Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at 7: 30 P.M. by Mayor C. Bruce Ard with the

The pledge of allegiance to the flag was directed by Councilman Crandall, and the
invocation was offered by Councilman Anderson.
Councilman Anderson met on Wednesday, March 14, with Beverly Boyle and Ivy Berry
to review the Boys' Knothole Baseball program. Mrs. Boyle has been working with
the program for several years, but she is moving to Boise and Mrs. Berry has
agreed to take her place. She will be assisted by Al Stephens. They are getting
organized for the 1990 season.
Marsha Bell reported on the Girls' Softball program for girls ages kindergarten
through sixth grade. She will be assisted by Susan Richardson. Individual
participants pay a fee of $12.50 which includes a shirt, pays the officials
(umpires and scorekeepers), buys equipment, and left over funds are used to help
improve the park facilities. The girls plan to play on Tuesdays and Thursdays
from 8:00 A.M. to 12:00 Noon on the Peterson Park diamonds.
Kyle Staples, 3170 Ross Avenue, voiced objection to the "no parking" signs on the
Virginia Street access to Peterson Park. Residents were not notified about the
erection of the signs, the street has never been posted before, and the Staples
believe the City acted unfairly. The City erected the signs to facilitate
vehicular access to the park because the street is so narrow. A resolution passed
by the City Council on November 5, 1975, grants the City officials authority to
regulate parking of vehicles within the City limits. Mr. Staples asked to
continue the discussion at the next Council Meeting on Thursday, April 5, to allow
him time to consult his attorney.
The Idaho Falls office of the U. s. Post Office cut off rece~v~ng bids for
operation of a branch office in the Ammon/Southeast Idaho Falls area on March 9,
1990, but no announcement has been made regarding award of the bid.
Attorney Anderson prepared a complete new dog ordinance in order to make it read
more clearly and to include the amendments specified in Ordinance No. 209.
Ordinance No. 215 was introduced by title, AN ORDINANCE REPEALING TITLE 6, CHAPTER
3 OF THE CODIFIED ORDINANCES OF THE CITY OF AMMON AND ALL OTHER ORDINANCES OR PARTS
THEREOF IN CONFLICT HEREWITH; PROVIDING FOR THE DEFINITIONS OF TERMS AND PHRASES
IN THE ORDINANCE; PROVIDING FOR FEES TO BE DETERMINED BY THE COUNCIL BY RESOLUTION
FROM TIME TO TIME FOR LICENSES AND LICENSE TAGS; PROVIDING THAT DISTURBANCES BY
DOGS OR RUNNING AT LARGE WITHOUT A LEASH ARE VIOLATIONS; THAT CERTAIN ACTS BY DOGS
ARE OFFENSES AND VIOLATIONS; PROVIDING THAT A VICIOUS DOG SHALL NOT BE MAINTAINED
WITHIN THE CITY; AND PROVIDING THAT CRUELTY TO DOGS IS A VIOLATION; DEFINING
COMMERCIAL AND NON-COMMERCIAL KENNELS AND PROVIDING FOR THEIR LICENSING AND
SUPERVISION; PROVIDING FOR THE IMPOUNDING OF DOGS IN VIOLATION; AND PROVIDING THAT
INTERFERENCE WITH THE IMPOUNDMENT IS A VIOLATION; PROVIDING FOR THE REDEMPTION
AND DISPOSAL OF IMPOUNDED DOGS AND PROVIDING FOR THE DISPOSITION OF DECEASED OR
UNCLAIMED DOGS; PROVIDING FOR CITATIONS OF ANY VIOLATION OF THE PROVISIONS;
PROVIDING FOR ADDITIONAL REMEDIES AND PENALTIES; AND PROVIDING FOR AN EFFECTIVE
DATE. Following Council study and discussion, Councilman Maeser moved to adopt
Ordinance No. 215 as an ordinance for the City of Ammon on its first reading. The
motion was seconded by Councilman Crandall. Roll call vote: Maeser - Yes; Cran-
dall - Yes; Anderson - Yes; Browning - Yes. The motion carried unanimously.
As requested in a letter from Chad Stanger, Public Works Director for the City
of Idaho Falls, the Council reviewed the EPA regulations regarding pretreatment

pretreatment program applies only to co ercial and industrial users, it involves
considerable paperwork, and Idaho Falls urrently does the sewer maintenance, it
would be advantageous for Ammon to ha e the City of Idaho Falls assume the
responsibility for implementation. Cou cilman Browning moved to authorize the
Mayor to draft a letter to Chad Stanger 0 reflect the Council's wishes regarding
the EPA pretreatment requirements. T e motion was seconded by Councilman

The Council discussed roof and door re irs for the Cit and Wellhouse
No.7. The City Building received tempo ary roof repairs and now a new

the City to better utilize the buildin and to tentatively prepare to move the
Fire Department into it. A number of fir s have been contacted to make proposals,
but there has been little response. The following proposals have been received:

The proposals received are from companies, and they appear to be
reasonable. Councilman Crandall moved to accept the door bids from Russ's Ovehead
Doors for Wellhouse No.7. The motion as seconded by Councilman Maeser. Roll

street sweeper proposal.
The Union Pacific Railroad has invited the City of Ammon to participate in a
Proclamation Meeting for "Railroad Cro sin Safet Awareness Week" on Monday,
March 26, 1990, at 10:00 A.M. at the nneville County Court House. Following
the meeting, representatives will be gu sts at a luncheon at the Shilo Inn and
a train ride to Rexburg. Mayor Ard made he following proclamation:

WHEREAS, Grade crossing accident prevention can best be accomplished
through driver education and enforcement of public laws;
NOW, THEREFORE, BE IT KNOWN THAT WE, the City of Ammon, do hereby
proclaim the week of March 26 31, 1990 as
"RAILROAD CROSSING SAFETY AWARENESS WEEK"
and urge all citizens of the City of Ammon to be aware of the potential
of grade crossing accidents, to practice responsible and safe driving
behavior and to support and participate in those activities aimed at
eliminating grade crossing accidents.
Ammon West L.D.S. Stake submitted plans to redo their parking lot, sidewalks, and
curbs around their building in the Hillview Addition. No action was needed, but
the Church desired to inform the City of their plans before beginning the project.
Regarding the property owned by Lennis Tirrell, Richard Skidmore, Ethel Pickett
estate, and Rich Hardy on the southwest corner of the intersection of Sunnyside
and Ammon Roads, the City Council instructed Planning and Zoning to initiate the
procedures for considering a zone change from RSC-l to C-l. Engineer Benton request-
ed the Council to review and approve the combined legal description of the property
which he prepared to use in advertising a public hearing. The property boundaries
and the present zoning were discussed in detail. Since one of the boundaries is
along Ammon Road, it was decided to delay the rezoning procedures until the right-
of-way for Ammon Road is established. The main reason for considering a rezone
is because Rich Hardy wants to build a commercial building to house his business,
Idaho Traffic Safety, on his property. The Council further decided, if Rich Hardy
gets ready with his plans before the rezoning action is completed, they will work
with him.
Councilman Browning moved to approve the minutes of City Council Meeting held March
1, 1990. The motion was seconded by Councilman Maeser. Roll call vote: Browning-
Yes; Maeser - Yes; Anderson - Yes; Crandall - Yes. The motion carried unanimously.
Reports: David Wadsworth reported for Public Works. The material has been
obtained to build the new dumpsters. Work is ready to begin on the sprinkler
systems for Falcon Park and outside of the trees in South McCowin Park. EPA has
approved a system for underground storage tanks where the tanks can be tested
yearly rather than pull-out and replace. The cost is $350 per tank, and the tank
must be full when tested. Gwen Monson, 2090 Eagle, is still having problems with
the neighbor's barking dog, but Public Works Director Wadsworth plans to work with
her to try to eliminate the problem. Lora Hansen and her children watered Peterson
Park last year, and they are willing to water it again this year. This proved to
be good for the City because Hansens were available to work with the ball players
and they reduced the rainbird loss. Cost was 16 hours per week @ $3.50 per hour,
and the total salary paid for the season was $1,312.50.
Fire Chief Cal Smith reported he has been working to get the latest edition of the
Uniform Fire Code ready for adoption by the City. Bonneville County/City of Idaho
Falls is upgrading the 911 system. They are forming a 911 committee of
representatives of all the areas on the system that will be affected by the change.
The first meeting is Tuesday, March 20, at 9: 00 A.M., and they would like Ammon
to be represented.
Engineer Benton advised that Chuck Steele of the FEMA office in Bothell,
Washington, had reviewed Ammon's request for a flood plain basement exception.
Everything appeared to be in order, and they were submitting the request to
Washington D. C. with a recommendation for approval.
Councilman Anderson reported the trees on 17th Street between Curlew and Avocet
and South on Curlew need to be trimmed because they hang over the street and
interfere with large vehicular travel. The Council discussed what to do about the
problem. Mayor Ard proposed that the Public Works Department make some
measurements and pinpoint the problem areas so the City can request the owners to
trim their trees and/or shrubs. (Code reference: 9-2-1, 9-2-2, 9-2-3, & 9-2-4)
Claims were approved. Councilman Browning moved to adjourn the meeting. The
motion was seconded by Councilman Crandall. The meeting was adjourned at 9:30 P.M.
