Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7:35 P.M. by Mayor George Wehmann with the following
City Officials present:

Others present during the meeting were Douglas Drury and students of a Bonneville High

The pledge of allegiance to the flag was conducted by Mayor Wehmann and the invocation
was offered by Councilman Rowberry. The minutes of the meeting on November 22, 1978,
were approved as prepared.
It was noted that J. R. Hayes, building contractor, was again not in attendance to pre-
sent whatever proposal he has in mind regarding the City's policy of charging for water
during construction.
Referring to a letter from the Mayor of the City of Soda Springs, Mayor Wehmann informed
the Council members about proposed legislation regarding the distribution of mineral
land funds.
Councilman Lee reviewed the November Fire Department report, which listed 11 responses
on Fire District calls, 3 of which were from chimney problems, and 3 calls in the City.
Councilman Rowberry reported that a claim against the City, estimated to be less than
$250,which resulted from an accident involving the garbage truck on the preceding day,
will be referred to the insurance company, and, inasmuch as the employee who. was driving
the truck at the time has an expired driver's license, he has been suspended from
operating any City vehicles and given 30 days to get a valid license. A suggestion to
change the regular meeting time to the first and third Thursdays, which was mentioned
by Councilman Rowberry, was discussed, and it was proposed that official action be
taken on this at the next meeting. In connection with the Idaho Falls powerline loop,
Councilman Rowberry made reference to the apparent intention of the Idaho Falls City
Council to approve the original route at its Thursday evening meeting, and Attorney
Anderson agreed to work with Mayor Wehmann to prepare a letter stating the position of
the City of Ammon with regard to this high transmission line going through the Ammon
impact area to be presented to the officials of the City of Idaho Falls after their
action is taken. A report on the Planning and Zoning Commission meeting made by
Councilman Rowberry noted that a recommendation to proceed with the annexation of the
Delmar Anderson property with initial zoning of RPA was passed by unanimous vote, and
the hearing on the Vera Lee property resulted in a decision to postpone action until
more information on the plans for the area is obtained. A public hearing before the
City Council on the Delmar Anderson property is to be held at 7:30 P.M. on Wednesday,
December 20, 1978.
Douglas Drury, of the firm of Forsgren, Perkins & Associates, appeared to deliver to
the City five copies of "An Annexation Plan for the Cities of Ammon, Iona, and Ucon"
which he had prepared with funds granted by the State Division of Budget and Policy
Planning, noting that five copies would also be presented to the Cities of Ucon and
Iona. It was pointed out that completing the study had taken a few weeks longer than
expected in order to obtain and incorporate the comments of officials of the three Cities,
and that the information in the "plan" is to be used as a guideline for future growth.
In response to an inquiry by Mayor Wehmann, Attorney Anderson reported that the hearings
on the Utah Power & Li ht Com an rate increase case are completed, and the Idaho Public
Utilities Commission has 0 days to make a decision.
Director of Public Works, Hayse L. Whiteley, told the Mayor and Council that a resident
picked up a form to file for expenses to repair a slight dent on the side of his camper,
which he claimed resulted from a City employee falling against the vehicle while collect-
ing garbage, and pictures of the alleged damage were displayed. Mr. Whiteley also
reported on the condition of city equipment, the snow and ice control operations, the
preparation of ice skating ponds, and the emergency generator repairs. He asked Engineer
Benton about the plastic water service lines which were put in by the developer on Rose
Dale Lane, and was given assurance that the product being used meets the specifications
approved by the City.
According to Councilman Swensen, Ron Parrish of Consolidated Agencies, Blackfoot, had
not kept an appointment which was set up to go over the City's new insurance policy,
so a review of the coverage is still needed.
Ordinance No. 171 was introduced and read by title:
"AN ORDINANCE CORRECTING AND AMENDING ORDINANCE NO. 167, OF THE CITY
OF AMMON, ANNEXING CERTAIN LANDS TO THE CITY OF AMMON, BONNEVILLE
COUNTY, IDAHO; TO CORRECT THE DESCRIPTION AS CONTAINED THEREIN;
HEREBY REAFFIRMING THE ANNEXATION OF SAID LANDS, DESCRIBING WITH
December 6, 1978
7R PARTICULARITY SAID LANDS SO ANNEXED AND HEREBY ANNEXED, AND DE-
CLARING SAID LANDS AS PART OF THE CITY OF AMMON, BONNEVILLE COUNTY,
IDAHO; REAFFIRMING THE DETERMINATION OF THE PROPER ZONING FOR
CLASSIFICATION OF THE ANNEXED LANDS AND TERRITORY UNDER THE ZONING
ORDINANCE OF THE CITY OF AMMON, IDAHO, AND PROVIDING FOR AN
EFFECTIVE DATE FOR THIS ORDINANCE."
Councilman Lee moved that the City Council dispense with the rule requiring the
reading of the ordinance on three different days and that the three readings be
waived. The motion was seconded by Councilman Rowberry; voting was Lee, yes; Row-
berry, yes; Swensen, yes; motion carried. The Ordinance was again read Qy title and
read in full. Councilman Lee moved to adopt Ordinance No. 171 as an ordinance of
the City of Ammon on its third and final reading. The motion was seconded by
Councilman Swensen; voting was Lee, yes; Swensen, yes; Rowberry, yes; motion carried,
and Ordinance No. 171 adopted.
With regard to street name signs,for new subdivisions, Engineer Benton mentioned a
business which makes and installs the signs, and it was indicated that, since all
recent annexation agreements require that developers are responsible for signs, they
should be provided with this information, but the City should deal with the County
when replacement signs are needed. In connection with the repair of streets in the
Jennie Jean area now that the Iona-Bonneville Sewer District construction is com-
pleted, Engineer Benton reported that the paving of Wanda Street east of Ross Avenue
is under contract, and the Sewer District officials are considering asking for
approval to put a I-inch overlay on the streets there next year instead of chip-
and-seal, which it is felt will make a better repair job, then it would be proposed
that the City lay a chip-and-seal coat sometime later. According to Engineer Ben-
ton, the Iona-Bonneville Sewer District may be able to make early payment in full
on the amount due the City of Ammon under the agreement which was signed several
months ago. Mayor Wehmann reminded Engineer Benton that the City still needs
maintenance manuals on Well #6 and the 17th Street storm sewer station.
The City Clerk's report listed miscellaneous claims to pay in the amount of
$4,510.62,and $10,179.00 payable on Local Improvement District No. 8 construction
for which an interim warrant has been issued to obtain funds. A statement showing
the cash balances in the various City funds was reviewed, and it was mentioned that
the annual audit is being completed.
Claims were approved for payment. It was moved by Councilman Lee and seconded by
Councilman Rowberry that the meeting adjourn; voting was all in favor; the meeting

Mayor Wehmann opened the meeting as a public hearing, as advertised, on the a?Dexation
and initial zoning of 63 acres of land known as the Delmar Anderson farm and In-
cluding the adjoining Union Pacific Railroad right of way, the property being
located immediately south of 17th Street, east of Jennie Jean Estates, and north of
Mountain Valley Estates. It was noted that the annexation process was initiated by
a written request received from Marvin Judd of D'Marco Investments Ltd., Provo, Utah,
who is the present owner. Planning and Zoning Chairman Jim McNett reported on the
hearing held before the Commission, which resulted in a unanimous recommendation to
annex with zoning of RPA. He noted that there was no one present from the public
at the meeting, and no objections were made to the proposal. In response to a
question by Councilwoman Dille about the street layout, Mayor Wehmann explained
that the developer has asked for annexation without platting and agrees to enter
in to a standard annexation agreement, which would be the same as the one for the
adjoining Mountain Valley Estates, and that when the platting is done, it will have
