This ordinance replaces the previous ordinance vacating the existing plat and realigns the order of the adopted ordinances to allow the development to move forward. Recommendation: Staff recommends to adopt Ordinance #716 and waive the three readings based on the following staff report Ammon City Council Regular Meeting 05.09.2024 Page 1 of 4 Ammon City Council 05.16.2024Page 10 of 87 Compliance: This action is in compliance with Idaho Statute 50-1306A and City Ordinance Summary of Analysis: 1.City Council approved Ordinance #704 on June 1, 2023 to annex the Riviera Park property 2.Ordinance #704 was not recorded until October due to waiting for information from the applicant that was needed by the Tax Commission to process the annexation 3.A portion of the annexed property was platted when it was under the jurisdiction of Bonneville County as the Teton Commercial Plat. The plat included public roads that needed to be vacated in order to replat the property. 4.Public Hearing #2023-028, Vacation of Teton Commercial Park Plat, was presented to the City Council on October 5, 2023. No public testimony was presented. 5.On October 5, 2023, City Council adopted ordinance #710 to vacate the Teton Commercial Plat. 6.Ordinances #704 (annexation) and #710 (plat vacation) were brought to office on October 11, 2023 to be recorded. When the ordinances were recorded, #710 was recorded before #704. This means that the City vacated the plat prior to it being under the jurisdiction of the City due to the timing of recording. 7.Ordinance #716 revokes ordinance #710, the previous ordinance vacating the Teton Commercial Plat, and vacates the Teton Commercial Plat now that is under the jurisdiction of the City. This allows the approved final plat for Riviera Park to be recorded. Austin met recently with GIFT to discuss the option of having GIFT come into the Hitt corridor to provide rides for Ammon residents and into Ammon locations. GIFT reported the cost for this would be just over $68,000 but the cost could be mitigated by sponsorship dollars from and Ammon businesses. Kade Marquez, representative of GIFT, was on Zoom to answer questions for Council. He added that sponsorship opportunities would be available and the pickup locations would be negotiable but would not be a set route running throughout the City. Summary of Analysis 1.This ordinance authorizes the issuance and confirming the sale of the Fiber Optic LID #5. 2.Approves the sale of the bond to City of Ammon with an interest rate of 5.0%. 3.Total cost of expenses of improvements is $2,225,897.47. 4.A total of 562 properties are receiving the benefit. 5.The amount of assessments paid in full total $569,563.35 representing 137 properties. 13 properties made partial payments. $1,686,334.12 is remaining for the bond financing. 6.In LID #5, 562 Homes have received the benefit out of 1172 which is ~47.9% Financial Impact The City is planning to purchase the Bond and self finance the $1,686,334.12 at 5% interest for 20 years.
