BEITORDAINEDBYTHECITYCOUNCILANDMAYOROFTHECITYOFAMMON,
IDAHOTHATORDINANCE703ISHEREBYADOPTEDACCORDINGTOTHE
FOLLOWING:
WHEREAS,onOctober6,2022theAmmonCityCounciladoptedOrdinance692,therebyimposingan
emergencymoratoriumordinanceonresidentialannexationsover10acresingrossacreage,and
WHEREAS,onMarch2,2023,theCityCouncilextendingthemoratoriumbyadoptingOrdinance697
andrescindingOrdinance692;and
WHEREAS,onJune1,2023,theCityCouncilfindsthattheconditionsthatexistingwhenthe
moratoriumwasfirstimposedhavebeenresolved.
NOW,THEREFORE,BEITORDAINEDBYTHEMAYORANDCOUNCILOFTHECITYOF
AMMON:
Section1.Ordinance697isherebyrescindedinitsentirety.
Section2:REPEALERCLAUSE.AllCityofAmmonOrdinancesorpartsthereofwhicharein
conflictherewithareherebyrepealed.
Section3:SAVINGSANDSEVERABILITYCLAUSE.Itisherebydeclaredtobethelegislativeintent
thattheprovisionsandpartsofthisOrdinanceshallbeseverable.Ifanyparagraph,part,section,
subsection,sentence,clauseorphraseofthisOrdinanceisforanyreasonheldtobeinvalidforanyreason
byaCourtofcompetentjurisdiction,suchdecisionshallnotaffectthevalidityoftheremainingportions
ofthisOrdinance.
ThisordinanceentitledOrdinanceNo.703shallbeeffectiveuponitspassageandpublicationasprovided
bylaw.
EnactedbytheCityCouncilasOrdinanceNo.703anordinanceoftheCityofAmmononthe1dayof
June,2023.
