Minutes of a Special Meeting of the Mayor and City Council:
The meeting was called to order at 7:50 P.M. by Mayor George Wehmann with the following
City Officials present:
Mayor George Wehmann
Councilman Russell N. Swensen
Councilwoman Carol A. Dille
Others present during the meeting were

Rt. 7 Box 5, D. Mark Ricks, 3125 Owen St., Steve
and Jerald Hansen, 3010 Rawson St.
The pledge of allegiance to the flag was conducted by Councilman Swensen; the invocation
was offered by Councilwoman Dille.
Mayor Wehmann announced that this was the time as advertised to hold a Public Hearing on
the plat and proposed zoning of Tie Breaker Village Division No.3 and remaining portion,
and it was determined that no adjacent property owners were present to make comment.
Garth Cunningham, representing the developer, displayed the plat and explained that the
request is to be annexed and zoned Rl. He noted that there has been very little change
in the portion under discussion since the original preliminary plat of the entire sub-
division was presented. The concern of the Planning and Zoning Commission regarding land
for a park (and a school, if needed) was mentioned, and Mr. Cunningham stated that he was
not prepared to say what arrangements can be made on that, but believed that the developer
was planning for 3 to 4 acres for this purpose in the last division, to be worked out when
the time comes, and requests that the City identify the location and size of a park area
that is desired. Mayor Wehmann pointed out that it was assumed that when the land to the
west of Tie Breaker Village is developed, adjoining land would be made available to add
to the proposed park and school site, and he commented that there has been no response
from the School District on what might be needed. Other items mentioned were that all
streets are 50 or 60 feet wide, and that the annexation agreement is to be much the same
as the one for Division No.2, including provisions for water meters. The Mayor and
Council members present indicated approval of the plat as presented for annexation and
zoning of Rl as recommended by the Planning and Zoning Commission, but acknowledged that
official action would have to be postponed until the regular meeting on June 7 due to the
lack of a quorum, and asked that the developer notify the City if there is any problem in
going ahead with this project since he failed to appear at this meeting as he had said he
would.
A Public Hearing on the preliminary plat and proposed zoning of West Ammon Estates was
opened for comment. David Benton, representing the developers, displayed the plat as
originally presented at the Planning Meeting on March 21, 1978, and explained that there
were people present at. that hearing who objected to some of the street layout, so revisions
are being suggested which are more agreeable to the property owner on the west, Derrald
Ricks, so that his property can be developed in an orderly way when desired. It was noted
that the request of the Planning Commission and the County that there be no access to
Sunnyside Road from lots has been taken into consideration. Council members specified
that Molen Street should go through on the plat so that the City has the option to open
it at a later date. Further discussion on the street layout brought comment from Mayor
Wehmann that this matter needs to be fully worked out between the developers and the ad-
jacent property owner so that a preliminary plat which is acceptable to the developers
can be presented for approval. Comments by the other citizens present, Steve and Cynthia
Pully and Jerald Hansen, were concerned with the size of the lots that border their pro-
perties along the east boundary of the proposed subdivision, which they felt were too small
in comparison to their lots, and a petition was presented to this effect signed by them-
selves and the' owners of six other parc€ls of land in that location. The Council recommend-
ed that the developers increase the frontage of the lots along the east boundary of West
Ammon Estates to somewhere near 120 feet and add to the depth of the lots also,if possible.
Engineer Benton pointed out that the developers request annexation and zoning of the entire
subdivision because of financing and to eliminate the need for further public hearings,
with development to be by divisions, and that Overlay 6 on the undeveloped portions, to
be removed as they are put into residential use, is being suggested so that the present
owner of the property can keep livestock animals there without a zoning problem. Regard-
ing these matters, the Mayor and Council felt that annexation of the entire area at this
time needed some more thought and that the owner could have animals until development is
started in the different arAaS nnder the grandfather clause or as a condition of the
annexation agreement. Approvalnh.the preliminary plat and zoning, as recommended by the
Planning and Zoning Commission, was postponed until the June 7 meeting for lack of a
quorum and to give the Council time for further study, and the developers were asked to
come back with a revised plat incorporating the changes as recommended.

recessed at 9:00 P.M.
