HILLCREST HIGH SCHOOL
BOYS BASKETBALL STATE CHAMPIONS DAY
WHEREAS, Hillcrest High School Boys Basketball has won the Idaho 4A State Championship;
and
WHEREAS, in doing so, Head Coach Dave Austin provided great leadership, and supported
and encouraged the talents of all of the players on the Hillcrest team; and
WHEREAS, on Saturday, March 5, 2022, the Hillcrest High School Boys Basketball team
finished their exemplary season by defeating Pocatello High School, 76-46, at the
4A State Championship Title game, ending with a 25-2 record; and
WHEREAS, the City of Ammon commends the Hillcrest Boys Basketball team for their
teamwork, grit, athleticism, sportsmanship, dedication to talent, and determination
to win, which reflects well on our entire community.
NOW, THEREFORE, I, Sean Coletti, Mayor of the City of Ammon, do hereby proclaim:

Summary of Analysis
1.In accordance with Idaho Code 67-2806(2), the City of Ammon published a Request for Bids on
January 14 and January 28, 2022 for providing maintenance services to our public parks.

single park or for several parks. The City of Ammon reserves the right to choose multiple

3.In response to the Request for Bids, the City received three bids. Two bids were for maintaining
all public parks and the third bid was for maintaining only the smaller public parks.
4.The bids are summarized as follows:
- B & K Lawn and Landscaping:$134,724.75 for all public parks
- All American Yards Inc.:$223,325.00 for all public parks
- T and T Lawn Services:$46,050.00
5.The bid evaluation committee has met and reviewed all bids. Based on the bids submitted, the
committee is recommending that the City award the bid to the low bidder, B & K Lawn and
Landscaping and reject all other bids.
6.The proposed contract has been reviewed and approved by both the City Attorney, Scott Hall,
and B & K Professional Services (Morgan Martin). The contract is recommended for approval.
Financial Impact
-Contracting park maintenance will have a net positive benefit of $25,767.00 on the Parks
Department. This amount can be saved and added to Fund Balance or reallocated to areas.
-The primary cost savings occur in labor, benefits, and in hiring seasonal assistance.

INDEPENDENT CONTRACTOR AGREEMENT
between
CITY OF AMMON
AND
B&K PROFESSIONAL SERVICES INC.
THIS AGREEMENT made between the CITY OF AMMON a municipal subdivision of
the State of Idaho, herein "CITY" and B&K Professional Services Inc. herein
"CONTRACTOR",
THE PARTIES AGREE AS FOLLOWS:
1.CONTRACT. CITY hereby employs CONTRACTOR as an independentcontractor to
complete and perform the following project and work:
a.CONTRACTOR will provide lawn services to the City of Ammon at public
parks. Lawn services shall include, but are not limited to, mowing, trimming,
blowing, edging, debris removal, weed management, and other similar landscape
services that may be reasonably required to maintain the public parks required by
this agreement. CONTRACT will provide lawn services to the following public
parks owned by the City of Ammon:
i.McCowin North
ii.McCowin South
iii.Peterson
iv.Eagle Pointe
v.Woodland Hills
vi.Woodland Hills Sports
vii.Complex
viii.Target
ix.Hawks
x.Landing
xi.Lions

b.CONTRACTOR shall provide services during the active growing season
beginning approximately April 1, 2022 and commencing approximately on
October 31, 2022. This service includes weekly lawn services and sprinkler
system activation and deactivation.
c.EXCLUSIONS. CONTRACTOR shall not be responsible for the following:
i.Replacement of trees, shrubs or other plants which are lost to casualty
such as theft, aberrant weather, or disease.

ii.Weed whipping around trees which do not have a physical barrier of at
least twelve (12) inches around the base of the tree (i.e. steel or concrete
edging) to prevent any damage to the tree.
iii.Personal items or obstacles in the service area being mowed.
iv.Fungus, disease, or other issues that the vegetation may have had.
v.Broken or damaged sprinkler system components.
d.Any additions or deletions to this contract will only be permitted pursuant to an
authorized and fully executed change order signed by both the CITY and
CONTRACTOR.
2.TIME OF PERFORMANCE AND TERMINATION: Parties agreethat:
a.CONTRACTOR will commence work on the project on April 1, 2022. This
agreement may be terminated by providing 90 days written notice by either party.
3.COMPENSATION: CITY agrees to pay CONTRACTOR as compensation:
a.The total sum of $134,724.75, for services rendered during calendar year 2022
which shall be payable to CONTRACTOR no later than 21 days after receipt of
an invoice from CONTRACTOR. At CONTRACTOR’S discretion, invoices may
be submitted to the CITY monthly, after the commencement of services.
b.CONTRACTOR shall provide sprinkler irrigation repair services at a rate of
$70.00 per man hour, plus any parts required for the repair. Sprinkler repairs may
be invoiced simultaneously with other invoices but must be clearly identified on
the invoice.
4.TERM OF AGREEMENT. The term of this agreement is 12months, beginning April 1,
2022 and terminating March 31, 2023. Agreement shall automatically renew for one
additional 12 month term unless terminated by either party according to Section 2 of this
agreement.
5.INDEPENDENT CONTRACTOR: The parties agree that CONTRACTORis the
independent contractor of CITY and in no way an employee or agent of CITY and is not
entitled to worker’s compensation or any benefit of employment with the CITY. CITY
shall have no control over the performance of this Agreement by CONTRACTOR or its
employees, except to specify the time and place of performance, and the results achieved.
CITY shall have no responsibility for security or protection of CONTRACTOR' S
supplies or equipment. CONTRACTOR agrees to pay and be responsible for all taxes
due from the compensation received under this contract.
6.WARRANTY: CONTRACTOR warrants that all materialsand goods supplied under
this Agreement shall be of good merchantable quality and that all services will be
performed in a good workmanlike manner. CONTRACTOR acknowledges that it will be
liable for any breach of this warranty. CONTRACTOR warrants all work for a period of
twelve (12) months following completion.

7.INDEMNIFICATION: CONTRACTOR agrees to indemnify, defend and hold harmless
CITY, and its officers, agents and employees, from and against any and all claims, losses,
actions, or judgments for damages or injury to persons or property arising out of or in
connection with the act and/or any performances or activities of CONTRACTOR,
CONTRACTOR' s agents, employees or representatives under this Agreement.
8.INSURANCE: CONTRACTOR agrees to obtain and keep inforce during its acts under
this Agreement a comprehensive general liability insurance policy in the minimum
amount of $2,000,000, which shall name and protect CONTRACTOR, all
CONTRACTOR' S employees, CITY, and its officers, agents and employees, from and
against any and all claims, losses, actions and judgments for damages or injury to persons
or property arising out of or in connection with the CONTRACTOR'S acts;
CONTRACTOR shall provide proof of liability coverage as set forth above to CITY
prior to commencing its performance as herein provided, and require insurer to notify
CITY ten (10) days prior to cancellation of said policy. CONTRACTOR warrants it is
adequately insured for injuries to its employees or others incurring loss or injury as a
result of the acts of CONTRACTOR or its employees or subcontractors and certificate of
insurance and worker’s compensation insurance shall be required by CONTRACTOR
and all subcontractors of CONTRACTOR
9.WORKERS COMPENSATION: CONTRACTOR shall maintain infull force and effect
worker's compensation for CONTRACTOR and any agents, employees, and staff that the
CONTRACTOR (including owners of CONTRACTOR) may employ, and provide proof
to CITY of such coverage or that such workers compensation insurance is not required
under the circumstances.
10.COMPLIANCE WITH LAWS: CONTRACTOR agrees to complywith all federal, state,
city and local laws, rules and regulations.
11.ENTIRE AGREEMENT: This is the entire agreement ofthe parties and can only be
modified or amended in writing by the parties.
12.ATTORNEY FEES. Reasonable attorney fees shall be awardedto the prevailing party in
any action to enforce this Agreement or to declare forfeiture or termination of this
Agreement.
13.CONDITION. CONTRACTOR agrees to remove all debrisand leave the premises in a
clean condition.
14.PERMITS. CONTRACTOR shall, at its own expense, obtainall permits necessary for
the work to be performed.
15.LICENSING. Because the work as provided for in thisAgreement is a public work
project, all work shall be performed by individuals duly licensed and authorized by law to

perform such work pursuant to the laws of the State of Idaho. Copies of all such licenses
shall be provided to CITY.
16.COMPLIANCE. All work shall be completed in a workmanlikemanner and in
compliance with all building codes or other applicable laws, specifications, etc.
17.SUBCONTRACTOR. This Independent Contractor Agreementdoes not create in any
form or measure a contract between CITY and any subcontractor of CONTRACTOR
herein. Payment to any subcontractor of CONTRACTOR for work performed by any
subcontractor of CONTRACTOR shall be paid by CONTRACTOR. To the extent
deemed necessary, CITY may jointly pay any payment to CONTRACTOR and
CONTRACTOR’S subcontractors.
18.ANTI-BOYCOTT AGAINST ISRAEL CERTIFICATION. CONTRACTORhereby
certifies pursuant to Section 67-2346, Idaho Code, that the CONTRACTORr, its wholly
owned subsidiaries, majority owned subsidiaries, parent companies and affiliates, are not
currently engaged in, and will not for the duration of this Agreement, knowingly engage
in, a boycott of goods or services from Israel or territories under its control.

Summary of Analysis
1.In accordance with Idaho Code 67-2806(2), the City of Ammon published a Request for Bids on
February 8 and February 15, 2022 for providing janitorial services at City Hall, the Technology
Building, and at the Parks Building.

professionals for janitorial services at three (3) city facilities. The three facilities that require
janitorial services are the following: 1) City Hall - 2135 S. Ammon Rd; 2) Technology Building -
3453 Ard Dr.; and 3) Parks Building - 3270 Molen St.
3.In response to the Request for Bids, the City received four bids.
4.The bids are summarized as follows:
-Ace Janitorial$36,000 (all services provided)
-Munns Vacancy 1$14,400 (city to provide supplies and equipment
-Munns Vacancy 2$15,600 (all services provided)
-Night Owl Services$18,900 (all services provided)
5.The bid evaluation committee has met and reviewed all bids. Based on the bids submitted, the
committee is recommending that the City award the bid to the low bidder, Munns Vacancy
Cleaning and reject all other bids.
6.The attached contract has been reviewed by both City Attorney Scott Hall and Brittianie Munns,
owner of Munns Vacancy Cleaning. The draft contract is recommended.
Financial Impact
-Janitorial services are not a budget expense in the current budget. These services have been
provided by a city employee for many years and this employee is now retiring. When the FY22
budget was drafted in May 2021, this was not known.
-All departments in City Hall will share the expenses of the janitorial contract. The Technology
Department and Parks Department will pay their portions of the cleaning contract.

THIS AGREEMENT made between the CITY OF AMMON a municipal subdivision of
the State of Idaho, herein "CITY" and Munns Vacancy Cleaning LLC herein "CONTRACTOR",
THE PARTIES AGREE AS FOLLOWS:
1.CONTRACT. CITY hereby employs CONTRACTOR as an independentcontractor to
complete and perform the following project and work:
a.The following CITY facilities will be cleaned twice weekly:
i.City Hall - 2135 S. Ammon Rd
ii.Technology Building - 3453 Ard Dr.
iii.Parks Building 3270 Molen St.
b.The following janitorial services will be provided at each location listed above:
i.Clean and sanitize restrooms, clean toilets, stalls, sinks, hand dryers,
mirrors, fill paper towels, soap dispensers, toilet paper and change sanitary
containers.
ii.Sweep and mop all hard floors in commons areas and restrooms
iii.Mop chair mats as needed
iv.Wipe down customer service areas, counters and exposed desktops
v.Clean glass at entryways, customer service counter and window cleaning
as needed
vi.Dust photos, awards and pictures in all common areas
vii.Empty garbage in all restrooms, workspaces, and common areas, changing
bags as needed
viii.Gather recycling and empty in recycling bins
ix.Vacuum all carpeted surfaces including back entryways, stairwells and
rugs.
x.Organize meeting spaces as needed
xi.High dusting around vents, corners and high ceilings and light fixtures as
needed
xii.Outside entry cobweb removal as needed.
xiii.General cleaning of all other areas as may be necessary but not
specifically listed here.
c.CONTRACTOR agrees to provide all materials and services for the project in
accordance with the attached written specifications.

authorized and fully executed change order signed by both the CITY and
