Consideration of Groundwater Right Purchase Agreement

Recommendation
-Review purchase agreement and if there are no changes, approve the agreement. The purchase
agreement will be handed out at the meeting.
Summary of Analysis
1.The City of Ammon currently has enough groundwater rights to supply drinking water and
irrigation water to all residents.
2.As the City of Ammon grows, additional groundwater rights will be needed to supply water to
new subdivisions. These groundwater rights must be acquired from existing owners of
groundwater rights.
3.The City of Ammon requires all new annexations to donate groundwater rights or contribute fees
in lieu of groundwater rights to the City of Ammon.
4.The agreement under consideration allows the City of Ammon to acquire groundwater rights by
entering into a contract with Idaho Water Company LLC to purchase groundwater rights that are
currently available on the market.
5.Idaho Water Company LLC is represented by Del Kohtz.
Financial Impact
-The City has reserved funding for purchase of groundwater rights. However, this funding is in
reserves and not budgeted in the current fiscal year. The budget would need to be reopened to
make this purchase.
