Council Minutes 9/12/2006 (168) I I I 193 March 2, 1995 CITY OF AMMON March 2, 1995 Minutes of the Public Hearing and the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:30 P.M. at the City Building, 3270 Molen Street, Ammon, Idaho, with the following City Officials present: Mayor C. The Pledge of Allegiance to the Flag was directed by Councilman Crandall, and the invocation was offered by Councilman Maeser. The meeting lacked a quorum of the City Council, therefore, agenda items were discussed but no official action was taken. Mayor Ard opened the Public Hearing to consider the request of Cantlon Properties to rezone the property now occupied by Jerry Bergeman and Sons Auto Repair, 2590 East 17th Street, from C-1 to HC-1. The property is part of the Ammon Town Center development, and the developers want uniform zoning for all the property involved. Notice of hearing was published in the Post Register on February 14 and February 21, 1995. Also, notices of hearing were mailed to adjacent property owners. The Planning and Zoning Commission considered the request at a Public Hearing on February 7, 1995, and they recommended approval. No parties in interest appeared to speak for or against. Mayor Ard closed the hearing. The City Council will take action on the request at their meeting on March 16, 1995. Business of the Regular Meeting continued. Rigo Gonzales, 2015 Curlew Drive, requested a non-commercial kennel license. Mr. Gonzales owns three dogs. All of the dogs have been spayed or neutered. Two dogs are house dogs and one is an outside dog. Ten residents within 150 feet were contacted and nine signed to give their approval. Councilman Maeser did not see any problem, but official action will be taken at the next Council Meeting. Kent Wood and Randy Trane met with the Council to offer some different sites they have located and inquired about as potential alternate sites to the site selected by the Council for the new City Building. Kent Wood observed there is a good deal of citizen resistance to the proposed site in McCowin Park. He has offered to act as a neutral party to bring the information to the City Council. The following sites were pointed out on a map of Ammon: 1. First choice is property on Brookfield Lane and Ammon Road formerly owned by Rex Shurtliff but recently purchased by Jay Johnson. Mr. Johnson will sell the property to the City for $65,000 which is about what he paid for it. The Council asked for a report on the size of this piece. 2. Property on the corner of Sabin Drive and East 17th Street owned by Grobergs. The size is 294' X 240'. There has been an option on this property for $100,000 but, if the City is interested, they are workable. 194A March 2, 1995 3. Jay Kohler owns a piece of property between the McCowin home at 3020 East 17th Street and Keith Jorgensen's Music. The lot size is 136' X 250'. 4. The Ross McCowin home, 3020 East 17th Street, might be a possible remodel, but no information has been obtained on whether or not family members are interested in selling. 5. Buck Hiller owns the frontage on East 17th Street from Legends Convenience Store to the lot on the west side of Cabellaro. 6. There is a lot in the vicinity of Hillcrest High School which David Benton mentioned. No information has been pursued. 7. Fred Karford owns property on the north side of the LDS Stake Center on Ammon Road. Mr. Karford has not been contacted regarding the availability. I 8. The Lewis Nielsen home on East 17th Street may be a possibility if somcething could be worked out with it and the Well No. 7 property. 9. Peterson Enterprises own the commercial property on East 17th Street between Midway and Heather Lane. They are willing to sell but they propose to build a City building. In return they would like the City to rezone to square out their commercial lots. The various sites were discussed to point out their possibilities. Since the Council decided on February 23, 1995, to build a City Building on Midway Avenue and Southwick Lane in North McCowin Park, their thoughts have changed somewhat. It was brought out that the decision has caused enough strong opposition that the Council does not want to divide the community. Mr. Wood and Mr. Trane were asked to check out and report back about the xizes and costs of three of the alternate sites which were discussed. The sites the Council had an interest in are: Johnson/Shurtliff property on Ammon Road, the Nielsen property by Well No.7, and the property near Hillcrest High School. Linda Baldwin, 3450 Rich Lane, requested a home occupation permit to engage in resale of all types of distressed merchandise. The merchandise is sold through I home parties on an order basis. There is no warehousing. Traffic will be minimal. Mainly, the bookkeeping will be done in the Baldwin home. The Council did not have a problem with the request, but action was deferred until the next meeting. The citizens present expressed a willingness to serve on committees to help better our community. They requested information on how they could serve. it was explained that the Planning and Zoning Commission consists of nine volunteers. Ammon is a part of the Bonneville Metropolitan Planning Organization. BMPO functions with the assistance of a Policy Board, a Technical Advisor Committee, and the Citizens' Advisory Committee. Ammon has two representatives on the Citizens' Advisory Committee, and there is one vacancy at this time. The BMPO program was discussed. Some of their areas of involvement are the traffic study in the Ammon Townsite, Crossroads 20l5--The Comprehensive Transportation Plan, the Bonneville Bicycle and Pedestrian Plan, the Transit Plan, and the Transportation Improvement Program. Various items of interest to our community were discussed. Reports: David Wadsworth reported for Public Works. The Council needs to decide if they want to pour a sidewalk by Tie Breaker Park. The City of Idaho Falls' Parks Department is going to help move eight trees from Well No. 7 to the Tie Breaker Park. Some grading has been done on Maiben Avenue, the only dirt road left in Ammon. Councilman Crandall inquired as to whether or not an application has been made to the Department of Water Resources for a permit to dig a new well. This is high priority. I Road maintenance was discussed. Councilman Maeser asked if the City was on line to complete the Ross Avenue chip/seal proj ect started last fall. It was brought out that any road maintenance we need to bid out should be done early so it can be completed during warm weather. Bonneville County is supposed to work with us on the chip/seal of Sunnyside Road and Ammon Road during this season. It was suggested that we get a firm commitment from them. Public Works Director Wadsworth promised to contact the County Road and Bridge. Ammon Urban Renewal is on the court docket for judicial confirmation on Friday, March 24, 1995, at 9:00 A.M. Mayor Ard reported on the BMPO Policy Board Meeting. If there is any road project that affects Ammon, the Mayor needs the information on it for the May BMPO Meeting. I I I 194B March 16, 1995 The City Clerk discussed Dixie Delaney's request for a determination about whether or not the Animal Overlay still exists on the properties on the south side of ~outhwick Lane in the Southwick Addition. The issue was discussed thoroughly, and ~t was concluded that Engineer Benton would research the issue and make a recommendation for the City Council. The meeting was adjourned at 8:45 P.M. Gayle Greenhalgh, 3115 Molen Street, requested a non-commercial kennel license. Ms. Greenhalgh has three dogs. The dogs are chained up outside in the day time, and they are kept inside at night. The dogs are pets, and no additional dogs are planned for. All the neighbors within 150 feet gave their consent. Councilman Maeser moved to approve a non-commercial kennel license for Gayle Greenhalgh, 3115 Molen Street. The motion was seconded by Councilman Crandal1. Roll call vote: Maeser - Yes; Crandall - Yes; Loveland - Yes. The motion carried unanimously. Sonna Lynn Lewis, Deputy Director of BMPO, and Bill Manwill, Bonneville County Engineer, studied the Ammon Townsite Traffic Report which was presented at City Council Meeting on February 23, 1995. Engineer Manwill reported their findings and recommended some modifications. Originally the intersection of Owen Street and Western Avenue was designated as a four-way stop. The modification recommended was for a two-way stop with Owen Street as the through street and stop signs on Western Avenue. A four-way stop was recommended for the intersection of Midway Avenue and Owen Street. The four-way stop at Midway and Rawson should be changed to a two-way stop with the stop signs on Rawson Street. It was further recommended that changes be made, then allow time for the traffic flow to stablize, and next restudy the area to evaluate. When changes ar made in street signing, it is anticipated there will be some accidents. In order to lessen the impact of the changes, the traffic flow should remain as is until school is closed for the
