Anderson explained that Protective Covenants. are a private matter and cannot
allow what the City does not allow; also that livestock animals are prohibited
in Mr. Ragan's nelghborhood under the Animal Overlay regulation.
Mr. Roland Romrell appeared to request the help of the City in solving the problem
of not being able to get sufficient water through the irrigation ditch culverts
along the school and church properties to take care of his needs as a ditch
user. Attorney Anderson explained that the City does not own or distribute the
water and has no stand to require the property owners to unplug the ditch, so this
would take action of the ditch users. According to Mr. Romrell, a former City
Council authorized the school and church to install the culverts, and he felt that
the City should be involved in getting the problem resolved. In response to his
request that consideration be given to setting up a meeting to be chairmaned by
the City with the people involved being invited, it was decided that this could be
done and should be under the direction of Councilman Swensen who has been in. charge
of maters pertaining to the irrigation ditches.
Mr. Romrell remarked on the efficiency of the Volunteer Fire Department,
noting that usually someone has the fire machines out of the building before the
siren stops. He suggested that something be put into the budget to compensate
the firemen in some way.
Claims were approved for payment.

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7: 35 P. M.

Others present were Glenn Smith, Allan Hemingway, and Mark Zahner of American
Legion East Bonneville Post #139, and Robert Gray and WiUiam Manwill of the
Bonneville County Engineer Office.
Prayer was offered by Councilman Hirschi. The minutes of the meeting of August
20, 1975, were approved as typed.
Glenn Smith, representing the local American Legion Pos,t,expressed appreciation
for the use of the City tennis courts for a dance the preceding Saturday, and asked
to be on record for requesting the use of the tennis courts for two (2) dances next
year--one each in June and July. Mr. Smith and Mr. Hemingway H1.ade comment
on the good conduct of the young people who attended the dance, and indicated that
the law enforcement officers told them that there were no problems observed.
Regarding dances for next year, Mayor Turnbow asked for time to discuss this,
since a proposal has been made to the County to use a location at Sandy Downs for
outdoor dances in the future.
Mayor T;urnbow explained that County Engineer Robert Gray and Mr. Manwill
were preirent to discuss a proposal to set up an agreement with Bonneville County
to provide the service of Ammon's street sweeper in county subdivisions that
have curb and gutter. It was noted that copies of the subdivision plats had,been
sent to the Councilmen for study, and that there are approximately 110 21 miles of
such streets, some: of which would need to be swept two to three times per month
while others would 'only be once a month, or less. In response to an i!lquiry by
Mr. Gray regarding the anticipated cost, Mayor Turnbow quoted a figure of $23,00
per hour which he indicated would cover the use of the sweeper, the labor of the

operator, gas, insurance, etc. Mr. Gray said that he would draw up a schecule
on the proposal to present to the County Commissioners, and should be able to
notify the City within a week if a written agreement is to be entered into.
According to Mayor Turnbow and County Engineer Robert Gray, there is a need
to adopt a resolution to amend the 17th Street Cooperative Agreement entered into
on July 14, 1975, to designate Bonneville County to provide the engineering on the
project. A motion to pass this resolution was made by Councilman Swensen and
seconded by Councilman Anderson. Voting was Swensen, yes; Anderson, yes;
Cheney, yes; Hirschi, yes;.motion carried.
With reference to the minute s of the previous meeting regarding finishing the
north end of Avocet Drive and Falcon Drive, it was decided that it will be best
to have this work done by the County with the City paying for the materials.
Mr. Gray agreed to make an estimate and get the information to Engineer
Benton for approval before going ahead.

Mayor Turnbow reported that the streets that have been seal-coated wiH be
swept by the contractor.

warrant on L.1. D. #5. The motion to adopt the resolution was made by Councilman
Hirschi, seconded by Councilman Swensen; voting all in favor;motion carried. )
It was noted that a City El~ction is coming up on November 4, 1975, with the
polling place to be at the City Hall. A Mayor and two Councilmen are to be elected,
and Declarations of Candidacy are required to be filed between September 28 and
October 7.
Action on the parking-in-the street regulations was again postpon_ed for further
study by the City Engineer and Attorney.
The matter of passing an ordinance to increase the salaries of City Elected
Officials was brought up for discussion. Mayor Turnbow explained that he had I
made a proposal by letter at the last. meeting: of $150 per month for the Mayor
and $75 per month for Councilmen to be considered due to the time that is in-
volved in meetings, conventions, etc. Comments were made by the Councilmen,
recognizing that the Mayor's reasoning was sound, and opinions were also ex-
pressed that perhaps this is not a good time for an increase because of the state
of the economy, and that being a City official should be for the service that can
be given rather than for the money received. Councilman Anderson moved to
increase the salary for Mayor to $200 per month and the City Councilmen salaries
to $100 per month. The motion died for lack of a second. Later Councilman
Anderson moved that the salaries be increased a.s proposed by the Mayor; there
was no second for this motion. No further action was taken.
In response to an inquiry by Attorney Smith in behalf of a "reputable builder",
the Mayor and Council expressed favorable feelings to locating a multi,..unit
housing development north of 17th Street just east of Sand Creek.
Regarding the special census count, Mayor Turnbow reported that it will be 60 to
120 days before this can get started.
Mayor Turnbow reported that he had accompanied Sewer and Water Project
Engineer Douglas Jensen and a representative of Hartwell Excavating Co. I
(along with Councilman Hirschi, Engineer Robert Butler, etc.) on a final-
inspection of the sewer system and waterline improvements portion of the
contract. All roads, manholes, lift stations, flume, etc., were checked, along
with specific sidewalk, curb, and gutter problems. A copy of the check list
with comments which resulted from this inspection showing whether the qamage
was assessed as the responsibility of the project contractor or the private con-
tractors is on file in the City Office. Mayor Turnbow recommended that the
sewer system and waterline improvements be accepted by the City, noting that
the contractor will be under a one -year warranty during which time it is felt
that most problems would show up. Councilman Cheney moved to accept the
sewer system and waterline improvements from Hartwell Excavating Company

as of September 8, 1975, with the punch list for items that have been marked to be
repaired by Hartwells as the general contractor to be completed. The motion was
seconded by Councilman Swensen; voting was: Cheney, yes: Swensen, yes; Hirschi, yes;
Anderson, yes; motion carried.
According to Mayor Turnbovv, Hartwells will furnish the oil and the labor to finish
seal-coating the streets in Hillview and Hillsdale Addition~ if the City pays for
the chips, with the cost to the City being approximately $2500. under these arrange-
ments. This must be- done in the next few weeks, and the Council members expressed
approval.
The need was expressed by Mayor Turnbow to have the people who hook on to city
water or sewer outside the city limits sign a contract. He proposed that agree-
ments similar to those used by the City of Idaho Falls be put into effect. The
Council members approved this suggestion, and it was decided that a recommendation
from the City Attorney on the wording of the contracts should be requested.
C<;lUncilman Cheney mentioned that nothing has been done about cleaning up the rocks
on the new section of McCowin Park, and Councilman Swensen indicated that he
knows where to get the use of a mechanical rock picker.
With reference to a letter which was sent to officials of School District No. 93
concerning lack of cooperation in following the watering regulations for sprinkling
at the schools in Ammon, Councilman Anderson reported that he had been informed
by a member of the school board that the School District people claim they have
not been advised of the time to sprinkle. He also mentioned that the school officials
are concer:p.ed about the rate being charged for sewer service for the schools.
Information on these matters will be forwarded to the Superintendent of School
District No. 93.
Councilman Swensen reported that the maps are being redone by the Federal
Insurance Administration so that the City of Ammon will be deleted and Flood
Insurance will no longer be mandatory.
The Councilmen. were urged by Mayor Turnbow to attend a meeting to be conducted
by the Association of Idaho Cities at St. Anthony on October 23, 1975. Councilmen
Swensen and Cheney indicated that they would probably be able to go.
Mayor Turnbow explained that there will be one new employee starting who will
be on the CETA II program until next June.
Claims were approved for payment.
