Council Minutes 10/07/2004 CITY OF AMMON CITY COUNCIL MINUTES THURSDAY, OCTOBER 7,2004 The meeting was called to order by Mayor Bruce Ard at 7:35 p.m. in the City Building, 2135 South Ammon Road, Ammon, Idaho, with the following City Officials present: Mayor C. Bruce Ard Councilmember Karen Y. Anderson Councilmember W. Lee Bean Councilmember Rex Thompson Councilmember Randy Waite City Attorney Scott Hall City Administrator Bruce Rose City Engineer Bill Manwill City Clerk/Treasurer Diane Gempler Councilmember Anderson led the Pledl!e of AIlet!:iance to the Flal! and, Councilmember Bean offered a prayer. Minutes September 16.2004: Councilmember Anderson motioned to approve the September 16,2004, minutes. Councilmember Waite seconded. Roll call vote: Councilmember Anderson - Yes, Councilmember Waite - Yes, Councilmember Thompson - Yes, Councilmember Bean - Yes. The motion carried. Public Comment -Items Not on Al!enda: Harvey Crandall, 3550 Brookfield Lane, addressed the Council regarding the JAG Development request for rezone of property along Ammon Road. Mr. Crandall indicated he had been unable to attend the public hearing held in May regarding the request. His property is most directly impacted by the requested rezone, and he would like the Council to know that he is not opposed. Consent Al!enda: Councilmember Anderson motioned to approve the Consent Agenda as presented. Councilmember Thompson seconded. Roll call vote: Councilmember Anderson - Yes, Councilmember Thompson - Yes, Councilmember Waite - Yes, Councilmember Bean - Yes. The motion carried. Items from Mavor: Mayor Ard gave the floor to Fire Chief Clarence Nelson. Clarence Nelson reported to the Council that the fire department has secured a homeland security grant totaling $99,000.00 for equipment. The funding will be used to purchase Self-Contained Breathing Apparatus units. PUBLIC HEARINGS: Mayor Ard explained the hearing process and swore in those individuals desiring to testify. School District #93 - Renewal of Modular BuUdinl! Permits: Notice of the Hearing was published in the Post Register on September 23 and September 30, 2004. Notice of the hearing was also mailed to property owners within five hundred (500) feet of the property and, to other parties of interest. Roger Hill, School District 93, presented the request for extension of the special use permit issued in 2000 through June of2006. The school district is preparing for a bond election. The bond, if passed will allow the construction of two additional elementary schools, to alleviate the need for the modular classrooms. Mayor Ard closed the public hearing. The Council discussed the renewal of the modular building permits and time limits for renewal of the permits or removal of the buildings. Councilmember Waite motioned to renew the modular building permits through June 30, 2006. Councilmember Thompson seconded. Roll call vote: Councilmember Waite - Yes, Councilmember Thompson - Yes, Councilmember Bean - Yes, Councilmember Anderson - Yes. The motion carried. City Council 10/07/2004 - 1 ACTION ITEMS: Ordinance No. 350 - Rezone Lot 6. Block 5. Trailwood #2: This rezone was approved by the Council at their September 19,2004 Council Meeting. Councilmember Thompson read Ordinance No. 350, AN ORDINANCE TO AMEND THE ZONING CLASSIFICATION AND THE ZONING MAP FOR CERTAIN LANDS LOCATED WITHIN THE CITY OF AMMON; PARTICULARLY DESCRIBING SAID LANDS AND DECLARING THE CLASSIFICATION OF ZONING FOR EACH SUCH PARCEL OF LAND; PROVIDING FOR AN EFFECTIVE DATE by title and motioned to dispense with the rule requiring three readings of the Ordinance and waive the 2nd and 3rd readings. Councilmember Waite seconded. Roll call vote: Councilmember Thompson - Yes, Councilmember Waite - Yes, Councilmember Anderson - Yes, Councilmember Bean - Yes. The motion carried. Councilmember Thompson read Ordinance No. 350, AN ORDINANCE TO AMEND THE ZONING CLASSIFICATION AND THE ZONING MAP FOR CERTAIN LANDS LOCATED WITHIN THE CITY OF AMMON; PARTICULARLY DESCRIBING SAID LANDS AND DECLARING THE CLASSIFICATION OF ZONING FOR EACH SUCH PARCEL OF LAND; PROVIDING FOR AN EFFECTIVE DATE by title and motioned to adopt Ordinance No. 350 on its third and fmal reading. Councilmember Waite seconded. Roll call vote: Councilmember Thompson - Yes, Councilmember Waite - Yes, Councilmember Anderson - Yes, Councilmember Bean - Yes. The motion carried. Chad Heath Preliminary Site Plan: City Planning Director Ron Folsom presented slides of the location and proposed site plan. The property is located in the Lincoln Industrial Park, on the south side of 14th North. Set backs, parking and landscaping meet the requirements for the I&M-l zone. The Council discussed the proposed site plan. Councilmember Bean motioned to approve the Chad Heath Preliminary site plan as presented. Councilmember Anderson seconded. Roll call vote: Councilmember Bean - Yes, Councilmember Anderson - Yes, Councilmember Thompson - Yes, Councilmember Waite - Yes. The motion carried. Hillcrest Crosswalk: Councilmember Bean reported that the School Board has approved a crossing guard on Sunnyside at Stonehaven Drive. Todd Hicks, representing School District #93, addressed the Council regarding the proposed crossing guard. The Council discussed placement of a crossing guard at the cross walk. There was additional discussion that there may not be a crosswalk once improvements to Sunnyside are completed. Councilmember Thompson motioned to authorize School District #93 to post a trained crossing guard who is an employee of the school district, at the crosswalk on Sunnyside at Stonehaven Drive for the remainder of the current school year. Councilmember Anderson seconded. Roll call vote: Councilmember Thompson - Yes, Councilmember Anderson - Yes, Councilmember Bean - Yes, Councilmember Waite - Yes. The motion carried. A letter from the City authorizing the crossing guard for the current school year will be prepared by City Staff. Johnson/Ammon Road Reouest for Rezone RP to RJ-A: A public hearing regarding the requested rezone was held before the Planning and Zoning Commission in June 2004. The Commission recommended the Council approve the rezone as requested by a vote of three for and two against. Steve Crandall of JAG Development addressed the Council with the request for rezone. Mr. Crandall and Brent Johnson answered the Council's questions regarding the request. The developers tated their intentions to develop independent elderly housing on this site. Council had considered adding restrictive language to the development agreement to ensure this intended use. It was decided that because of the relationships of the developers with the community, they could be relied upon to develop according to their stated intentions. Councilmember Waite motioned to approve the Johnson! Anunon Road request for rezone from RP to R3-A as presented. Bean seconded. Roll call vote: Councilmember Waite - Yes, Councilmember Bean - Yes, Councilmember Anderson - Yes, Councilmember Thompson - Yes. The motion carried. Peterson Park Plat Amendement: City Engineer Bill Manwill reported that Emergency Services has requested that the cul-de-sac named "Camelot Court" be renamed as Samual Street. City Council 10/07/2004 - 2 Councilmember Anderson motioned to amend the plat to change the cul-de-sac name from Camelot Court to Samuel Street. Councilmember Thompson seconded. Roll call vote: Councilmember Anderson - Yes, Councilmember Thompson - Yes, Councilmember Waite - Yes, Councilmember Bean - Yes. The motion carried. Floatin2 Holidav: City Administrator Bruce Rose asked that the Council approve November 26th, the day after Thanksgiving, as the date for the floating holiday to be taken by City employees. The Council approved the request. Miscellaneous Discussion Items: None Mayor Ard reported that the fire department, as well as dispatch and the Sheriff's office, have been experiencing problems with "dead spots" in the dispatch service area. The City of Ammon will be working with the Sheriff's office and the Dispatch Center to resolve the problem. Councilmember Bean motioned to adjourn. Councilmember Waite seconded.
