Mr. Romander requested that Council consider changing current code to allow local businesses ability to conduct business through door-to-door sales without the additional fees. Mr. Romander explained that local businesses would be more likely to conduct business appropriately as they had a local reputation to uphold. Council and Staff discussed the current limitations and costs tied to the licensure. D.ACTION ITEMS: 1.Administrative Appeal Brogan Creek Driveway (Cindy Donovan, City Planner) City Planner Cindy Donovan reviewed the request from the Blatters, who were present to discuss their request. Donovan noted that the request for two additional accesses on the lot went against City Code and BMPO standards and staff recommended denial. Richard Blatter, 3546 Boulder Creek Ln, spoke to Council regarding the request. Mr. Blatter noted that he believed the additional driveways would assist with drainage in the area with the current swale and flood plan and that the additional space would prevent on-street parking and vehicles backing into the roadway. City Engineer Bono noted that the swales in the area were calculated during the platting process and water retention was specific to those calculations. Council discussed the background of the Ordinance guiding the decisions and the appeal process. Angalee Blatter added that the lot being combined and the limitation of on-street parking in the development made their property unique. Mayor Coletti added that he thought more consideration of the validity of the Ordinance should be considered at a future work session. Compliance - The request is not in compliance with Policy #50-001 BMPO Access Management Plan Adoption of Policies and Procedures. - The request is not in compliance with Title 10, Chapter 29, Section 13 (B) 4a Recommendation Staff recommends denial as it is in conflict with City of Ammon Policy #50-001, the BMPO Access Management Plan and Title 10, Chapter 29, Section 13 (B) 4a. Summary of Analysis be limited to one driveway for each tract of property separately owned. Properties contiguous to each other and owned by the same person are considered to be one 26, section 4.7, item 32. 10-29-13 (B) 4a: at the street, in accordance with the BMPO Access Management Plan, July 2012 and City Policy #50- 3. Property is located in the Brogan Creek Subdivision 4. Brogan Creek Division 1, Lots #4 and #5 were combined to become Lot #12 (see Brogan Creek Division 1 Amended Plat attached) Ammon City Council Regular Meeting 01.05.2023 Page 2 of 4 Ammon City Council 02.16.2023Page 3 of 29 5. The Brogan Creek Subdivision was engineered with swales to allow for one thirty (30) foot access per lot, these lots each contained a ten (10) foot water channel along the property lines to facilitate water run-off into the swales. When the lots were combined, these channels were adjusted to twenty (20) feet to allow for adequate water run-off. 6. Site Plan was submitted showing three (3) access points to Klamath Falls Street 7. Planning staff has denied the three (3) access points and returned the site plan with corrections noted. 8. Plans are currently under review by the Building and Planning Departments. Parcel Characteristics - Property is located at 5680 Klamath Falls Street - Located in Brogan Creek Division 1 - Property is zoned RP-A - To allow construction of three (3) vehicular accesses on Klamath Falls Street - Presented by Richard and Angalee Blatter, homeowners It was moved by Council Member Wessel to deny the appeal request to allow for additional vehicular accesses to Klamath Falls Street, as it is in conflict with City of Ammon Policy #50-001, the BMPO Access Management Plan and Title 10, Chapter 29, Section 13 (B) 4a. ‘źƷŷƚǒƷ ğ ƭĻĭƚƓķͲ ƷŷĻ ƒƚƷźƚƓ ķźĻƭ ƚƓ ƷŷĻ ŅƌƚƚƩ It was moved by Council Member Slack and seconded by Council Member Tibbitts to continue until further information can be obtained. aƚƷźƚƓ ƦğƭƭĻƭ ǞźƷŷ ǝƚƷĻ ĬǤ Ʃƚƌƌ ĭğƌƌͲ /ƚǒƓĭźƌ aĻƒĬĻƩ ‘ĻƭƭĻƌ ǝƚƷźƓŭ Ɠƚ E.DISCUSSION ITEMS: 1.Building Activity Annual Report (Charles Allen, Building Official) Building Official Charlie Allen reviewed the 2022 Building Activity Report focusing on permits issued, property valuations, inspections completed and new construction. Allen noted it was a hugely successful year, that he was cautiously optimistic about the coming year, and he was thankful for his team. 2.City Administrator Austin reminded Council that the February Work Session would be st held at Resin Architecture on 1 Street for a virtual tour of the plans for the City Hall expansion and remodel. 3.Counsel Scott Hall advised that a public hearing on comprehensive plan changes be held. Hall discussed the timing of the current building moratorium expiration and the potential need for an extension, which staff has been preparing for. Hall, Council, and Staff discussed the potential for community meetings related to the comprehensive plan and land use map changes City Planner Donovan added she was prepared to hold a few before any future action took place. 4.Council Member Vander Meer inquired as to ownership and maintenance of the railroad crossing on Sunnyside as it had become quite dangerous for drivers. Bono added he had submitted for similar funding on Sunnyside and would look into options for there as well. Summary of Analysis -In June 2022 the City of Ammon transferred our capital savings of $1,924,115.45 to the Eastern Idaho Regional Wastewater Authority (EIRWWA became EIRSD in August 2022). -We had not budgeted for this transfer to help with phase one of the plant expansion. It was important to do the transfer at this time to help EIRWWA prepare and plan for phase one, and before the official EIRSD transition. -The Notice of Public Hearing published in the Post Register on February 8 and 15, 2023. Ammon City Council 02.16.2023Page 11 of 29 City Council Meeting: February 16, 2022 Mayor Coletti and City Councilmembers: FY 2022 Audit Report Covering Oct. 1, 2021 Sept. 30, 2022 Staff Presenting: - Jennifer Belfield, Finance Director Recommendation: - Staff recommends approving/accepting the FY 2022 audit report as presented by Theresa Flannery from Wipfli. Summary of Analysis: - We have completed the audit for FY 2022. - Overall the audit went very well. - There were no findings/write ups. Financial Impact: - During FY 2022 we received over $750,000 worth of federal funding (ARPA funds), so we needed a single audit done. The amount for a single audit was $4,500. - There will be a final invoice to close out the audit. (This is a regularly budgeted for line item, GL # 10-410-640.)
