The meeting was called to order at 7:40 P.M. by Mayor Russell N. Swensen with the following
City Officials present:

Others present during the meeting were Grace and James Kimbro, Dee Mansfield, and Bill
Ferguson (all representing Kimbro Real Estate of Idaho Falls), Reynold Chambers of 2863
E. 17th Street, and T. R. "Ted" Orchard of Rt. 1 Box 206.
The pledge of allegiance to the flag was directed by Councilman Monson and the invocation
was offered by Councilman Quigley.
Bill Ferguson, acting as spokesman for Kimbro Real Estate, explained that a client is
interested in buying property on the north side of 17th Street in the Chambers Addition
which is zoned C-l, and he needs to know what the possibility would be of getting a
license for selling beer and wine to be consumed on the premises in an Italian restaurant.
Attorney Anderson noted that the City wine ordinance would have to be amended, and the
Mayor and Council members expressed a desire to have input from the residents, perhaps by
an advisory election, before taking any action to change the City policy regarding beer
and wine by the drink. It was agreed that the matter would be taken under advisement.
Later in the meetin~, Attorney Anderson mentioned the need to clarify the City's stand
about the consumption of beer and wine on the premises, and indicated that he would
inquire if it would be possible to have an advisory ballot vote in the Ammon precincts
at the time of the County election which is coming up in November.
Tentative plans to start additional development in the E-Z Storage complex, located
immediately east of Sand Creek and south of 17th Street, were presented by Ted Orchard.
The conditions of the Special Use Permit, which was granted for the commercial storage
area in 1980, were reviewed and it was indicated that the proposed carports for re-
creational vehicles could be classified as open storage which was provided for in the
permit. Mr. Orchard was informed that plans will have to be submitted to the Planning and
Zoning Commission before a building permit to start construction can be issued. Details
concerning the use of the City-owned storm sewer lift station property which is within
the fenced area of the storage compound and the agreement that <requires the developer to
extend the storm sewer system south to Salmon Street in the future were clarified by
Engineer Benton.
Problems concerning the irrigation ditch in front of the Ammon Elementary School were
mentioned by Councilman Quigley. He noted, also, that a claim has been filed against
the.;ityfor window breakage which the resident claims resulted from rocks being thrown
by the City lawn mower while working in the park across the street from his home.
Councilman Monson reported that the Planning and Zoning Commission completed a public
hearing on amending the Zoning Ordinance to establish a Manufactured Residence (MR) Zone.
A public hearing before the City Council on this proposal was scheduled for 7:30 P.M. on
October 18, 1984.
Matters of interest in the Public Works department, according toa rep~rt by Hayse Whiteley,
were the installation of a water service line for the Valley Living Center which is under
construction on the north side of 17th Street, a water main leak near the storm sewer lift
station by Sand Creek, plans for putting in a French drain on Molen Street, and efforts to
locate a satisfactory fire truck to purchase.
Engineer Benton reported that government grant funds are not available for a jogging path
which has been suggested for North McCowin Park, but information on good materials to use
can be obtained from the City of Idaho Falls Recreation Department.
Attorney Anderson reviewed the results of the ruling of the Idaho Public Utilities
Commission on the recent Utah Power & Light Company rate case, in which the City was an
intervenor, stating that he thought it turned out favorably for the City and residents.
Regarding the status of the City Council decision to revoke the building permit for the
McQuillen log house, Attorney Anderson reported that his letter to Mr. McQuillen's lawyer
asking for information about a schedule for moving the house away~twith the response
that an appeal for a court review will be filed so that will hold up any further action
for now, with the court process expecting to take at least a couple of months.
The City Clerk presented claims to pay in the amount of $41,180.85 and claims for expendi-
tures paid since the last meeting totaling $21,932.94, all of which were approved.
