The minutes of the meeting o 00 l'- o:J CI.:J ~ Prior to the opening of the meeting, time was give~ to Blaine GOdfrey of 3090 Sunnyside Road who ~ct~d as spokesman for the following citizens who were present: Wilmer Lee, Lester Nelson, Afton GOdfrey, Hazel Empey, Mrs. J.E. Bunch, Vera Lee, Marjorie Judy, Clifford JUdy, Carla Judy, Dan JUdy, and Jane Infanger (Lennis Tirrell came in later during the evening). Mr. Godfrey explained that the residents along Sunnyside Road near the west city limits were concerned about the intentions of the City with regard to the larger waterline which was planned in th€ present water system improvement proj1ect in that area. He indicated that the water pressure is very poor there. Engineer Benton explained that no decisions have been made to definitely cut out any part of the project, and the most pressing needs would certainly be taken Care pf. According to Mayor Turnbow, the new waterline will be put in on Sunnyside Road as planned. The first item of official business was a presentation by Rance Bare of Ellsworth Engineering on the preliminary plat of the proposed Hol1ycove Park Addition, to be located immediately south of Hillsda1e Division No. I 3 off of Eagle Drive, which has been recommended for approval by the Planning and Zoning Commission. The Council's feelings were requested before a final plat is drawn up. Mr. Bare reported that the Planning . Commission had indicated concern about the limited amount of access to the project, and noted that plans for the future show ultimate capabili- ties for four access areas. Mayor Turnbow inquired about the width of the access easement along the canal and Sand Creek, and requested that it be made clear that the City will have no obligation for any of the irrigation system in or around the project which is the responsibility of the ditch owner. He suggested that the developer have all water rights transferred off the property before any lots are sold. Matters pertain- ing to the sewer line and lift station were discussed, and Engineer Ben- ton suggested that the land owner to the south be approached about run- ning the sewer line through his property rather than putting in the lift station, which Mr. Bare said would be done. A question was asked about planning for a park, to which the reply was th~ the Planning and Zoning Commission had not mentioned this at all. A thorough discussion later in the meeting resulted in the following motion: Councilman Swensen moved that the Hollycove Park Addition Preliminary plat be approved with the conditions as outlined: that an access easement be allowed around the canal and Sand Creek, that the lift station be ,at the south perimeter of the property, that the west side of the project be fenced, and that I there be temporary culdesacs at the southerly end of each street. The motion was seconded by Councilman Cheney; voting Swensen, yes; Hirschi, yes; Anderson, no; Cheney, yes. Motion carried. It was noted that there was some disagreement expressed on width of streets, size of lots, and lack of parks. Two visitors, Paul Merrell and Kathy Braniff, inquired and were informed that there would be no action on the proposed Local Improvement District for sewer servic~ lines at this meeting, and all those concerned will be notified about the official assessment roll hearing. Mayor Turnbow com- mented that the matter is still under advisement with the City Attorney, and it now looks possible to have all assessment payments taken out of the monthly charges. 41P1'70 According to Engineer Benton, the terms of the Annexation Agreement for Peterson Park Division No. 3 have been determined to be satisfactory and the agreement has been drawn up for signature. Therefore, the Peterson Park Division No. 3 Annexation Ordinance was assigned No. 119 and read in full by Attorney Smith. Councilman Swensen moved to dLspense with the three readings on separate days of Ordinance #119 and have it placed on its third and final reading by title only. The motion was seconded by Councilman Cheney; voting was all in favor; motion carried. After the reading by title only, Councilman Cheney moved to pass Ordinance #119 on its third and final reading. The motion was seconded by Councilman Swen- sen; voting all in favor; motion carried. Publication of the Ordinance will be held up until the Annexation Agreement has been signed. I Attorney Smith presented a check from the Boise Cascade Corporation in the amount of $3,019.66 which is to be held in escrow for the future curb, gutter, and paving improvements for the four lots of the East Hills Addi- tion on Sunnyside Road. This is in lieu of the actual installation of these improvements as required by the curb-and-gutter policy for lots measuring less than 120 feet since it is felt advisable to wait to estab- lish a grade in that location at a time in the future when the remalnder of the street is to be improved. Regarding the water service for this small subdivision, it was confirmed with the Council that the intent is to treat the waterline as an existing line and use the ordinance policy of charging $1.00 per front foot as a water main charge. It was reported by Attorney Smith that the multilith sheets for the new City Code have been completed, and wi}l be copied as soon as the proof- reading is done. Announcement was made that matching funds for the purchase of property for a park in the Peterson Park area have been awarded from the Bureau of Outdoor Recreation, and a price of $30,000 has been discussed with Harold Loveland which would be in keeping with the BOR policy of not offering more than the appraised value. According to Mayor Turnbow, it may be I possible that the application for funds to oil the road at McCowin Park will be considered again in the near future. Items mentioned by Engineer Benton were that the county plans for the 17th Street improvements are moving slowly, the motor for the new pump at Well #5 should have been shipped on June 28, and there is nothing to report from the contractor on a date for getting a portion of the sewer system into operation. Mayor Turnbow asked that the council members be thinking about the rates to be charged for sewer and water service for churches and schools. Engineer Benton will look up the standard usage rates and make some recom- mendations. A matter referred to in the minutes of the Planning and Zoning Commission regarding zoning for property bordered by 17th Street and Ammon-Lincoln Road (commonly known as Casey's Corner) was discussed. Mayor Turnbow recommended that an attitude of cooperation be expressed in the develop- ment of this land for limited business purposes, and that a letter be drafted by himself and the City Engineer to Bish Jenkins who represents the present land owners. The zoning of this area is of concern to the City since it is adjacent to the City Limits and a request to be annexed would be likely. Motion to adopt resolution was made by Councilman Swensen; seconded by Councilman Cheney; voting all in favor; motion carried). Engineer Benton reported that the property owner (Vern Peterson) would like to develop the two west lots of Pony Acres as zoned for R-l which would allow several more building lots than originally platted. The feeling of the Council was that re-platting would not be necessary. --7/~ Councilm~n Cheney r~ised ~ question ~bout the 1974 Bonneville Council of Governments budget, ~nd Councilm~n Swensen mentioned that this budget had been brought before the City Council several months ago. Mayor Turn- bow pointed out that Councilm~n Swensen has the authority to represent the City when immediate decisions need to be made at BCOG meetings, but it would be well to suggest that matters should be discussed by the different City Councils whenever possible before BCOG action is taken. Since several of the City Officials plan to be out of town on the next regular meeting date, it was decided to postpone that meeting until 8:00 P.M. on Tuesday, July 23, 1974. Cheney was absent) Prior to the official opening of the meeting, Mayor Turnbow presented Park application forms to City Engineer Benton for completion to apply for funds from the Idaho State Parks and Recreation Dept. in regards to new park acquisition. A discussion followed in regards to parks develop- ment. Mr. Jim Poulsen of the State Parks Dept. will visit the City on August 5th or 6th for consultation; further details will be forthcoming ~s to time and place. Councilm~n Swensen was asked to work with Council- m~n Cheney on the McCowin Park development plans. Prayer was offered by Councilm~n Hirschi. 3, 1974, were approved as typed. Minutes of the meeting of July Attorney Anderson read Ordinance No. 120, an amendment to the zoning ordinance relative to changing the requirements for residential lot widths to 80 feet. Councilman Swensen moved that the 2nd and 3rd read- ings of Ordinance No. 120 be dispensed with and that it be placed on its 3rd and final reading by title only inasmuch as no protests were heard at the Planning and Zoning Commission hearing held July 16, 1974. The Imotion was seconded by Councilman Hirschi; voting was all in favor; motion carried. Attorney Anderson read Ordinance No. 120 by title only. Councilman Swensen moved that Ordinance No. 120 be passed; seconded by Councilman Hirschi; voting all in favor; motion carried. Engineer Benton and Attorney Anderson read and discussed information on the proposed Local Improvement District #6, which includes curb, gutter, waterline, sewer, and pavement as needed for streets in several areas of the City. A protest hearing was set for the regular meeting time on August 21, 1974. It was noted that Engineer Benton is gathering deeds for the property needed along 17th Street, and that County Engineer Robert Gray has the 17th Street improvement project in the design stage with some deeds still lacking.
