submitted by the Project Engineers with. the Mayor's approval. The HUD and State
grante are still pending. In view of the apparent certainty now that the project will
gO ahead, it was suggested that the Fire Rating Board will be informed of the plans
for water improvements--Engineer Benton was asked to take care of this. Also
Attorney Anderson suggested passing the Bonding Ordinance in July.
According to Mayor Turnbow, Attorney Anderson has written letters to the property
owners a1:out teari ng dO'Nn t~e abandoned houses on 17th Street, and one of them has
been leveled.
After considerable discussion on the subject, Councilman Southwick moved that the I
remaining alleys within the original townsite be opened and that notification be glven .
to residents on these alleys that they have sixty (60) days in which to move any
fences, ditches, headgates, and buildings in these alleyways. The City will stand the
cost of installing culverts in the ditches crossing the alleyways where applicable. The IX:Wt::WiI

Engineer Benton is to get the surveying done and notify the property owners, any
culverts installed are to be a minimum of 24 inches, and a 5-foot sidewalk and ; tit
utility easement will be required when building permits are issued as specified in a
motion of a previous meeting.

Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7:40 P.M. by Mayor Keith C. Turnbow with the I
following City Officials present:

Commissioner Orval Forbes, County Engineer R. G. Gray, and
Ammon Planning and Zoning Commission Chairman Garth Cunningham.
Prayer was offered by Councilman Swensen. Minutes of the meetings of June 6 and
June 20 were approved as typed.
Referring back to the minutes of June 20, Mayor Turnbow instructed the City Clerk
to write to the property owners concerning opening of the alleyways in the Original
Townsite. Also it was determined that no further contact has been made relative to
the Building Permit applications by Reuben Anderson except a call to Mayor Turnbow
expressed disapproval of the way the situation was handled. Attorney Smith reported
that Attorney Anderson is working on the Recodification revisions and will try to have
them ready for the next meeting.
Mayor Turnbow announced that a letter and form from EPA regarding minority-group
participation in the engineering and construction of the water and sewer project had
been signed and returned ~ith explanation that the planning engineering had to be done
the way it was before the grant applications could be submitted. Attorney Anderson I
is requesting clarification in this matter and, in the meantime, any questions received
should be referred to the Attorney or the Mayor. Engineer Benton mentioned that
invitations to bid on the project will be sent to the minority-group companies, on the
list.
It was noted that official information was received on.June 28, 197 3, notifyin~ the
City of the approval of a $400, 000 ~rant from HUD for the water and sewer .project.

Consequently, the advertising for bids has been published and the bid opening set
for 7: 30 P. M. on July 26. Further correspondence from HUD indicates that contracts
should be let within 2 months and construction completed within 18 months.

After the Council had reviewed and discussed the document involved, Councilman
Southwick proposed the following Resolution: Be it resolved that The Ammon City Coun-
cil approves and accepts the Agreement of Cooperative Action between the City of
Idaho Falls and the City of Ammon for inspection of building activities within the
City of Ammon. Councilman Swensen moved that the resolution be accepted; seconded
by Councilman Cheney; voting all in favor; motion carried.
County Commissioner Forbes and County Engineer Gray were invited to review the
figures and anticipated construction date for improving 17th Street. A possibility of
1974 was mentioned with a cost estimate of $72,000 being Ammon' share. Mayor
Turnbow noted that the plans include storm sewer drainage for the area west of Sand
Creek and requested looking into the amount which would be required to put in storm
sewer through Ammon to drain from Sabin Drive to Sand Creek. All this information
is needed at this time so the City Officials can plan how much will be needed and how
to accumulate funds for such a project. A recommendation was made to wait to acquire
the right-of-way until after a public heaTing when the tone of the public can be determined.
It was mentioned that the County plans to do a temporary resurfacing of 17th Street on the -
section just west of Ammon in the next few weeks, and the City Officials requested that
this resurfacing work be continued on to Falcon Drive by the County if the cost to the
City is favorabl e in comparison to an estimate reported earlier in the Inleting by
Engineer Benton of approximately $2000.00.
The final plat of the Utterbeck Addition was presented to the Council by Planning I
Commission Chairman Garth Cunningham as having been approved by the Planning
and Zoning Commission. Councilman Southwick moved that the Final Plat of the
Utterbeck Addition be approved and that the Mayor, City Clerk, and City Engineer
be authorized to sign on the plat. Seconded by Councilman Swensen; voting all in favor;
motion carried. Engineer Benton recommended that the City should require dedication
and paving of a turn-around at the end of .the street as proposed and prohibit further"
development in the area without another access (to the Ammon Road); also that curb
and gutter should be required if any lot is divided into less that 120 ft. widths. It was
noted that the sewer line will not be available for this addition under the present
project due to the street not going all the way through.
Mr. Cunningham registered a complaint about the noise of early-morning ball games at
the Ammon Jr. High School. 'lhe appropriate person of the Ammon Stake is to be
contacted. The disturbing of sleep of young children caused by the high school drill
team practicing in the church parking lot on Central Avenue was also mentioned by
Councilman Anderson.
Regarding Ammon Days coming up on August 3 and 4, Councilman Cheney is planning
for the relay games and Councilman Swensen is to line up a flat bed to be pulled by the
city tractor as a float for the City Officials to ride on in the parade. Permission was'
given in response to a request to have the city's street sweeper used in the Pioneer Day
parade in Idaho Falls on July 24th. The City Maintenance crew are to take care of this,
in addition to driving the street sweeper and the tractor in the Ammon Days parade.
Councilman Swensen reported on business discussed at recent BCOG meetings. He also
expressed concern over the constant plugging of the ditch culvert in the Junior High
School and church lot area. The Attorney was instructed to write to the Church
Building Committee (with copies to the local Bishop and School District Superintendent)
specifying that a 24-inch culvert with clean-outs be installed when anticipated construc-
tion is done on the church building at Central Avenue in the near future. The Attorney
should also check with the title company about the dedication of the alley through that
block.
According to Councilman Anderson, all City Wells are running, but #4 is still having
some trouble. Problems brought up by Councilman Southwick included complaints
about leaving the tanker fire truck outside during the daytime, a health hazard due to
septic tank failure at a rental home on Bittern Dr., and poor watering of the parks.
He presented an offer by a church group to do the watering at Lions and Falcon Parks
for which approval was given if a payment of $35 per month was acceptable. Mr.
Southwick requested immediate action on the Recodification, and a meeting to discuss
this with Attorney Anderson was set up.

Councilman Swensen moved that the next regular meeting of the City of Ammon
be held on July 26, 1973, following the bid opening. Seconded by Councilman
Cheney; voting all in favor; motion carried.
The meeting adjourned at 11: 55 P. M.
Claims were approved for payment.

Several individuals of the group listed above as being residents of the Original
Townsite presented requests for postponement or installing turn-arounds, etc.,
in response to the city's proposal to open the remaining dedicated alleyways as
moved in the meeting of June 20, 1973. The citizens were asked to take their
recommendations to the next meeting of the Planning and Zoning Commission on
August 22, and further consideration will be given to this matter before action is
taken.
The Council accepted a petition from the delegation from Sabin Drive requesting
enforced speed control on that street by replacement of speed signs which were
taken down during a recent construction project and putting dips 0" bumps in the
street to slow down the traffic. After members of the group had expressed their
feelings, Mayor Turnbow indicated that the speed signs would be replaced im-
mediately and the City Officials would look into the matter of the speed checks
with its legal counsel. Later in the meeting, Mayor Turnbow inquired of
Attorney Anderson regarding this problem and the advice was given that there is
too much exposure to liability from any accident or damage that might be
caused from such speed checks. It was the feeling of the Mayor and Council
to accept this legal advice and endeavor to have better patrolling on Sabin Drive I
to try to correct the speeding situation.
Wilford McGavin of 2850 Teton St. was present to request a variance to the
5-foot. side-yard setback requirement so that an addition 10 his garage which he
is planning could be placed at 3 feet from his property line. This request had
been previously presented to the Building Permit Committee of the Planning and
Zoning Commission, and Chairman Cunningham reported that a recommendation
to deny issuance of a permit was made by that committee. Sitting as a Board of
Adjustments, the Council advised Mr. McGavin that he would not be allowed to
build closer that the 5 -foot requirement, and it was suggested that he endeavor
to purchase the additional 2 feet which he needs from his neighbor. Mr.
