APPENDIX C REGULATORY INFORMATION Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 3 EXECUTIVE SUMMARY True North Environmental, LLC has performed a Phase I Environmental Site Assessment (ESA) examining the environmental conditions at the subject property located along E 49th S in Ammon, Idaho. This Phase I Environmental Site Assessment has been performed in conformance with the scope and limitations of ASTM Practice E 1527-13, and the Detailed Scope-of-Services section of our project proposal. Conclusions and Recommendations are presented in Section 10.0 of this report. This Phase I Environmental Site Assessment has revealed no evidence of Recognized Environmental Conditions (RECs) associated with the Subject Property. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 4 1.0 INTRODUCTION The Phase I Environmental Site Assessment (ESA) was performed in general accordance with ASTM E1527-13 by True North Environmental, LLC for a potential real estate transaction. True North Environmental, LLC conducted this Phase I ESA for the two contiguous parcels located along E 49th South in Ammon, Idaho as presented on Figure 1 (Property). The approximately 240- acre agricultural use parcels are identified by the Bonneville County Assessor’s office as parcel numbers RP02N38E347221 & RP01N38E030049. The Phase I ESA was performed for Stout Investment Group, who is also considered the Client/User of this Phase I ESA report. 1.1 PURPOSE This purpose of this Phase I ESA is to assist the User in developing information to identify current and historical recognized environmental conditions (RECs) in connection with the Property as reflected by the scope of this report. The ASTM Standard E1527-13 states: “This practice is intended for use on a voluntary basis by parties who wish to assess the environmental condition of commercial real estate taking into account commonly known and reasonably ascertainable information. While use of this practice is intended to constitute all appropriate inquiry for the purposes of LLP [landowner liability protection], it is not intended that its use be limited to that purpose. This practice is intended primarily as an approach to conducting an inquiry designed to identify recognized environmental conditions in connection with a property.” The ASTM Standard E1527-13 defines a REC as: "The presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.” The term is not intended to include de minims conditions, defined as: “A condition that generally does not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies.” 1.2 SCOPE OF SERVICES The scope-of-services for this project was defined by our proposal dated October 14, 2021. The scope for this Phase I ESA included a regulatory database review, historical and physical records review, interviews, visual reconnaissance of the Property and adjoining properties, and report preparation. The Phase I ESA was performed in conformance with the guidance of ASTM standard E1527-13 and All Appropriate Inquiry (AAI). No special terms and conditions were incorporated for this Phase I ESA. Three figures are attached to this report including Figure 1, which shows the regional location of the Property, Figure 2, which is a portion of the United States Geological Survey (USGS) Topographic Quadrangle map of the general vicinity of the Property, and Figure 3, which presents a site sketch of the Property layout and site features. Photographs of the site that were taken on October 28, 2021, the date of the site inspection, are included in Appendix A. Historical information collected during the performance of this ESA is included in Appendix B. Regulatory information and the Bonneville County assessor's tax map image of the site and surrounding area is included in Appendix C. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 5 1.3 SIGNIFICANT ASSUMPTIONS True North Environmental, LLC assumes the following:  That the User will read this report in its entirety.  That all information obtained during the performance of this ESA is correct and complete.  That the client and current Property owner and/or occupants have provided True North Environmental, LLC with all reasonably ascertainable information available regarding the subject property.  Local ground water flow directions are assumed based upon published information, and our knowledge of the local geology, topography and hydrology. No underground excavations or site-specific subsurface analyses were performed as a part of this Phase I ESA. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 6 2.0 RELIANCE, LIMITATIONS AND DATA GAPS 2.1 RELIANCE This report is an instrument of service of True North Environmental, LLC and includes limited research, a review of specified and reasonably ascertainable information and a site visit to the Property to identify RECs in general accordance with ASTM Standard E 1527-13. This True North Environmental, LLC Phase I ESA was performed in accordance with generally accepted practices of the profession undertaken in similar studies at the same time and in the same geographical area, and True North Environmental, LLC observed that degree of care and skill generally exercised by the profession under similar circumstances and conditions. The scope of services and the report have been completed on behalf of and for the exclusive use of the User, solely for their use and reliance in the assessment of this Property. The User is the only party to which True North Environmental, LLC has explained the risks involved and which have been involved in the shaping of the scope of services needed to satisfactorily manage those risks, if any, from the User’s point of view. Accordingly, reliance on this report by any other party may involve assumptions whose extent and nature lead to a distorted meaning and impact of the findings and opinions related herein. The findings and opinions by True North Environmental, LLC related in this report may not be relied upon by any party except the User without the consent of the User and True North Environmental, LLC. TNE may be available to contract with other parties to develop findings and opinions related specifically to such other parties’ unique risk management concerns related to the Property. 2.2 LIMITATIONS This report was prepared for the sole use of the User (as described in Section 1.0 above). The reliance on and use of this report by the User shall be governed exclusively by the limitations and exceptions found in the report and the agreement between the User and True North Environmental, LLC. This report was prepared based on review of limited data, as described herein, in accordance with generally accepted professional practices, applicable to work of similar nature and complexity of similar localities, at the time the services were performed. No warranty, expressed or implied, is made. The scope of this report is limited in nature and intended to provide a preliminary evaluation of the current readily observable/obvious environmental conditions at the Property at the time of the report preparation and does not constitute definitive or in-depth review of all the potential environmental impairments and situations. True North Environmental, LLC assumes no responsibility for conditions of which it is unaware and/or as to which there was no opportunity or request for review. It is important to recognize that even the most comprehensive scope of services may not detect all the environmental liabilities at a particular property. Therefore, nothing herein shall be construed as a representation or certification that the Property is either fully characterized or is free of environmental impairments and/or contamination. In order to conduct the investigation for this report, True North Environmental, LLC relied upon readily available information, as discussed in the report, and unless explicitly included in our scope, included no verification of the accuracy or completeness of documentation or data or possible withholding of information by the interviewees, agencies, or other parties. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 7 The ASTM E1527-13 Standard provides that a Phase I ESA completed less than 180 days prior to the date of the intended transaction is presumed to be valid. A Phase I ESA for which the information was collected or updated within one year prior to the transaction may be used provided that the following components were conducted or updated within 180 days of the date of the transaction:  Interviews with owners, operators, and occupants;  Searches for recorded environmental cleanup liens;  Reviews of applicable federal, tribal, state and local government records;  Visual inspections of the Property and of adjoining properties; and  The declaration by the Environmental Professional responsible for the ESA or update. 2.3 DATA GAPS The ASTM Standard E1527-13 defines a data gap as: “a lack or inability to obtain information required by this practice despite good faith efforts by the environmental professional to gather such information. Data gaps may result from incompleteness in any of the activities required by this practice, including but not limited to site reconnaissance…and interviews” The following data gaps were encountered for this Phase I ESA.  A completed version of the User Provided Questionnaire was not returned to True North Environmental for evaluation.  The current property owners were not available for a formal interview. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 8 3.0 USER PROVIDED INFORMATION Section 6 of ASTM Standard E1527-13 describes the tasks to be performed by the User in order to comply with the All Appropriate Inquiries (AAI) Final Rule (40 CFR Part 312). These tasks include review of title and judicial records for environmental liens and activity and use limitations (AULs), specialized and actual knowledge of the User, reason for significantly lower purchase price, and commonly known or reasonably ascertainable information. Results of an environmental lien and AUL search and User provided questionnaire are provided below. 3.1 ENVIRONMENTAL LIEN The User and Owner did not identify environmental liens or activity and use limitations (AULs) that are currently recorded against the property. ASTM E1527-13 requires that Users report any environmental liens or activity and use limitations to True North Environmental, LLC, which is the environmental professional conducting the Phase I ESA for the Property. True North Environmental, LLC searched an on-line database maintained by IDEQ listing sites with Institutional Controls Restricting Use in the State of Idaho. None were found associated with the Property. Lastly, the ERIS Database Report (Appendix C) includes a review of Sites with Institutional Controls Restricting Use. On the date of the last revision of the databases at the EPA and IDEQ, there were no listed liens or activity and use limitations recorded on the Property. 3.2 USER PROVIDED QUESTIONNNAIRE A User Questionnaire Summary was provided to the User in the proposal that authorized this project. The Questionnaire was not returned to TNE by the date this report was published. User Questionnaire Summary Yes No Is the Use aware of any environmental cleanup liens? Is the User aware of any activity use limitations? Has the user indicated they have specialized knowledge or experience related to the property or nearby properties? Is User in the same line of business as the current or former occupants of the Property or adjoining properties? Does the purchase price being paid for the Property reasonably reflect the fair market value? Is User aware of commonly known or reasonably ascertainable information about the Property (i.e. past uses of the Property, current or past uses of specific chemicals, spills or chemical releases, or any cleanups that may have occurred)? The User is aware of current and past uses of the Property. The User is not aware of any past chemical releases or cleanups that have occurred at the Property. Based on User’s knowledge and experience, is User aware of any obvious indicators that point to the presence or likely presence of contamination at the Property? Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 9 4.0 PROPERTY LOCATION AND DESCRIPTION The Property consists of two irregular-shaped parcels described as parcel numbers RP02N38E347221 & RP01N38E030049 located in Ammon, Idaho. The legal description of the Property is reported as 80 AC W SAND CREEK & W DITCH and LOT 1, LOT 2 LESS 1.00 AC, S1/2 NE1/4 (160.270 AC TOTAL). The north parcel is described as T2N R38E S35 and the south parcel is described as T1N R38E S3. The Property was not structurally developed but was developed for agricultural use. Improvements to the north property consisted of irrigation canals and associated head gates, irrigation pumps, and irrigation pivots. The term “adjoining property,” as defined by the ASTM Standard, intends to mean properties that border or are contiguous or partially contiguous with the Property, or would be so except for separation by a street, road, or other public thoroughfare. The Property is adjoined by single family residential subdivisions (to the north, west and east) and agricultural crop land use (to the south). Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 10 5.0 PHYSICAL SETTING The physical setting of the subject property was reviewed using published reports and maps depicting topography, soil, hydrogeology, and geology. This information is useful in evaluating potential contaminant movement in the environment. 5.1 TOPOGRAPHY The current topographic map showing the area in which the Property is located was reviewed to evaluate topographic features at the Property and adjoining properties. Figure 2 shows a portion of the United States Geological Survey (USGS) Ammon, Idaho 7.5-minute Topographic Quadrangle Map that was created in 1981. The ground surface elevation of the Property is approximately 4,000 feet with a gradual slope to the southwest. 5.2 HYDROLOGY The Property is situated within the Snake River watershed, and the Snake River lies approximately 6 miles west of the Property. Surface drainage on the Property is generally to the west-southwest. 5.3 SOIL CONDITIONS TNE reviewed the soil survey for Bonneville County for information regarding soil types that underlie the Property. The soil survey indicates that the property is underlain by the Paul silty clay loam, which has a typical profile of approximately 45 inches of silty clay loam underlain by alluvial sands and gravel and with depth, basaltic bedrock. This soil type is described as well-drained with a high water storage capacity and is considered to be prime farmland if irrigated. 5.4 GEOLOGIC CONDITIONS The Property is located in the Snake River Plain, a flat depression underlain by volcanic rocks, approximately 30 to 60 miles wide, that cuts an arcuate swath across southern Idaho. The volcanic province of which the Snake River Plain is a part extends from near Payette, Idaho, near the Oregon border, approximately 150 miles southeast to the vicinity of Twin Falls, and then approximately 190 miles northeast to the area of Ashton, Idaho (located about 50 miles south of West Yellowstone, Montana). The Eastern Snake River Plain is bounded on the southeast by mountains of the Basin and Range province. These mountains consist of upper Precambrian through lower Mesozoic sedimentary rocks; these units were uplifted along normal faults during Neogene and Quaternary tectonism. Southwest of the Snake River Plain are mid-Miocene rhyolitic and basalt rocks of the Owyhee Plateau. On the northeast end of the Snake River Plain are Quaternary rhyolitic and basaltic rocks of the Yellowstone Plateau. The geologic map of the Ammon and Paradise Valley Quadrangles, Idaho (Mansfield, Lang and Merrit, 1952) provides detailed mapping of the geology on and near the Property. All of the property is shown to be underlain by “Hill wash and older alluvium” originating from hillslopes located east of the site and alluvium from the mainstream Snake River (late Pleistocene age). The unit described is mostly local derived, ranging from boulders to fine soil and are usually not well rounded. In the Ammon area they have been intensively cultivated. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 11 5.5 HYDROGEOLOGY The aquifer system in the area is composed of fractures and interflow deposits in the volcanic bedrock underlying the site. Depth to groundwater beneath the site is on the order of approximately 70 feet below ground surface (as indicated on area Well Drillers Logs, see discussion below). Based on the location of the Property in the Snake River Plain, it is inferred that groundwater beneath the Property probably flows towards the west southwest. This inference is based upon the topography, geology and surface water hydrology present in the area of the site. The regional aquifer system is locally overlain by shallow or perched saturated zones, many of which are associated with seasonal leakage from irrigation canals. In addition, the regional basalt aquifer contains numerous interbedded zones of low-permeability sediments and basalt. These impede the vertical movement of water and contribute to conditions that produce horizontal water movements. The Snake River is located approximately 6 miles west of the Property. TNE examined Well Driller’s Reports available through the Idaho Department of Water Resources (IDWR) website (https://maps.idwr.idaho.gov/agol/WellsandGroundwaterManagement/). When well drillers prepare these reports, they attest that all information is accurate to the best of the driller’s knowledge and that the well meets all minimum construction standards. A limited number of well logs for the Property area were available. According to search results on the IDWR website of available nearby well logs, it can be expected that gravel, sand and clays are found from the surface to around 10 feet bgs, underlain by interbedded layers of lava and gravel. The static water level in the area is expected to occur around 120 to 150 feet bgs. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 12 6.0 HISTORICAL USE INFORMATION The objective of consulting historical sources is to develop a history of the previous uses of the property and surrounding area to help identify the likelihood of past uses having led to recognized environmental conditions in connection with the Property. Efforts are made to identify previous uses of the property back to the property's first developed use, or back to 1940, whichever is earlier; however, this task requires reviewing only as many of the standard historical sources described below as are necessary and both reasonably ascertainable and likely to be useful. The term "developed use" includes agricultural uses and placement of fill. 6.1 SANBORN FIRE INSURANCE MAPS In the late nineteenth century, the Sanborn Company began preparing maps for use by fire insurance companies. These maps describe the construction materials of specific structures and potential fire dangers at structures in developed urban areas. Sanborn maps were periodically updated and expanded geographically through the twentieth century. True North Environmental, LLC searched for reasonably ascertainable historical Sanborn Maps for the Property at the Idaho Falls Public Library. No Sanborn Map coverage for the Property vicinity was found. 6.2 TOPOGRAPHIC MAPS True North Environmental, LLC reviewed the 1981 USGS Ammon, Idaho 7.5-minute Topographic Quadrangle Map for historical information. The ground surface elevation of the Property is approximately 4,700 feet and the property slopes to the west. One structure or outbuilding is present in the north portion of the southern parcel, and evidence of the railroad line that formerly connected Ammon and Firth is depicted intersecting the south parcel. 6.3 HISTORICAL AERIAL PHOTOGRAPHS True North Environmental, LLC examined 12 readily available aerial photographs from between 1964 and 2020. Copies of the aerial photographs reviewed for the project are presented in Appendix B. YEAR DESCRIPTION 1964 This partial coverage photograph shows only the north parcel, which consists of irrigated agricultural crop land. The Property is not structurally developed and there is an irrigation canal along the east boundary. Adjacent property consists of rural residential and agricultural use properties. 1969 This photo is also partial coverage with only the north parcel visible. The property and adjacent property conditions appear similar to the previous photograph. 1975 This photograph covers the entire Property, which consists of irrigated agricultural crop land. A small, developed area is present in the north portion of the southern parcel of the Property, just to the east of the irrigation canal. The structural development appears to be a barn surrounded by a livestock corral that is associated with the adjoining residential parcel (not part of the Property). The railroad bed and remnants are present in the southern parcel. Adjacent property to the north, west and east consists of single family residential use and adjacent property to the south consists of similar agricultural use land. 1984 The Property and adjacent property conditions appear similar to the previous photograph. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 13 1988 The Property and adjacent property conditions appear similar to the previous photograph. 1992 The Property and adjacent property conditions appear similar to the previous photograph. 1996 The Property and adjacent property conditions appear similar to the previous photograph. 2000 The area near the barn in the southern parcel does not appear to be as active as previous photographs and more vegetation appears to be present. The railroad bed formerly in the southern parcel appears to have been removed and converted to crop land. Increasing residential development in the area is evident, otherwise the Property and adjacent property conditions appear similar to the previous photograph. 2004 The Property and adjacent property conditions appear similar to the previous photograph. 2012 The Property and adjacent property conditions appear similar to the previous photograph. 2016 The barn structure that previously in the southern parcel is no longer present. Otherwise, the Property and adjacent property conditions appear similar to the previous photograph. 2020 The Property and adjacent property conditions appear similar to the previous photograph. 6.4 CITY DIRECTORIES City directories provide residential and commercial business information based on address listings for urban areas and/or areas with a high population density. The directories typically provide the names of occupants for address listings and sometimes also provide an inferred use at the address. Polk city directories were not obtained or reviewed because other sources appear to have provided adequate historical information regarding prior use. 6.5 OWNERSHIP INFORMATION True North Environmental, LLC reviewed the Bonneville County Parcel Viewer website (https://www.arcgis.com/apps/webappviewer/index.html?id=f5f27c3e084449c3b933b019a9b744 4b) for Property owner information on October 21, 2021. Parcel ownership for the north parcel was listed as Eldon Lee, and the ownership for the south parcel was listed as Elden Lee Family Trust. 6.6 HISTORIC ENVIRONMENTAL DOCUMENTS True North Environmental, LLC was not provided with any historical environmental documentation. 6.7 ENVIORNMENTAL CONCERNS RELATED TO HISTORIC USE Based on the review of reasonably ascertainable historical records for the Property and adjacent properties, no RECS were identified. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 14 7.0 REGULATORY REVIEW The purpose of the regulatory review is to obtain and review reasonably ascertainable records that will help identify RECs that could affect the Property. True North Environmental, LLC contracted with ERIS to conduct a search of ASTM Standard E1527-13 Federal, state and local environmental databases. The ASTM required minimum search distance (MSD) for each database is presented below. A copy of the ERIS database report is presented in Appendix C. A summary of select facilities is presented below: Leaking Underground Storage Tank (LUST) Site:  The Ammon Speedi Mart located approximately ½ mile to the northeast was listed. This site was also listed on the Remediation Site Database (REM). No other information was provided regarding petroleum storage, releases or remediation. Mineral Resource Data System (MRDS) Site:  The subject property was listed on the MRDS database as a clay mine. This appears to have been mis-mapped and is considered an incorrect listing that does not apply to the Property. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 15 7.1.1 ORPHANS An “Orphan” means that ERIS was not able to link the listed “Orphan” site to a specific address from the information provided in the database. No Orphan sites were identified within the MSD. 7.1.2 PUBLIC RECORDS REQUESTS True North Environmental, LLC contacted the following agencies for additional information regarding the Property and/or adjacent properties: IDAHO DEPARTMENT OF ENVIRONMENTAL QUALITY The IDEQ is the local pollution control agency in the Property area and a Public Records Request (PRR) was submitted for the Property during the performance of this ESA. The IDEQ responded to our PRR indicating that they had no information for the Property. A copy of the PRR response provided by the IDEQ is presented in Appendix C. FIRE DEPARTMENT A PRR was submitted to the local Fire Marshal’s office for any information regarding spill response or other potential environmental issues. The Idaho Falls City Clerk responded to our inquiry stating there are no spills, hazardous substances or other environmental issues for the property dating back to 2001. No other correspondence was received. A copy of the PRR response is presented in Appendix C. PUBLIC HEALTH DEPARTMENT The area is within the Southeastern Idaho Public Health Department, and a PRR was submitted to SEIPH for additional information about the Property. The SEIPH responded to our PRR indicating that they had no records regarding current or historic septic systems for the Property. Copies of the SEIPH PRR responses are provided in Appendix Ch Results 7.2 ENVIRONMENTAL CONCERNS RELATED TO REGULATORY REVIEW Despite the few nearby properties that were listed on various environmental databases, and the information provided during the PRR request, it is our best professional judgment that these listed sites are unlikely to pose a significant threat to environmental conditions beneath the Property. This judgment is based on information provided in the listings, the location of the listed sites relative to the Property, and the nature of the local geology and hydrogeology. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 16 8.0 SITE RECONNAISSANCE True North Environmental, LLC Mountain Environmental examined the Property with the owner on October 28, 2021. All areas of the Property were accessible and inspected on foot. Weather conditions during the site visit consisted of sunny and mild conditions with ambient air temperatures around 55 degrees. Photographs taken on the date of the site visit are presented in Appendix A. 8.1 PROPERTY DESCRIPTION AND CURRENT USE The Property use consisted of two structurally undeveloped agricultural use parcels for alfalfa crop production. Improvements to the Property included an irrigation canal and irrigation pumps and pivots. 8.2 SITE SPECIFIC PROPERTY OBSERVATIONS TOPOGRAPHY The surface elevation of the Property is nearly level with a slight slope towards the southwest. SOURCE OF DRINKING WATER The Property is not structurally developed and drinking water was not available, other than potential municipal sources. SEWAGE DISPOSAL/DEPTIC SYSTEM The Property is not reportedly connected to the municipal sewer system and no private septic systems were reported. HAZARDOUS SUBSTANCES AND PETROLEU PRODUCTS No hazardous substances or petroleum products were observed on the date of the site visit. STORAGE TANKS One above ground propane tank was present to provide power to an irrigation pump (see Appendix A). No other above ground or below ground storage tanks were reported or observed on the date of the site visit. ODORS No unusual odors were detected on the date of the site visit. INTERIOR OR EXTERIOR STAINING No staining was observed on the date of the site visit. DRUMS OR OTHER CONTAINERS WITH UNKNOWN CONTENTS No drums or containers with unknown contents were observed on the date of the site visit. PCBs No PCB-containing equipment was observed on the date of the site visit. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 17 HEATING SYSTEM No buildings were present on the Property on the date of our site visit therefore there were no heating systems to inspect. DRAINS AND SUMPS No drains or sumps were reported or observed on the date of the site visit. PITS, PONDS OR LAGOONS No pits, ponds or lagoons were observed on the date of the site visit. SOLID WASTE DISPOSAL No evidence of solid waste generation or disposal was observed on the Property on the date of our site visit. Small amounts of concrete debris and tires were observed near E 49th S. WASTEWATER DISCHARGE Wastewater is not discharged from the Property. WELLS No water supply wells were reported or observed on the date of the site visit. 8.3 ADJOINING PROPERTY OBSERVATIONS The Property is located in a mixed residential and agricultural use area of Ammon. Adjacent property to the north, east and west consisted of single-family residential subdivisions and adjacent property to the south consisted of similar agricultural use land. 8.4 ENVIRONMENTAL CONCERNS RELATED TO SITE VISIT No RECs or environmental concerns were observed on the date of the site visit. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 18 9.0 INTERVIEWS The objective of interviewing persons familiar with the Property is to obtain general information on past and current site usage, as well as information that might indicate possible RECs in connection with the Property. 9.1 PROPERTY OWNER True North Environmental, LLC was not able to contact the Property owners before the report was published. The farmer who has been producing alfalfa at the Property since approximately 2015 was interviewed, which is presented below. 9.2 PROPERTY OCCUPANT True North Environmental, LLC interviewed the site manager who farms the Property. Mr. Ryan Steele has been farming alfalfa at the Property since approximately 2015. He mentioned that he converted the land to alfalfa farming and that it was previously used to produce barley (the south parcel) and a sod farm (the northern parcel). He irrigates the property and operates the pivots, and mentioned that the irrigation water is received from the canals that bisect the Property. He was not aware of any environmental issues associated with the Property. 9.3 OTHERS True North Environmental, LLC may also interview former owners, operators, occupants or others who are likely to have material information regarding the potential for contamination at the Property, but only to the extent that those individuals have been identified and that the information likely to be obtained will not duplicate information already obtained from other sources. No others were interviewed during the performance of the Phase I ESA. 9.4 ENVIRONMENTAL CONCERNS RELATED TO INTERVIEWS The lack of a formal interview with the Property Owners is considered a data gap but based on historical operations as a farm, this does not qualify as a REC. No environmental concerns or RECs were identified during the interviews. Phase I Environmental Site Assessment E 49th S, Ammon, Idaho October 29, 2021 19 10.0 CONCLUSIONS AND RECOMMENDATIONS True North Environmental, LLC has completed a Phase I ESA examining the environmental conditions at the subject property located along E 49th S in Ammon, Idaho. This Phase I Environmental Site Assessment has been performed in conformance with the scope and limitations of ASTM Practice E 1527-13, and the Detailed Scope-of-Services section of our project proposal. This Phase I Environmental Site Assessment has revealed no evidence of Recognized Environmental Conditions (RECs) associated with the Subject Property.
