M.- by Mayor Keith C. the following City Officials present: Mayor Keith C. Turnbow Councilman Russell N. Swensen Councilman Marvin J. Anderson Turnbow, with Engineer David Benton Councilman Gerald B. Cheney Councilman Brent Hirschi Invocation was given by Mayor Turnbow. Mayor Turnbow advised the Council that the main purpose of the meeting was to review the bids submitted -on L.1. D. No. 6 which was opened at 4:00 p. m. on the 7th of October, 1974. (See insert.) City Engineer David E. Benton reviewed the two bids submitted by Kennaday Paving Co. and Bonneville Paving Co., item by item. The apparent low bidder was Kennaday Paving Co. with a base bid of $28, 825. 00. Bonneville Paving Co. bid was $33,203. 50. Taking the low bid of $28,825.00 plus -legal, administrative, and engineer- ing costs would bring total for L.1. D. #6 to $33,148. 74. This is planned for a 15- year repayment schedule. Councilman Cheney moved that we accept the figure of $5,898.00 as the City share of L.1. D. #6 as presented by City Engineer Benton. The motion was seconded by Councilman Hirschi; voting Cheney yes; Hirschi yes; Anderson yes; Swensen yes; motion carried. Councilman Hirschi moved that we accept the low bid of $28,825.00 for L.1. D. #6 as submitted by Kennaday Paving Co. and have City Engineer David E. Benton give said bidder notice. to proceed with the project. The motion was seconded by Councilman Cheney; voting was all in favor; motion carried. A discussion was held on the Farmers Home Administration boundaries and the effect upon developmental pattern of Bonneville County and cities of Idaho Falls, Ammon, Iona, and Ucon. Mayor Turnbow, Councilmen Cheney, Hirschi, and Swensen recommended moving area to green line on map; Councilman Anderson recommended line be moved to exclu de Ammon. CITY OF AMMON October 16, 1974 Minutes of the regl,llar meeting of the Mayor and City Council: The meeting was called to order following City Officials present: Mayor Keith C. Turnbow Councilman Russell N. Swensen Councilman Marvin J. Anderson Councilman Brent Hirschi Councilman Gerald B. Cheney at 7:40 P. M. by Mayor Keith C. Turnbow, with the Clerk Deon Hemingway Attcjrney W. Joe Anderson Engineer David E. Benton Others present during the meeting were Galen Hesson and Merrill Walker. Pray~r was offered by Councilman Hirschi. Mr. Galen Hesson of 3595 Georgia Lane requested consideration of a problem which has developed while preparing to hook on to the new sewer system, in that the line .. 8'4 that comes out of his house is lower than the main line in the street. Heexplained that the City Attorney advised him that he would probably have to put in a lift pump, and that a neighbor who is an attorney mentioned that some other cities have given a reduction in the monthly charge in situations like this. According to Mayor Turnbow, such a reduction in the rate would not be possible due to the revenue bond regulations, and .it was felt that Mr.. Hesson: would find that further digging would uncover a solution to the problem so that a lift pump may not be necessary. Regarding the sewer hookups on private property, suggestions -were made that' property owners and/or their contractors should be advised.to be very careful when digging if close to gas lines and water lines (and any damage to such lines would be their responsibility), and that making a record of damage to the sidewalk, curb and g utter, etc., should be a part of the inspection so the City can require I repair by the property owner if he has done his own sewer-line work (see resol- ution regar,ding required repair of hazardous sidewalks, etc., in minutes of August 7, 1974). It was also noted that streets that are not yet paved are dusty now because they need to be dry when the asphalt is laid, and that the project contractor is responsible for one year for any problems that develop in the street paving. Councilman Cheney indicated that he is working on arranging for the gym at the Ammon Junior High Scho()l for the City Basketb.all Program, and also on getting the plowing done on the park property north of McCowin Park. In response to an inquiry by Councilman Anderson, Engineer Benton explained that a portion of Samuel Street is ,not paved because 'the property owner to the south has never dedicated the area to the city for a street and the project contractor cannot do work outside the city right-of-way. Another pro~l~m which Councilman Anderson reported having been brought to his attention concerned dirt,an,d mud being tracked on to the new paving from Richard Wiemer's unimproved driveway at 3640 Samuel St., and the Attorney was asked to write to Mr. Wiemer about this situation. Mayor Turnbow requested that Engineer Benton check to see if the water rights have been released for the land in Peterson Park Division No. 3 so there will not have to be a ditch there and water running into the new city park property. I Councilman Swensen reported that the term of Yolande Waid on the Traffic Safety Commission has expired and moved that she be reappointed for a 3-year term. The motion was seconded by Councilman Cheney; voting was all in favor; motion carried. According to Councilman Swensen, Fire Chief Marvin McGary has asked about having a sort of open-house party for the volunteer fireman on Halloween at , the City Building since they plan to be around the building at that time. It was felt that there would not be much expense and this would be a satisfactory activity if the budget funds are adequate. Councilman Hirschi expressed concern that matters pertaining to the fire department are seldom referred to him even though that department is his responsibility as a City Council assignment. Mayor Turnbow reported that the Sheriff's office has hired a new animal control officer who has had experience with dogs and is doing a good job. He noted that it has been suggested that the form used by the County also be used for citations issued in Ammon to facilitate procedu.res, especially if the matter is talken to court. Councilman Swensen commented that there should be no problem with this arrange - I ment. Mayor Turnbow mentioned that a map showing proposals for the placement of trafic, signs in Ammon-is being prepared by the Sheriff's Department to take to the Ammon Traffic Safety Commission. Mr. Merrill Walker was present representing outside'-the-city water users, and advised the Council that Mr. Bill Quapp of the spe;cial study committee was not able to be in attendance. Councilman Swensen reviewed the recommendations of the study committee and read a proposed resolution prepared by Mr. Ouapp, with some suggestions for shortening the wor,ding while leaving the intent the same. He noted especially that the statement in the proposed resolution about when the portion of the charge which represents the Water and Sewer Improvement Project ammortization costs should go into effect was not discu'ssed by the study committee I o Xl l'- o:J W ~ I I 85 so there was no official recommendation on this. After considerable discussion by the Council and advice from the city I S legal counsel, it was decided that the policy recommended in the proposed resolution was sound and could be used as a bas-is for reviewing the outside-the-city water rates from time to time, and that the resulting rate should become effective immediately. Consequently, the follow- ing resolution was adopted by the motion of Councilman Hirschi which was seconded by Councilman Cheney, with the voting unanimous in favor: RESOLUTION RELA TING TO THE CHARGES FOR WATER USERS OUTSIDE THE CITY OF AMMON WHEREAS, it is the intention of this resolution to provide an equit- able formula to establish a rate schedule for outside -t he -city-water- users based on actual average monthly cost; AND WHEREAS,. it is intended that in addition to the average. monthly cost, that outside-the -city-water-users shall pay a prorated share for the Water System Improvement Project (WSIP) constructed in 1973-1975; AND WHEREAS, in addition to the above two categories of costs, the outside-the-city-water-users shall pay an incremental fraction above the basic monthly operations costs to .cover repair, replacement, maintenance costs, and operating expenses on the water system connecting such users to the city water system; AND WHEREAS, the City of Ammon owning and maintaining the water system incurs costs which are separable into categories such as operat- ing expenses and capital improvement, and the operating cost for cal- endar year 1973 was $4.64 per connection (maintenance and repair costs are included in these o.perating expenses, and are generally covered by the monthly charges to each water user--city residents $5.00, outside- the-city water users $5.50 at the pres~nt time\; AND WHEREAS, in the event that expenses in anyone year exceed the revenues from that year, the deficit al'ld general overhead is made up from the general fund of the City, established through the property tax on city residents, and since water users' outside the City of Ammon do not contribute to the general fund, a charge in excess of the annual per user operating cost is reasonable and equitable and this incremental cost is to be set at thirty per cent (30%) of the average monthly operat- ing cost for each :user, for the previous calendar year, as derived from the water water system cost reported in the annual audit; AND WHEREAS, based on estimates of the completed costs made by the City Engineer, and ammortizing the project costs over forty years, the per month/per user cost for the Water System Improvement Project is $4. 08; NOW THEREFORE BE IT RESOLVED that, based on the above consid- erations, the monthly charge for water users outside of the City of Ammon shall be determined on the basis of the following formula: Monthly Charge::: $4. 08 + (Monthly Operating Cost x 1. 3) rounded to the nearest 1/4 dollar The monthly operating cost shall be determined by the annual audit cost of the system divided by the average montily connections and divided by twelve (12). This annual cost shall exclude costs of ammortization of the WSIP of 1973-1975 even if reported as part of the total. FUR THER RESOLVED that such charges shall commence with the November 1, 1974, billing, which is for the month of October, 1974. Mayor Turnbow reported on the progress of situations regarding funds for the sewer and water project. Engineer Benton explained that there has been a stop put on issuing permits for making connections to the sewer system until a final inspection has been completed. There was a discussion by the Council pertaining to the 70-day policy for starting to charge the residents for sewer service. It was felt that this policy should be flexible at this time due to being held up on issuing permits. Councilman Swensen suggested that a grace period should be granted by cutting off the counting on the 70 days when weather prohibits any hookups then starting to count again when the weather breaks. At the request of Mayor Turnbow, the Council considered granting an easement to allow a sewer line to be installed on city property at Lions Park for the adjoining property. Councilman Swensen moved that an easement be granted for the owner 86 of the property adjacent to the north property line of Lions Park (2015 Curlew Dr., presently owned by Floyd Young) for the purpose of installing a sewer line subject to it being installed at the property owner I s expense and according to the City Engineer's specifications. The motion was seconded by Council- man Cheney; voting was aU in favor; motion carried. It was mentioned that there has been a request for a street light on Salmon Street between Curlew and Dove Drives, and Mayor Turnbow suggested that a survey should be made for the purpose of making recommendations for the placement of street lights. Engineer Benton felt that he could get a map from the power company to use in making decisions on this matter. Engineer Benton reviewed the prog-Tess of the 17th Street improvement project, I mentioning especially the curb turn-outs which may be placed on the north side of the street. He also noted that he has been informed by Derrald and Lawrence Ricks that the canal company has approved removal of the ditch on the propesed Holly Cove Park Addition. Regarding installation-of sewer lines on private property. Mayor Turnbow reported that it has been established that the code -does not require that this work be done by a licensed plumber. A question concerning the charging of a $10.00 fee for a sewer permit was brought UB and Attorney Anderson recom- mended that this charge be made since inspections and record keeping are being provided. A report was made by Mayor Turnbow on the status of the delinquencies on Local Improvement Districts No. 1 and 2 to the effect that all are paid except one on which payments are being made each month. According to Mayor Turnbow, action has not been. started on taking a -special census since it has been learned that a declaration of an estimated population is sufficient to get increases in revenues which are .based on population counts. A suggested salary of $510.00 per month was decided upon if an applicant is accepted for city maintenance training under the CETA program. Claims were approved for payment.
