It was felt that the city employees using the new backhoe could take care of this within a few days. Councilman Anderson reported that the Chevrolet truck which was ordered would not be available for several weeks, so a quotation on a Dodge truck from Ells worth Brothers, Inc., has been accepted with deli.ve~y expected in the next two days. Reference was made to the minutes of the previous meeting regarding making ~ decision on whether or not to allow dances at the tennis courts this year in re sponse to an iRquiry made by the local American Legion Post. Considerable discussion by the Council concerning the problems involved, while at the same time recog- nizing the need to cooperate in providing opportunities for entertainent ~or the youth in the area, resulted in a motion being made by Councilman Cheney that three (3) dances be authorized for this year, one per month during June, July, and August, with one of these being reserved for Ammon Days if wanted, and the American Legion having first preference on the others OT all, with the sponsoring group to take care of all policing, parking, and any damages done. The motion was seconded by C0uncilman Anderson; voting was Cheney, yes; Anderson, yes; Hirschi, no; Swensen, yes; motion carried. I Mayor Turnbow recommended that the City offer its swimming pool facilities for the children and spouses activities of the -AIC Convention to be held in Idaho Falls in June, and requested suggestions for other suitable entertainment for the event. CITY OF AMMON May 7, 1975 I Minutes of the regular meeting of the Mayor and City Council: The meeting was called to order at 7:50 P. M. by Mayor Keith C. Turnbow, with the following City Officials present: Mayor Keith C. Turnbow Councilman Russell N. Swensen Councilman Brent Hirschi Councilman Gerald B. Cheney (Councilman Marvin J. Anderson excused - working) Clerk Deon Hemingway Engineer David E. Benton Others present during the meeting were Mr. and Mrs. Gary Butterworth and Mr. and Mrs. Thayle Monson. Prayer was offered by Councilman Cheney. Minutes of the meeting of April 21, 1975, were approved as typed. The citizens listed above were present to inquire about the h.ousing development which is proposed south of Eagle Drive. It was explained that the plat for this development, to be known as Holly Cove Park, has been approved by the Planning and Zoning Commission and the City Council, and that the lot widths met the I zoning requirements, the street widths meet specified standards, and that curb and gutter and probably sidewalk will be required in the Annexation Ag~eement, along with other requirements such as adequate drainage, turn-arounds on the ends of the streets, etc. The type of homes to be built is not regulated by the City Code except for a minimum size and a requirement to meet the Uniform Building Code in construction. Engineer Benton mentioned that the bridge on Eagle Drive is to be put at the level of the present curb and gutter whic~ will allow any drainage from the north to go on through. It was noted that the finandng arrangements for the project is not known by the City Officials at this time. The residents present are to be notified if and when any further hearings on this matter are scheduled. 115 Referring to a decision made concerning irrigation water rights in a previous meet- ing, Mayor Turnbow reported that the Progressive Irrigation District has reviewed the arrangements requested, and has asked that the matter be reconsidered. Con- sequently, the City Attorney has studied the legal aspects of removing the irrigation water rights from private property where the water is. no longer. available as well as from the city park properties, and advises that this can be done if the proper wording is used regarding a provision that the individuals can obtain the water rights back again if desired. Councilman Cheney moved to exclude all properties within certain areas of the City from the Progressive Irrigation District, and to authorize Attorney Anderson to draw up the official resolution including the legal descriptions. The motion was seconded by Councilman Swensen; voting was all in favor; motion carried. I Engineer Benton presented figures on the water and sewer rates for metered businesses in the cities of Idaho Falls and Ucon for the purpose of revising the rate for metered accounts in the City of Ammon. Considerable discussion and deliberation by the Council resulted in the following motion: Councilman Swensen moved that the water and sewer rates for any metered bnsiness within the City Limits be effective as follows: For water 25i per thousand gallons of water used, and for sewer 30i per thousand gallon of water used as indicated by the meter reading, with a minimum of $6.00 per month water charge and a minimum of $6.50 per month sewer charge; in order to conform with the rates of surrounding communities, namely Idaho Falls and Ucon. The motion was seconded by Councilman Hirschi; voting was Swensen, yes; Hirschi, yes; Cheney, yes; motion carried. o 00 l'- CO, ~ W According to Engineer Benton, the City employees are marking the sewer manholes and water main valves with paint so that their locations will show up on the aerial map to be made next week. Also he suggested that arrangements be made to have the City employees move the fence as needed for the 17th Street Project. I With reference to the policy established for pr.operty owners outside of the city where the main sewer trunk line has already been put in, it was confirmed for Engineer Benton that a sewer connection could be made for Ross McCowin on 17th Street east of Avocet Drive at his own expense without paying a hookup fee. A recommendation was made that, if Mr. McCowin desires to hook on to the city water system, he should pay for 130 feet of frontage at $6.00 per foot and then be obligated to pay for the other 130 feet of his frontage when it is sold for a building lot. Engineer Benton displayed drawings on the proposed development of the new park properties as they will be submitted to the Bureau of Outdoor Recreation with the application for matching funds for these projects. Mayor Turnbow requested that the City Clerk .be notified if the office copying machine is used for personal purposes after office hours,' and that payment is to be made for copying done for personal use. Announcement was made by Mayor Turnbow that the special highway funds as alloted by the recent session of the State Legislature have been received, and that the budget must be opened and provision made to spend this money. Councilman Swensen moved that the 1975 Budget be opened and the special highway funds in the amount of $5, 394. 92 received by the City be allocated to the Street Department for expenditur.es in repairing streets within the City. The motion was seconded by Councilman Cheney; voting was Swensen, yes; Cheney, yes; Hirschi, yes; motion carried. Authorization was ,given for the City Attorney to draw up the legal ordinance for this action and have it published. I Councilman Hirschi mentioned that Paul Macbeth of 2600 Salmon Street asked to have his letter concerning street and sidewalk problems brought to the attention. of the Council and put on record for action. Objection was expressed by Councilman Hirschi to a letter sent to Gary Johnson, 2020 Dove Drive, from the City Attorney at the request of Mayor Turnbow, which apparently sigled out Mr. Johnson for parking a vehicle in the street and on the sidewalk while many other residents do this without being sent notice of being in violation of the City Ordinance. It was noted that Mr. Johnson's vehicle is a large commercial truck (tractor} with a big trailer. Councilman Swensen mentioned that a decision on the parking situation had been delayed while the sewer and water project construction was going on, and it was suggested that action be taken in the near future on getting a plan made for one -way streets or whateyer is felt advisable to help solve the parking -In-the -street and on-the -sidewalks problem. J 1."1'6 The feeling of the Council was to immediately ask the law enforcement officers to start is suing citations consistently for all parking on the sidewalks and on the streets where posted for no parking. Councilman Cheney reported that ther is a need to have some gravel put in along front of 3275 Central Avenue where the sewer trench was dug, and that the property owner has requested this several times through the City Office but nothing has been done. Engineer Benton agreed to check this and have it taken care of. According to Councilman Cheney, he has not been able to get anyone to take the supervision of the City Knothole Baseball Program for this summer. Engineer Benton informedth_eS::ounci! that all of Idaho Falls has been taken out I of the Hood plain area wifh. regard to the requirement for obtaining flood insurance, and indicated that Ammon can probably be removed also if a request is sent to the C,?rps of Engineers. Councilman Swensen was asked to take care of this. In reporting on the activities of the Bonneville Council of ~vernments, Councilman Swensen mentioned that the BCOG employees are to get an 8.8% increase in salaries, but the amount as budgeted for the City of Ammon share of the expenses of that organization will cover this. Councilman Swensen reported that he had learned of government funds that are available on a matching basis for organizing and equipping fire departments, and felt that this was worth looking into for the purpose of obtaining needed supplies arid equipment such as radios, flashlights,gloves, boots, etc. He stated that ,he had already contacted Chief Poulter of the County Fire District about this. A compliment was expressed by Councilman Swensen for the work of the County Commissioners and Engineer on the road signing which is being done on the county roads. Regarding animal control, it w~s noted that Deputy Rustici would like to have the feeling of the Council about following through with the court procedures when citizens fail to appear on citations issued for violation of th~ Dog Leash Law. I The Council members indicated that the City should use the Court for enforce- ment of the law and, should be consistent. Mayor Turnbow reported that he had signed the contract with the County for participation in a special censu~ as authorized by the Council in a previous meeting. Claims were approved for payment."
