A report by Public Works Foreman Thomas Reese included information on arrangements
being made for use of the street sw'eeper for a special contractor clean-up project
at the Idaho National Engineering Laboratory site, problems encountered in trying to
help the property owner(locate the sewer service stub-in for a new home under con-
struction at 4333 Ileen Circle, progress of the work being done on the ceiling in
the City shop, the need for de-humidifiers in the sew'er lift stations, and the
possibilities for better use of the light that is near the shelter in McCowin Park.
Scheduling the City Clean-up Time was discussed, and special trash pick-up days were
set for the Saturdays of April 30, May 7,and May 14.
A model manufactured housing ordinance was revie-vred, and comments indicated concern
about whether or not the ordinance, with revisions as recommended by the Planning I
and Zoning Commission, is necessary for the City since the changes would require a
manufactured dwelling on a residential lot to meet the standards of the Uniform
Building Code and so w'ould not be different from what is already in the City fuilding
regulations. Reference was made to a letter of opinion from the City Attorney re-
garding the liability OT the City if trailerhouses in residential zones are denied,
which is quoted as follows: "There is a specific zoning which allows mobile home
parks, so they (trailerhouses) are not restricted from being in the City, but only
restricted from being in certain locations. If the ordinances w'ere follow'ed
and a particular applicant did not feel the ordinances were fair, I think his re-
course would be to attack the validity of the ordinances rather than seek any damages.
I don't believe there could be a successful damage suit in the event the ordinances
-vrere follow'ed by the City." The need to put more thought into the matter was expressed,
and Councilman Monson moved to table the discussion of the manufactured housing ordi-
nance until the next meeting. The motion was seconded by Councilman Williamson;
voting was all in favor; motion carried.
Approval was given to pay claims in the amount of $11,325.56, and vouchers for pay-
roll expenses, etc., paid since the previous meeting totaling $6,0]6.04 w'ere also
approved.
A motion to adjourn was made by Councilman Monson and seconded by Councilwoman Dille;
voting was all in favor; the meeting was adjourned.

Minutes of the Regular Meeting of the Mayor and City Council;
The meeting was called to order at 7:30 P.M. by Acting Mayor Russell N. Swensen
w'i th the follow'ing City officials present:

Others present during the meeting were Dick Bybee, Loren Peterson, and Jack Win-
chester.
The pledge of allegiance to the flag was conducted by Councilwoman Dille and prayer
was offered by Acting Mayor Swensen.
Loren Peterson, representing the citizens committee for park improvements, listed
priority items for completing the development of Peterson Park, for which the City
has a matching grant from the Bureau of Outdoor Recreation. Jack Winchester presented
information on costs for the lighting whichh'8'estimated to be about $1,000. Approval I
was given by the Council to go ahead on the lighting project, and it w'as agreed that
w'ork should proceed, as funds are available, on the other items of a border for the
parking lots, bleachers, barbecue equipment, a small shelter (cover for a picnic
tanle), a few replacement trees, extension of the chain-link fence on one of the
ball fields, and cementing of the playground equipment which was purchased last
year but not installed. Mr. Peterson also recommended that the lawn be fertilized
and sprayed for w'eeds, and that something be w'orked out for drainage of a low spot
in the park.
Circumstances regarding damage to his driveway were related by Dick Bybee of 2130
Ross Avenue. He explained that the problem occurred while a City water main was
being repaired. A recommendation was made that the matter be referred to the City's
insurance agent.

In connection with the drainage problem at the residence of Michael Jones at 1805 Midway
Avenue, which was discussed at the lasi meeting, a request from Mr. Jones to put in a
culvert was rejected, and there was no change in the decision that the situation should
be solved by following the City's policy of having a "swale" in the driveway to allow'
the run-off water to drain in a natural way.
An application for a variance submitted by Leonard Waters of 2105 Avocet Drive was re-
viewed. It was noted that there is 50 feet of available space from the existing house
to the south property line, and Mr. Waters requests permission to build a family room
and two-car garage with a total footage of 46 feet, thus leaving a sideyard of 4 feet.
The question was brought up as to whether or not a variance in this case would be'lin the
spirit of the zoning ordinance which refers to special conditions to be considered.
Councilwoman Dille moved to deny the variance because there are no exceptional conditions
as far as narrowness or shallowness of the lot. The motion was seconded by Councilman
Williamson. After discussion on the motion, Councilwoman Dille w'i thdrew the motion with
consent of the second, and moved to send the matter to the Planning and Zoning Commission
for a recommendation; the motion was seconded by Councilman Monson; voting was all in
favor; motion carried.
A variance request from Orland Bailey of 2810 Salmon Street was considered and found to
be in order, with the necessary signature of the adjoining property owner having been
obtained as verification of notice. It was moved by Councilwoman Dille and seconded by
Councilman Monson that a sideyard variance of 2t feet be granted to Orland Bailey to
add 4 feet on to his garage thus leaving a sideyard of 5t feet (zoning requires 7t feet);
voting on the motion was all in favor; motion carried.
It was decided that discussion on a model manufactured housing ordinance should be con-
tinued until another meeting. Acting Mayor Sw'ensen encouraged attendance at the AIC
Spring District Meeting on Tuesday, April 12. The monthly fire department report and
the animal control work schedule were reviewed by Councilman Williamson. The Public
Works Director mentioned that de-humidifiers have been ordered for the sewer lift stations.
Acting Mayor Swensen announced the re-appointments of Elaine McGary and Michael Browning
for three-year tenms on the Planning and Zoning Commission, and the Council confirmed
this action in a motion made by Councilwoman Dille and seconded by Councilman Monson with
voting all in favor; motion carried. It was understood that the terms were retroactive
to March 1, 1983. Richard Kelly cannot accept re-appointment because of health conditions.
Claims to pay totaling $21,859.45 w'ere approved, along with expenditures of $5,829.33 paid
since the previous meeting.
A motion to adjourn was made by Councilwoman Dille

Others present during the meeting w'ere Shauna Hammond of the parks improvement committee
and Pam Dixon, 3615 Vaughn Street.

cation was given by Councilw'oman Dille.
Shauna Hammond presented information on costs for spraying the weeds and fertilizing the
grass in Peterson Park, and mentioned that an auger will be needed for the work on the
playground equipment which is planned for Saturday, May 7.
According to Councilman Williamson, an extension was granted on the Utah Pow'er & Light
Company rate-increase hearings, and a tentative date is set for June 24, with the inter-
venor testimony hearings to be during the month after that. He indicated that Utah
Power & Light Company is planning to consolidate the business offices in eastern Idaho,
so will be moving out of Rexburg, and a suggestion was made that an invitation be ex-
tended to the company to locate in Ammon.
