A. CALL TO ORDER: Mayor Sean Coletti opened the meeting at 7:00 p.m. at the Ammon City Hall located at
2135 South Ammon Road. Council Member Thompson led the Pledge of Allegiance and Council Member
Wessel offered a prayer.

1. Consent to Appointment George Vander Meer Ammon City Council
Mayor Coletti introduced George Vander Meer to Council and recommended his appointment to City
Council to fill the vacant seat. Mr. Vander Meer would serve until the next regular election,
November 2023, at which time the seat would open for an election to finish out the final two years of
the term before returning to a four-year term in 2025. Mr. Vander Meer expressed his excitement for
the opportunity and that he was looking forward to working with everyone.

It was moved by Council Member Slack and seconded by Council Member Thompson to approve the appointment
of George Vander Meer to the Ammon City Council. Motion passes unanimously with vote by roll call
2. Contract for Services Enterprise Vehicle Leasing (Micah Austin, City Administrator)
City Administrator Austin introduced Rob Dillon from Enterprise to discuss the contract. Council
discussed the updated contract price and vehicle options and asked for clarifications on the changes
to the contract and number and type of vehicles being requested. Austin noted that the updated
contract included upgrades to vehicles to better suit the needs of Public Works.
Recommendation
- Approval of lease agreement
Summary of Analysis
1. On December 9, 2021, representatives from Enterprise Lease Management, Inc, presented to
the City Council a proposal to lease six (6) service vehicles to the City of Ammon. Based on that
discussion, the City Council directed staff to obtain a lease agreement with Enterprise Lease
Management, Inc. That lease agreement is up for approval at this meeting.
2. Scott Hall, City Attorney, has reviewed the lease agreement and made several revisions and
amendments. The current agreement re
3. The total annual amount for the lease agreement is $49,800.75.
4. The lease agreement is renewable on an annual basis.
5. The City of Ammon can terminate the agreement at any time.
Financial Impact
- The total annual amount is $49,800.75.
- The costs for this lease will be covered by the department to which the vehicle is assigned.

3. Contract for Services Ammon Arts (Micah Austin, City Administrator)
City Administrator Austin introduced Thea Disney to Council for the annual review of the contract for
request is in the amount of $1,200 for three productions to be
put on by the group.
Recommendation
- Approval of the request.
Summary of Analysis
1. The Ammon Arts Community Theater, Inc, is requesting $1,200 from the City of Ammon for
production of a live theater event that would occur during FY 2022
2. Ammon Arts Community Theater plans to produce three theater productions during 2021. All
productions will be open to the public, but tickets will be sold.
3. According to the proposal submitted by the Ammon Arts Community Theater, the funds will be

budget to pay for this expense.
It was moved by Council Member Slack and seconded by Council Member Wessel to approve the contract with
Ammon Arts Community Theatre in the amount of $1,200. Motion passes unanimously with vote by roll call
4. Contract for Services Resin Architecture (Micah Austin, City Administrator)
City Administrator Austin reviewed the contents of the contract and the next steps in the design and
development process. Austin introduced Johnathon Gallup of Resin Architecture to review details.
Council and Staff discussed the contract and process to completion. Gallup explained that project
parameters had suggested a building cost of approximately $1,000,000 resulting in contracting fees
of approximately 10%. Gallup explained the proposed designs for a main level building around 3,000
square feet with options for an unfinished basement space.
Recommendation
- Approval of contract as presented.
Summary of Analysis
1. On November 5, 2021, according to Idaho Code 67-2320(2), the City of Ammon advertised for
design services for a remodel and expansion of City Hall through issuance of Request for
Proposals (RFP)
2. The RFP was published twice, according to Idaho Code 67-2320(2).
3. The City received two responses to the RFP: Resin Architecture and Hummel Architects.
4. Based on the criteria published in the RFP, Resin Architecture was recommended to the City
Council for the design contract.
5. The proposed contract outlines seven phases of the project as follows:
1. Programming/Needs Assessment
2. Concept Design
3. Public Input / Community Work Session
4. Schematic Design Set
5. Design Development Set
6. Final Construction Document Set
7. Construction Administration Services
6. The total contract amount is not to exceed $105,250.00 for all seven phases.
7. This project is listed in the Strategic Plan as a top priority.
Financial Impact
- The GL Account for this expense is 10-408-700. $50,000 is currently budgeted for this project in
this line item in FY22.
- The total contract amount is not to exceed $105,250.00. This amount would be distributed over
two fiscal years.
- When the budget was established for this project in May 2021, the total contract cost was not
known.

5. Contract for Services BIRD eScooters (Micah Austin, City Administrator)
City Administrator Austin reviewed the final MOU with BIRD as it was being presented. Council asked
minimal, if none at all, except for the processing of a Business License.
Recommendation
- Approval of MOU as presented.
Summary of Analysis
1. BIRD Scooters, represented by Julianne Roller, is requesting a business license to operate in the
City of Ammon.
2. BIRD would be a unique business in Ammon because they operate entirely within the public
ROW.
3. In order to operate their business in the public ROW, BIRD is proposing the attached
Memorandum of Understanding (MOU).
4. Among other things, the MOU indemnifies the City of Ammon from all activities related to the
operation of the BIRD business.
5. City Attorney, Scott Hall, has reviewed the MOU and his changes are reflected.
6. The MOU was presented and discussed to the City Council on January 13, 2022. After that
discussion, the City Council directed staff to bring the MOU to the City on January 20, 2022 for
approval.
Financial Impact
- There is no financial obligation with the proposed MOU.

6. Final Plat Curlew Bend (Cindy Donovan, City Planner)
City Planner Cindy Donovan reviewed the layout of the plat with discussion of entrance/exit location
and access to the development.
Compliance
- Application is in compliance with 10-29-8 Requirements for a Final Plat, 10-35 Multi-Use Zone, and
10-5-26 Allowed Uses in Multi-Use Zone
Summary of Analysis
1. Rezone of the property was approved by the City Council on March 18, 2021.
2. Conditional Rezone Agreement with current developer was approved by the City Council on August
19, 2021.
3. Design Review was approved by the City Council on December 2, 2021.
4. Preliminary Plat was approved by the City Council on January 6, 2022.
5. Development Agreement includes: a maximum of 61 dwelling units, lighting to meet the
specification in the International Dark Sky Association guidelines, a minimum of 10,000 square feet of
commercial space with a maximum of two stories, participation in park and open space

7. Development Agreement Curlew Bend (Cindy Donovan, City Planner)
Donovan reviewed the special conditions within the agreement noting that each condition related to
conditions within the conditional rezone agreement approved previously. Council discussed water to
the property noting that the development agreement indicated the need for pressurized irrigation
systems as well as plans to develop and complete connecting roads in the area.

Agreement for Curlew Bend with amendments to add clarifications regarding sidewalk construction in Special

8. Final Plat Brick Estates (Cindy Donovan, City Planner)
Donovan reviewed the details of the plat including minor changes that had come forward since the
preliminary.

PARTICULARITY SAID LANDS TO BE ANNEXED AND ZONED AND
HEREBY ANNEX AND ZONE AND DECLARING SAID LANDS A PART OF
THE CITY OF AMMON, BONNEVILLE COUNTY, IDAHO; DETERMINING
THE PROPER ZONING FOR CLASSIFICATION OF THE ANNEXED LANDS
AND TERRITORY UNDER THE ZONING ORDINANCE OF THE CITY OF
AMMON, IDAHO; PROVIDING FOR AN EFFECTIVE DATE FOR THIS

AMMON, IDAHO THAT:
WHEREAS, the land and property hereinafter described is contiguous and adjacent to the
city boundaries of the City of Ammon, Bonneville County, Idaho, and the City has received a
petition to annex said property to the City of Ammon and the property is subject to annexation
pursuant to the provisions of the Idaho Code; and,
WHEREAS, public hearing #2018-017 was held before the Planning and Zoning
Commission of the City of Ammon, on November 7, 2018 following proper legal requirements
for advertisement of the hearing and recommendations were received from the Planning and
Zoning Commission, and
WHEREAS, the City Council of the City of Ammon has determined that it was not
necessary to hold a public hearing before the City Council on the request for annexation and the
City Council can act upon the public hearing and recommendation of the Ammon Planning and
Zoning Commission.

NOW THEREFORE, be it hereby ordained by the Mayor and City Council of the City of
Ammon:
Section 1.
(1) The City Council did adopt the recommendations from the Planning and Zoning
Commission as its findings of fact.
(2) That the City Council has determined that it is not necessary to hold a public hearing
before the City Council and under the authority of Idaho Code Section 67-6509 have declined to
do so in this request for annexation and initial zoning.
(3) That the property to be annexed is contiguous and adjacent to the City of Ammon and is
subject to annexation to the City of Ammon.
(4) That the zoning classification of R-1 will be compatible with the comprehensive plan.
Section 2.

be and the same hereby is annexed to the City of Ammon, Idaho and is declared to be within the
