Minutes of the Regular Meeting of the Mayor and City Council ,and a Public Hearing:
The meeting was called to order at 7:30 P.M. by Acting Mayor Russell N. Swensen with
the following City Officials present:

The pledge of allegiance to the flag was conducted by Councilman Monson and prayer was
offered by Councilman Swensen. The minutes of the meeting on December 18, 1980, were
approved as prepared later in the meeting.
The meeting was opened as a public hearing on the annexation and initial zoning of the
second portion of the Delmar Anderson Addition, a parcel of land containing 59.7 acres
bordered by 17th Street on the north and Crowley Road on the east. It was pointed out
that the hearing had been advertised and notification given by mail to adjoining property
owners as required by law, and that there were no interested parties present to make
comment. Dick Kelly reported on the public hearing and recommendation made by the
PlaQning and Zoning Commission at the meeting on January 13, 1981, and mentioned the
problem of the waste-water ditches that are on the land. David Benton, representing the
developer, gave assurance that the drainage would be worked out before a final plat is
presented and indicated that the development plans will have to be submitted to Federal
agencies because of the flood plain regulations, etc. The Council members reviewed the
requested zoning of C-l on 14.7 acres at the northeast corner of the property, R-2 as a
buffer on the 24.9 acres adjacent to the corner parcel, and RPA on the remaining 20.3
acres (no mention was made of an animal overlay zone). Councilman Swensen reported that
the City Fire Department had been given an opportunity to check the proposed street layout,
etc., on the preliminary plat and could see no problem with the plan so far. It was noted
that the street plan for the entire Delmar Anderson Addition proposes tw'o streets through
to'17th Street and two streets having access to Crowley Road, which is consistent with the
limited access policy on major county roads. The public hearing was closed at 7:55 P.M.
As the first item of business in the regular meeting, Councilman Swensen called for action
on the request submitted by Delmar Anderson which was the subject of the public hearing
just completed. Councilman Monson moved to accept the preliminary plat as presented and
to annex the second portion of the Delmar Anderson Addition with zoning of RPA, R-2, and
C-l as advertised, subject to an annexation agreement being submitted and approved. The
motion was seconded by Councilwoman Dille; voting was Monson yes, Dille yes, Swensen yes;
motion carried.
Councilwoman Dille made reference to a letter from the City's insurance carrier, Consoli-
dated Agencies, Inc., of Blackfoot, concerning the opportunity to participate in a "Loss
Ratio Dividend'. Program" for liability insurance through the Association of Idaho Cities,
with coverage being through the same company that now insures the City, and it was decided
that more information is needed before any action can be taken on this matter.
Councilman Monson reported that information presented by a representative from the County
Engineer's office at the Planning and Zoning Commission meeting indicated that the Hitt-
Hackman Road is to be completed from 1st Street to 17th Street this year and on to
Sunnyside Road in the next few years.
In connection with the Ammon Plumbing suit which was discussed at the meeting on February 5,
Attorney Anderson recommended having an executive session with the concerned parties, and
the date of March 19 was suggested.
Hayse Whiteley, Public Works Director, informed the Council about efforts being made to
arrange for repair of the swimming pool deck and work that is planned to fix a leak in
the water tank of the fire truck. In response to an inquiry on behalf of employee Robert
White regarding working for the City during late afternoon and evening hours while going
to Va-Tech School, the Council members agreed that such an arrangement w'ould not be
feasible unless, as mentioned by Councilman Swensen, the possibility of working out some-
thing for animal control might want to be discussed. Another matter brought up by Mr.
Whiteley was in relation to the problem of not being able to get prompt response from
electricians when the City needs electrical w'ork done on pumps, etc., which has resulted
in having Monson Electric provide service a number of times, even though this could be
considered a conflict with Thayle Monson being an elected city official. Councilman
Swensen expressed condern for Councilman Monson personally under these circumstances be-
cause people sometimes look for such things, but agreement was indicated in support of
getting Monson Electric for emergencies, with a recommendation that calls for electricians
be documented.
The Council discussed a report made by Councilman Sw'ensen, in response to a call from
Lieutenant Max Gallup of the Sheriff's Department, that some residents who obtain special
~ermits for parking vehicles in the street during group activities in the home are not
displaying the permits on the cars as required, and Council members agreed, as a backup
for the officers, that if the permits are not on the vehicles and a parking ticket is

valid and is not to be dismissed. Attention was also given to complaints about a citizen
who has been parking trucks and a car on the street in a "no parking" zone on Geneva
Drive creating a safety hazard, and it was requested that a reminder be issued that resi-
dents who are violating the parking regulations on posted streets are subject to citation
and are asked to cooperate by getting all vehicles off the street to eliminate the danger
of accidents. Councilman Swensen reviewed the monthly Fire Department report, and men-
tioned that the animal control officer will be asked to arrange some working hours to take
care of the dog problem at the schools.
The City Clerk presented claims in the amount of $13,944.95, which w'ere approved for pay-
ment. It was moved by Councilman Monson and seconded by Councilw'Oman Dille that the

Also present during the meeting was Boy Scout Travis Allen.
The pledge of allegiance to the flag was conducted by Councilman Swensen and prayer was
offered by Councilman Monson. Minutes of the meetings on January 8, January 22, and Febru-
ary 5, 1981, were approved as prepared.
Guidelines for signs, which were suggested by the City Building Official as an addition
to the sign ordinance, were reviewed and designated for study to be considered at a
later date.

Councilman Swensen announced that Attorney Anderson requested suggestions of citizens
who may be willing to testify at the Utah Power & Light Company rate-increase hearing
on March 16 in Pocatello, and Councilman Rowberry recommended Jim Sanders of 2160 Curlew
Drive and Alden Brindle of 2850 Salmon Street.
Councilwoman Dille reported that she did not have any additional information on the "Loss
Ratio Dividend" insurance program at this time.

A report by Councilman Rowberry indicated that he is formulating plans for citizen-
participation projects in the parks and will bring specific suggestions to the Council
for approval. He recommended that sledding hills like those in the new Peterson Park
be developed on the west part of McCowin Park using City equipment and employee labor.
The repair needed on the swimming pool deck was discussed, and Engineer Benton suggested
that the concrete companies in the area be contacted to get information on businesses
that do the specialty work of raising existing cement sections rather than having a
complete replacement job done.
A letter received from a citizen on Falcon Drive complaining about various conditions in
the City and making suggestions for improvements was discussed, and Councilman Swensen
mentioned approaching community organizations to get involved in clean-up projects, etc.
Council members were encouraged to kee,p up on matters being considered by the State
Legislature that affect cities by reading the "Legislative News" sent out by the AlC.
Councilman Monson indicated that he would try to attend a special meeting at the State
Transportation office in Rigby on March 17.
Claims in the amount of $8,499.66 were approved for payment. It was moved by Council-
woman Dille and seconded by Councilman Rowberry that the meeting adjourn; voting was all
in favor; the meeting adjourned at 8:30 P.M.
