make several contacts on city-
related matters while there.
According to Mayor Wehmann, notificatim dated February 19, 1976, has been
received from the Census Bureau, reporting an official population of 3, 630 for
Ammon. This information has been sent to the Idaho Secretary of State to be
used when calculating revenue apportionments which are based on population,
and certification of this figure has been made to the Office of Revenue Sharing.
The appointment of Elmoyne Bailey, 2810 Salmon Street, to fill a two-year
term on the Planning and Zoning Commission was announced by Mayor Wehmann.

A request was made by Mayor Wehmann that the Council Committees look
around and submit information on work that needs to be done in the City.
A pay schedule for city emplOfees as recommended by Mayor Wehmann was
reviewed. See insert. Councilwoman Dille moved to accept the salary schedule
to be effective as of March I, 1976. The motion was seconded by Councilman Lee;
a voice vote was all in favor; motion carried.
Mayor Wehmann presented the final proposed budget to the Council for considera-
tion. He explained that the estimated revenue includes an increase in the water
rates of $1. 00 per month inside the City and $2.00 per month outside the City,
due to the additional cost of power for pumping the water, but official action on
this should not be taken until after the budget is approved. Mayor Wehmann also
mentioned that it was his understanding that the City Attorney would submit bills
for extra efforts in behalf of the City above that normally covered by the agreed
retainer fee. Councilman Lee moved to accept the proposed budget as presented
and to instruct the Attorney to make the appropriate publications and notifications
for a public hearing on March 17, 1976, at 7:30 P. M. The motion was seconded
by Councilwoman Dille; a voice vote indicated that all council members were in
favor; motion carried.
City Engineer: Engineer Benton reported that a new zoning map for the City has I
been prepared. He mentioned that he had informed a property owner in the
Original Townsite, who inquired about the requirements for street paving when
developing on the streets that have been opened up which were formerly intended
for alleys, that the new Council has not set. a policy, and recommended that the
matter be taken to the Planning and Zming Commission to make a recommendation
to the Council. Likewise, a resident on Sabin Drive had been advised that the
City is not involved in the matter of taking that area out of the Progressive Irri -
gation District. Engineer Benton noted, however, that such an action would be an
advantage to the City when Midway Avenue is extended north to 17th Street.

Planning and Zoning Commission: A Public Hearing on re-zoning property on
the north side of 17th Street relative to a proposal to locate a rest home there
is scheduled for Tuesday, March 16, 7:30 P. M., with the hearing on this subject
to be held before the City Council immediately following at 8:00 P. M. The City
Officials have not heard of any opposition to this request.
City Clerk:. As suggested by Mayor Wehmann, City Clerk Deon Hemingway informed
the Council that the policy of making a $5. 00 charge when water is shut off due to
delinquent accounts will be replaced with the procedure provided for in the City
Code of charging a.$2. 00 fee whenever a service trip is made for the purpose of
iisconnecting for non-payment, even though ap. actual disconnect may not occur.
(Section 4-3-33) Notices to this effect will be sent with the delinquent bills. The
Clerk also provided Attorney Smith with a list of names and last-known addresses
of former residents who have moved during the past several months leaving an
unpaid balance on their accounts, with the intent that the Attorney will file for
colle chon in the small claims court.
The matter of establishing a policy for mileage, room, and meal expenses when
officials travel on city business was discussed briefly. Councilman Anderson
reported that no definite policy had been set in the past. Mayor Wehmann indicated
that a study will be made and a standard rate established.
Councilman Lee moved to adjourn at 10: 50 P. M. ; seconded by Councilwoman Dille.
Claims were approved for payment prior to the opening of the meeting.
