asked that the expenditures for Parks and Recreation be watched carefully because
we are close to budget.
Claims were approved.
Councilman Crandall moved to adj ourn the meeting, and the motion was seconded by

The Pledge of Allegiance to the Flag was directed by Councilman Anderson, and the
invocation was offered by Councilman Maes~r.
Mayor Ard opened the Public Hearing to consider the request of Deseret Mutual for
a rezone from RSC-l to C-l of the following described property:
Beginning at a point that is S 0011'23"E 40.00 feet along the Section
Line from the Northwest corner of Section 27, T. 2 N, R. 38 E.B.M. and
running thence S 0011' 23"E 745.00 feet to the North line of property
recorded as instument No. 489378, thence East along said North line
418.59 feet to the West bank of Sand Creek; thence along said West Bank
the next three courses, N 104l'43"E 411.74 feet; N 5027'06"E 110.20 feet;
N 80l9'04"E 124.33 feet; thence N 89026'05"W 163.19 feet; thence N
0033'55"E 76.15 feet to a point of curve with a radius of 20.00 feet;
thence to the right along said curve 31. 42 feet; thence N 89026' 05"W
319.47 feet to the point of beginning, containing 7.084 acres.
A Notice of Hearing was published in the Post-Register on May 19, 1992, and radio-
television stations, the City of Idaho Falls, and property owners within 300 feet
were mailed notices. No citizens or other interested parties attended the hearing.
Ray Blake, representing the developer, and Kirk Black, representing Deseret Mutual,
were sworn in by Mayor Ard to present testimony. The Planning and Zoning Commission
recommended approval of the zone change. Mayor Ard called for questions.
Councilman Crandall asked about the status with the City of Idaho Falls regarding
access on to Hitt Road. Mayor Ard discussed the issue with Mayor Campbell and
Councilman Larry Carlson. He asked Idaho Falls to outline their plans for Hitt Road
so that Ammon could develop with equal access. He was encouraged to work with
Councilman Carlson. Idaho Falls Public Works Director Chad Stanger has been
negative about any access on the Ammon side.
Ray Blake discussed project plans. The property contains seven acres and is owned
by Deseret Mutual. Several years ago the property was considered for development,
but the timing did not seem right. Over the past six months, a number of maj or
retailers has expressed interest. In fact, more retailers are interested in the
project than there is land. A master plan for the area should include the trailer
park which is under different ownership. Preliminary plans are for 75,000 square
feet of retail space, but access on to Hitt Road is crucial. So far, Idaho Falls
has been reluctant to grant Hitt Road access.

Councilman Hall asked for a detai ed property location. Councilman Crandall asked
if the developer was aware of the water and sewer easements which would involve
costs to change. The developer a ssured the City that such details could be worked
out. Mayor Ard closed the Public earing.
Councilman Maeser moved to appro e the zone change from RSC-l to C-l for Deseret
Mutual on propert located on the southeast corner of the intersection of Hitt Road
and East 17th Street. The motio was seconded by Councilman Crandall. Roll call
vote: Maeser - Yes; Crandall - Ye ; Anderson - Yes; Hall - Yes. The motion carried
unanimously. Deseret Mutual agree to bring back a master plan to the City of Ammon
and Mayor Ard will work with the City of Idaho Falls on an administrative level
regarding Hitt Road access. I
Russell Swensen, former Mayor, stt,ted that he was very upset as he traveled around
the valley that Hamer, Monteview, Chester, Newdale, Teton, Pingree, Swan Valley,
Irwin, Firth, Roberts, Lewisville, and Ririe all have new post offices, but Ammon
with a population of 5000 can n~t even have a branch post office. Recently the
branch at Dimple's was moved to Digital Doohickeys in Idaho Falls. He asked for
input from the City Council about postal service in Ammon. Swensen believes Ammon
is deserving of a post office, nd he plans to pursue the issue unless the City
Council objects. The Council agre d to suppor Swensen's efforts.

Richard Birch, 2865 South Ammon Road, expressed a desire to proceed with
construction of his residence, but he is faced with several problems. Progressive
Irrigation will not let Birch cut the canal to connect to the sewer until the water
is out of the canal. He requested approval from the City of Ammon to install a
temporary 1500 gallon holding tank to handle sewage until such time as the sewer
can be installed. The Environmental Health Department has been contacted, and they
do not have a problem with a temporary holding tank provided the City of Ammon
grants written approval. The Council agreed to write a letter of approval
specifying a time limitation to be established by the City when the installation
can be made. A second problem is access. It is costly to build a bridge across
the canal which will be eliminated when Ammon Road construction takes place. Birch
would like to access from the back of his lot by way of the Pony Acres bridal path.
The City does not have authority to grant use of the bridal path. Individual
property owners need to give their approval. A third request was to live in a self-
contained travel trailer until construction of the house is complete enough for the
building inspector to grant occupancy. City code 11-5-16 allows a trailer house
in connection with construction. Questions were answered concerning the
installation of the water service line.
Councilman Hall moved to approve the minutes for City Council Meeting held May 21,
1992, as written. The motion was seconded by Councilman Maeser. Roll call vote:
Hall - Yes; Maeser - Yes; Anderson - Yes; Crandall - Yes. The motion carried
unanimously.
Homeowners on Mason Street in Mountain Valley Estates Division No. 1 (First Amended
Plat) are concerned with a building permit application for a large storage garage
on Lot 24, Block 3 of the subdivision. Protective covenants are between the
developer and the homeowners. The City is only involved with zoning requirements.
Bonneville Land and Title Company has prepared a title report on the property to
be deeded to the City by Robert Suitter for Tie Breaker Park. As soon as the report
is reviewed and approved, a closing date will be set to transfer ownership.
The Association of Idaho Cities Annual Conference is scheduled for June 17 through
June 20 in Boise.
According to Forsgren Associates, work on Ammon Road right-of-way acquisition is
progressing. They will keep the City informed of needed action.
Fireworks permits will be issued to Kmart (inside of the store), Stephen and Tanice
Anderson (stand in Rush Auto parking lot), and Perry and Rita Graves (stand in Kmart
parking lot) following inspection by the Fire Department.

The swimming pool is up and running. For some reason, the pool is loosing a small
amount of water, but otherwise everything appears to be operating satisfactorily.
The pool cover is beneficial. Preliminary instruction for specialized groups is
under way. The pool will be open to the public on June 13 with the first lesson
session to begin June 15. Free passes to the pool are to be authorized by the

Mayor. The Mayor encouraged the City Council to visit the pool occasionally to
observe the operations.
Francis Lee, a former City Councilman, died recently, and the Council authorized a
sympathy bouquet to be sent to his family.
Councilman Maeser requested Public Works Director Wadsworth to follow through on
striping East 17th Street.
City Clerk Jensen reported the City of Idaho Falls enters into an agreement with
Wakenhut Corporation for school crossing guards. The City of Idaho Falls Fire
Department requires companies or individuals to obtain a permit to use water from
fire hydrants. Claims were approved.
Councilman Hall moved to adj ourn the meeting, and the motion was seconded by
Councilman Crandall. The meeting was adjourned at 8:55 P.M.

Brenda Hatch, 3200 Midway, discussed the community recycling project scheduled for
June 20 at McCowin Park. She requested the City to place two dumpsters by the
collection area. This will be a trial run to determine the benefit and interest.
The volunteer group involved with Mrs. Hatch will evaluate whether or not to continue
such a project.
Property owners in First Amended Plat of Mountain Valley Estates, Division No. 1 have
obtained legal counsel and filed an appeal of Building Permit No. B92-33 issued to
Robert Oyler to build a storage garage on Lot 24, Block 3. A formal hearing before
the Board of Adjustment has been advertised for Thursday, July 2, at 7:30 P.M.
Council President Maeser advised that no action would be taken on the appeal until
after the July 2nd hearing, but he gave the citizens present an opportunity to
express their thoughts.
