Bruce Ard Councilman Michael B. Browning Councilman Harvey L. Crandall Councilman Greg J. Maeser at 7: 30 P.M. by Mayor C. Bruce Ard with the Acting Public Wks. Dir. David Wadsworth P&Z Representative Darrel W. Olson City Clerk Aleen G. Jensen Others present were: Councilman Elect Marvin J. Anderson Hayse L. Whiteley, 3200 Midway, Ammon Rex B. Purcell, 3415 Molen Street, Ammon Kay and Margene Reiman, 3155 Rawson Street, Ammon Etsel E. and Maxine Sommer, 2990 Romrell Lane, Ammon Carolyn Patterson, 3110 Molen Street, Ammon Melvin Rosen, 2985 Meadow Lane, Ammon Nolan Jorgensen, 3360 East Sunnyside Road, Ammon Lawrene Freckleton, 3165 East Sunnyside Road, Ammon Glenn R. Blatter, 3240 Molen Street, Ammon M. Ray and Talmage (Scout) Johnson, 3430 Del Rio Circle, Ammon I Absent: Attorney W. Joe Anderson and Engineer David E. Benton The pledge of allegiance to the flag was directed by Councilman Crandall, and the invocation was offered by Councilman Maeser. Since there is a vacancy on the City Council, consideration was given as to whether or not it would be advisable to appoint Marvin J. Anderson, newly elected Councilman, to take office immediately rather than wait until January 4, 1990. An appointment at this time creates a questionable problem. The Idaho Code states an appointee to fill an unexpired term of an elected official must qualify for the seat at the next election. Therefore, if appointed, would Anderson have to be a candidate for election in two years? If he waits to take the oath of office until January, 1990, he has been elected to his own four year term. It I was agreed that Marvin J. Anderson should decide what he would rather do, and the Council will act accordingly. Rex B. Purcell acted as spokesman for Kay andMargene Reiman, 3155 Rawson Street, who have requested permission to improve their living quarters by replacing a single wide trailer home with a double wide unit. The single wide trailer now located on the Reiman's property constitutes a non-conforming use in an R-l zone, and the zoning ordinance does not permit changes to a non-conforming use. Reimans presented their plans to the Planning and Zoning Commission at their November meeting, but they did not get favorable encouragement. Therefore, they have filed an application for a Special Use Permit for action by the City Council. Neighbors and friends supported the Reimans and asked the City Council to give special consideration to granting an exception because the plan is a positive upgrade which should benefit Reimans, the neighborhood, and the community. The Council set a Public Hearing on the request for Thursday, December 7, 1989, at 7:30 P.M. Darrel W. Olson reported on the meeting of the Planning and Zoning Commission held November 7, 1989. The only agenda item was Kay and Margene Reiman's request to replace their single wide trailer house with a double wide trailer. No official action was taken because of lack of quorum. However, Commission members present at the meeting were of the opinion that the request should be denied because it was contrary to the established law. Specifications for the purchase of a new, four wheel drive, heavy-duty pickup I were approved, and the Council authorized advertising for bids. It was agreed that bids would be received until 4:00 P.M. on December 4 and, if there was satisfactory response, the bid could be awarded at Council Meeting on December 7, 1989. Regarding the Ammon Road Project scheduled for construction in the fiscal year beginning October 1, 1990, Councilman Browning reported a letter had been drafted by Engineer Benton and mailed to each of the six engineering firms who responded to the Statement of Interest request. These firms were invited to be interviewed by the Consultant Selection Committee on Thursday, November 30, beginning at 7:00 P.M. Each firm will be allowed 25 minutes--15 minutes for their presentation and 10 minutes for question and answers. I I I Book 7-247 November 16, 1989 November 30, 1989 Hayse L. Whiteley, 3200 Midway, expressed some concerns. (1) The building permit issued to William Mcquillan to move a log house on to the lot on Ammon Road was issued correctly. The permit was challenged because it did not meet the square footage requirements of the zone. (2) The building permit fees charged by Ammon are high. The plan check fee should be reduced from 65% of the permit. Ammon does not have a building inspector at the present time. High fees discourage construction in Ammon. (3) It is questionable whether it is cost effective for the City of Ammon to buy a new pickup. Reports: Acting Public Works Director David Wadsworth reported that the blinking lights for the school crossings on Ammon Road are in the process of installation. There are so many street signs on Ammon Road that the Traffic Safety Committee needs to review and make a recommendation about them. The power pole has been placed at Well No.6, so the fire siren can be moved to City property where the City can get to it to maintain it. Civil Defense may give some financial help for a new siren. VerI Terry applied for a building permit for a house with a basement on Mason Street which is in the Flood Plain. The Council stated no permit shall be issued until the Flood Plain basement exception is resolved. Progressive Irrigation answered our letter about the hole by the Ammon Speedi Mart. "This particular problem has nothing to do with the Progressive Irrigation District. This is a private ditch and the ditch and headgates that come together here are owned privately by the farmers that use them. You will need to contact them and request their assistance." Mayor Ard instructed Public Works to reinforce a sheet of plywood to make a cover for the hole. Councilman Browning moved to adj ourn the meeting. The motion was seconded by Councilman Maeser. Bruce Ard with the following present: Mayor C. Bruce Ard Councilman Michael B. Browning Councilman Harvey L. Crandall Councilman Greg J. Maeser Engineer David E. Benton Assistant District Engineer Clyde R. Gillespie of District No.6, Idaho Transportation Department, Rigby, Idaho Acting Public Works Director David Wadsworth City Clerk Aleen C. Jensen The purpose of the meeting was to conduct individual interviews as part of the final selection process for a consultant for the Ammon Road Project. Clyde Gillespie of the State Transportation Department discussed policies and procedures of the selection process prior to conducting the interviews. Blakley, Buturla Consulting Engineer, 621 South 4th Avenue, Caldwell, Idaho, 83605, was invited to submit a technical proposal and attend an interview, but they did not respond. Consultants were asked to respond to the following questions: 1. You have said in the technical evaluation report that the project can be designed in the allotted time. If the project falls behind, do you have the manpower to accelerate the project? 2. Will you be doing the exploration necessary to evaluate subsoil conditions or will that be performed by others? 3. Explain how you plan to involve the community in this design. By--News releases? Meetings? How?
