Minutes of the Regular Meeting of the Mayor and City Conncil:
The meeting was called to order at 7:35 P.M. by Mayor George Wehmann with the following
City Officials present:

Others present during the meeting were Jean Pugh and Brent Andrew.
The pledge of allegiance to the flag was conducted by Councilwoman Dille and the invoca-
tion was offered by Mayor Wehmann. There were no minutes ready to be approved.
Jean Pugh, 3160 Owen Street, was given time to present a written proposal concerning the
procedure for obtaining a renewall on a dog kennel license which was given to Attorney
Anderson to study and advise the Council.
The problem of the Tiny Tot Day Care Center having been opened for business at 3415
Molen Street without the manager having checked on the zoning regulations for the loca-
tion was brought up for discussion, and the presence of Brent Andrew representing the
business was acknowledged. Inasmuch as it was determined that this operation does not
qualify as a home occupation and consequently is in violation of the R-l Zoning in the
area, advice from the City Attorney was requested as to whether or not a conditional use
permit could be issued. Mayor Wehmann recommended and the Council members agreed that
in the interim,while the legal procedure is being researched, the day care center be
allowed to continue in operation until October 18th at which time the Council should re-
view the situation again, that the matter should be presented to the Planning and Zoning
Commission at the meeting on October 9th, that there should be no increase in enrollment
(presently 17 children) during that time, and that the time limit will be terminated
sooner if there are any written complaints received by the City. Mr. Andrew indicated
that he would abide by this decision.
A review of the City finances was presented by Auditor Walter Clapp. It was recommended
that, since the funds are in a tight position, a monthly budget should be set up and the
situation looked at each month with a projection ahead for three months.
After the schedule for new rates in the different categories for water service, as pre-
pared by Councilman Rowberry and planned for in the FY-1980 budget, had been discussed,
the following Besolution was presented for approval:
WHEREAS, THE CITY OF AMMON, Bonneville County, Idaho, has adopted, by Ordi-
nance, the provision requiring a monthly service charge to be paid by any user
utilizing the city water system, wherein such person is a customer, by having a
customer line connected to the city water main; and
WHEREAS, the City Ordinances of the City of Ammon provide that the water
rates to be charged to customers shall be established by resolution of the Council
and posted in the Clerk's Office and may be amended from time to time by resolu-
tion; arid
WHEREAS, the City Council has examined the rates now being charged and have
determined, and do hereby find, that such rates should be revised to meet ex-
penses of operation, bond service, maintenance, repairs and other appropriate
charges:
NOW THEREFDRE, be it hereby resolved by the City Council of the City of
Ammon as follows:
Section 1.
That the water rates to be charged by the City of Ammon, for the monthly
service charges for water service from the City of Ammon water system to the
customers through the City water mains, are hereby found to be reasonable in the
following amounts and are hereby fixed as follows:
a. Residential Users:

e. Charges for use of the City water system by users outside
the City limits shall be one-and-one-third (1-1/3) times
the above stated charges.
f. A 5% discount will be afforded apartment, condominium, and
trailer-court complexes containing five (5) or more units
provided a single payment in full is made by the lOth day of
the month following the month for which service is being billed.
Section 2.
That the monthly water service charge shall be due and payable before the 10th day
of the month following the month for which service is received.
Section 3.
That a copy of this Resolution shall be posted in the Clerk's office and subject
to examination by any interested party.
It was moved by Councilwoman Dille and seconded by Councilman Ro~berry that the fore-
going Resolution in regard to water rates for the City of Ammon be adopted, with the
rates to become effective October 1, 1979. The voting was Dille, yes; Rowberry yes;
Swensen, yes; Lee, yes; motion carried.
Councilwoman Dille moved to impose a finance charge of l~ per month after an account
is 30 days delinquent and that the minimum finance charge be 50~. The motion was
seconded by Councilman Rowberry. Councilwoman Dille moved and Councilman Rowberry
seconded that the motion be amended to state that the City "may" impose the finance
charge. Voting on the amended motion was unanimous in favor; motion carried. It was
instructed that wording regarding the finance charge be printed in the coupon books
which are used by all customers when making payment on accounts.
The following Resolution to increase the rates for refuse (garbage) collection was pre-
sented for approval:
WHEREAS, THE CITY OF AMMON, Bonneville County, Idaho, has adopted, by Ordinance,
the provision requiring a monthly service charge to be paid by any user utilizing
the refuse collection system, wherein such person is defined to be a customer by
being served by the city water and/or sewer system; and
WHEREAS, The City Ordinances of the City of Ammon provide that the refuse
collection rates to be charged to customers shall be established by resolution
of the Council and posted in the Clerk's office and may be amended from time to
time by resolution; and

WHEREAS, the City Council has examined the rates now being charged and have de-
termined, and do hereby find, that such rates should be revised to meet expenses of
operation, bond service, maintenance, repairs and other appropriate charges:
NOW THEREFORE, be it hereby resolved by the City Council of the City of Ammon

That the refuse collection rates to be charged by the City of Ammon, for the
monthly service charges are hereby found to be reasonable in the following amounts
and are hereby fixed as follows:
a. Each dwelling unit (including but not limited to single
residences, house trailers, apartments, condominiums,

d. All occupied business, commercial, or other premises are hereby assessed
upon the basis of number of garbage cans and approved containers used and

Provided, however, any apartment, condominium, or trailercourt complex may elect
to be assessed under the business rate by requesting same in writing to the City,
specifying size of container (4 or 5 cubic yards) and number of pick-ups per week.
Metal containers shall be furnished and maintained by the City and shall remain
the property of the City. Cost of rental of containers is included in above fee
schedule.

It was moved by Councilwoman Dille and seconded by Councilman Rowberry that the foregoing
resolution regarding refuse (garbage) collection rates be adopted, with the charges as
outlined to go into effect on October 1, 1979. Voting on the motion was Dille, yes; Row-
berry, yes; Swensen, yes; Lee, yes; motion carried.
Other items mentioned were as follows: Councilman Lee reported that calls he has had lately
indicate that people are unhappy about the dog situation, and the subjects of hiring an
animal control officer and revising the dog ordinance were discussed again. It was explained
that the City of Idaho Falls is willing to take dogs from Ammon at the animal shelter op-
erated by that City. Regarding what appears to be a problem with the City getting monies
from court fines collected on citations issued in Ammon, Attorney Anderson advised that
the dlSposltlon of the tickets will have to be traced, and Councilwoman Dille agreed to
check the records relative to this matter. According to Councilman Swensen, LaVern
Williams, longtime City employee, is coming along fine after heart surgery, and it was
pointed out that he is to be continued on the payroll until at least the end of October
under a special disability sick-pay arrangement pending establishing a policy for such
situations. Councilman Rowberry asked for reaction to the commercial sewer rate which
he proposed at a previous meeting, and it was agreed that the subject should be studied
for future action. Hayse Whiteley, Public Works Director, reviewed matters concerning
the sewer hookup requirement at the Ammon Produce plant, preparing the pool and tennis
courts for winter, the installation of a flange at Well #2 which stopped the leak there,
and the letter to be written to David Steed regarding the repair of a waterline at Wanda
Street and Princess Drive.
