The following Resolution was read by Chairman Swensen:
A RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF
SERVICE CONNECTION CHARGES FOR COSTS INCURRED BY
THE CITY IN INSTALLING AND CONNECTING SERVICE LINES
FROM THE MAIN WATER LINE TO THE ADJOINING PROPERTY.
WHEREAS, the City of Ammon, Bonneville County, Idaho, has passed
an Ordinance providing for the establishment by Resolution of service connection
cnarges incurred by the City in .installing and connecting service lines from the
main water line to the adjoining property; and
WHEREAS, the rates previously established under Section 4-3-15 of
the City Ordinances of the City of Ammon, Bonneville County, Idaho, are no longer
in effect for applications for water service filed after the effective date of said
Ordinance, or serviece lines not yet installed prior to the effective date of said
Ordinance,
NOW, THEREFORE, the service connection charges for the various
sizes of lines installed by the City shall be as follows:
3/411 size $150.00
111 size $165.00
1-1/4" size $270.00
1-1/211 size $270.00
211 size $450.00
Larger than 2'1 size Actual cost to City including
meter where applicable
Service connection charges for service outside the City limits
shall be twice the charge for servece inside the City limits as shown.
Councilman Hirschi moved that the Council adopt said resolution; seconded by
Councilman Cheney; voting--Hirschi, yes; Cheney, yes; Anderson, yes;
Swensen, yes; motion carried; resolution adopted.
According to Attorney Smith, Mayor Turnbow asked to have the Code checked
regarding provisions for requiring a final inspection and issueing of a Certificate
of Occupancy before allowing persons to move into home s built in the City of Ammon,
which has been a problem. He noted that the requirements for this are covered in the
Uniform Building Code which the City has adopted as a standard for all building and
also in Sections 11-6-6 and 11-6-7 of the City Ordinances, with Sectionsll-26-7
and 1-3-1 providing for the penalty for violations. In answer to an inquiry from
Councilman Cheney about people moving into homes before the final inspection
due to hardship situations, Attorney Smith explained that the reason fro the Cer-
tificate of Occupancy inspection is to insure that all safety factors have been taken
care of. He stated that all contractors have been put on hard notice tlR t future
violations of this requirement will be prosecuted.
Councilman Cheney moved that the meeting adjourn at 8:40

Elmoyne Bailey, representing the citizens present, reviewed the feelings of the
group regarding unsightly appearance of yards and street areas due to junk cars,
scattered garbage and trash, and violation of the parking-in-the-street regulations.
She stated that these conditions not only reflect on the City and its Mayor and
Council, but also detract from the pride and value which are placed on homes I
and property by the majority of Ammon residents. Mayor Turnbow gave assur-
ance that the present City Code includes provisions making the mentioned prob- .
lems illegal, and the City Officials have also made a survey within the past ten
days to determine where offensive conditions exist. He and the Council indic-
ated that a plan of action will be worked out and put into effect as soon as
pos sible. Attorney Smith suggested that the Traffic Safety Commission should
be asked to make a study and recommendation on the parking-in-the-street
situation. Mayor Turnbow expressed appreciation to the group of residents
for bringing these matters to the attention of the city officials and asked for
their continued cooperation in turning in information when violation of city
laws are observed.
Since th, ere were no objections made known to the Planning and Zoning
Commission in response to the advertising of a public hearing on the intentions
to amend Section ll-5-24D(1)a of the Zoning Ordinance regarding off-street
parking requirements in said section to increase the necessary spaces per unit.
After Attorney Smith {!ad read Ordinance No. 117 in its entirety, Councilman
Anderson moved to dispense with the-,'reading 9f the ordinance on three separate
days; second by Councilman Hirchi; voting all in favor; motion carried.
Councilman Swensen read Ordinance No. 117 by title and moved that said ordinance
be adopted on its third and final reading by title only; seconded by Councilman
Cheney; voting--Swensen, yes; Hirschi, yes; Cheney, yes; Anderson, yes; I
motion carried, Ordinance No. 117 adopted.
With reference to a variance request submitted by Blaine Godfrey, 3090
Sunnyside Rd., it was noted that the Planning and Zoning Commis sion
has appointed a committee to check out the details before a decision
is !!lade, so a recommendation should be made before the next meeting.
_City Engineer David Benton reviewed the items which he sUggested should
be included in the Annexation Agreement to be signed by the developer of
the proposed Maiben Jones Addition. The Council members indicated
approval of the items listed, and were in favor of having the City Attorney
review the agreement to add to or make modifications and be sure that
the proper languag,e is used to protect the City and the developer. It
was noted that official action on the Annexation Ordinance for the
Maiben Jones Addition wilL,be subject to the proper execution of the
Annexation Agreement.
SUggestions for terms for the annexation agreement for Peterson Park I
Division 3 were also discussed by Engineer Benton, and he indicated
that this agreement should be ready for the next meeting.
Regarding an assessment in the name of Richard Jacobsen under L. 1. D.
#4 against a 3-foot strip of land, Ene:ineer Benton mentioned that the
land involved was dedicated to the .City as part of the street in the
Warren Bird Subdivision, so the assessment can be cancelled.

The subject of whether or not the policy about sewer connection charges set by
motion of the Council in the meeting of AUgust 21, 1972, is still appropriate due
to the increased growth rate was brought up by Mayor Turnbow. After a
lengthy discussion, it was decided that the policy as set should remain in
effect: "that no sewer connection charge (shall) be collected for those structures
and / or homes that will connect with the City Sewer System where and
approved sewag.e disposal system has been installed; all other connections
shall be charged an appropriate connection fee. II This was understood to
apply only to the areas within the City Limits where the sewer line was
planned under the project as contracted. Problems involved in serving the
Utterbeck Addition on Wanda Street and the Boyd Thompson property on Rose
Dale Lane with sewer line was discussed but no decision was made.
According to Engineer Benton, arrangements have been made with the developer
of the East Hills Addition to have the funds for the curbs and gutter improvements
there put in escrow, which must be dom.e before Certificates of Occupancy
will be issued for the homes being built.
In response to a request by Mayor Turnbow to have a record made of existing
srot-off valves for the water system, Engineer Benton sUggested that
knowing how to use a good electronic locater would be more effective,
especially since there would be considerable cost involved in making such a
record.
Mayor Turnbow Mentioned that he has bean talking with Les Corcoran,
Idaho Falls Fire Chief, about the future for fire coverage and fire stations,
and more discussions are planned. Councilman Swensen inquired about
what feelings have been heard from the citizens about the efforts made to
work with the County and the City of Idaho Falls in providing some of the
basic services needed by the City, and the other Councilmen reported
that there art comments indicating both approval and disapproval. The
matter of licensing bicycles was discussed, and Mayor Turnbow sUggested
that the system used J..:by the County could be followed.
Announcement was made that the Association of Idaho Cities Convention will
be in Boise on June 13, 14, and 15, this year.
Engineer Benton reported that the property owners along 17th Street from the
east city limits to the Ammon-Lincoln Road do lOt not want to be in the L.1. D.
District for urban improvements.
Councilman Sw<<nsen noted that he will need s'ome help in filling out the forms
to qualify the city area for flood plain insurance, which must be in before anyone
who wants the insurance can get it.
A proposal for mowing the park lawns has been submitted by Jared Murray,
according to Councilman Cheney, but last year's expenses will have to be
checked before consideration can be given to this. He reported that he has
contacted Mr. Merrill, who is associated with the owners c.f the property
Falcon Park, and was given the go-ahead for the City to use the area as a
park again this year. Also, Mrs. Kay Lemons, who had previously agreed
to supervise the summer knot hole baseball program, will not be able to do
so, and sUggestions are needed. Sixty pine trees have been ordered to be
shipped in the ne:;,:t few days for planting in McCowin park.

Councilman Anderson reported that a trailerhouse has been sitting
in the lot next to Steve Loveland on Rawson Street for the past three
days. He was asked to check this out since it is in violation of the
Zoning Ordinance.
A problem with the sump pump at the end of Eagle Drive as observed
by the nearby residents was reported by Councilman Hirschi.
Appropriate action will be taken to get the pump running. and
Councilman Swensen is to arrange for it to be cleaned out. An
inquiry from the Ammon 3rd Ward Elders Quorum (through Councilman
Hirschi) about watering parks again this year will be given consideration
at a later -date.

Mayor Turnbow explained that a zoning variance request submitted by Blaine
Godfrey of 3090 Sunnyside Road had been checked out by a committee of the
Planning and zoning Commission, with the recommendation given that the
request for going to a 4 or 5 foot sideyard in order to build a double garage I
be denied. Councilman Cheney moved that the Council take the recommend-,. i!'.. I e
