Minutes of the Regular Meeting of the Mayor and City Council:
The meeting was called to order at

The Pledge of Allegiance to the Flag was directed by Councilman Loveland, and the
invocation was offered by Councilman Hall.
Councilman Crandall moved to approve the minutes of City Council Meeting held
December 17, 1994. The motion was seconded by Councilman Maeser. Roll call vote:
Crandall - Yes; Maeser - Yes; Hall - Yes; Loveland - Yes. The motion carried
unanimously.
Councilman Maeser moved to approve the minutes of the Special City Council Meeting
held December 23, 1994. The motion was seconded by Councilman Loveland. Roll call
vote: Maeser - Yes; Loveland - Yes; Hall - Yes; Crandall - Yes. The motion
carried unanimously.
Gaye Loertscher, 3725 Ross Avenue, requested a home occupation permit to do product
packaging, dba Stuff-It. Family members will do the packaging. Mr. Loertscher
will pick up the product to be packaged and deliver it back after packaging has
been completed. Basically it is a contract labor operation which will provide some
extra income. Councilman Maeser moved to approve the home occupation permit for
Gaye Loertscher, 3725 Ross Avenue. The motion was seconded by Councilman Hall.
Roll call vote: Maeser - Yes; Hall - Yes; Loveland - Yes; Crandall - Yes. The
motion carried unanimously.
Daryl G. Peterson, 4340 Mason Street, expressed concern about bad experiences with
City of Ammon animal control procedures. It seems like animal control manages to
pick up the friendly dogs, but the dogs which cause problems continue to run loose.
Recently two of Peterson's dogs got loose. Petersons looked throughout the area
all night for the missing dogs. The next day they discovered the dogs had been
picked up by animal control, and they had been taken to the animal shelter. Since
the dogs had current City of Ammon licenses, the owners were upset that their dogs
were impounded without any attempt to notify them. On another occasion, Petersons
were working with animal control to capture a problem dog. The problem dog was
finally impounded, but in the course of events, Peterson's dog was impounded first.
Mr. Peterson appealed to the City Council to review their policies to provide some
type of notification and/or return for licensed dogs. Public Works Director
Wadsworth gave a report of the incident as experienced by the City employees. The
Council discussed the issue and determined that owners are entitled to some service
when they comply with the City's licensing law. It was agreed that, if animal
control picks up a licensed dog,provided the dog has not been a perpetual problem,
an attempt will be made to notify the owner and/or to return the dog to the owner
before the end of the day.
Unfinished Business: The Council discussed whether or not there is a need to
pursue adoption of a curfew ordinance. The City of Shelley's curfew ordinance
appears to be working for them, and the City of Idaho Falls seems to have a
workable curfew ordinance. Bonneville County has not taken action to establish a
curfew. City of Ammon has not taken any action pending action of the County
because Bonneville County is responsible to enforce Ammon's ordinances. Gaye
Loertscher reported she had heard of incidents where Idaho Falls youths come out to
Ammon to avoid the Idaho Falls curfew. Shane Loertscher stated Ammon does have
youth running the streets late at night, and they are up to no good. Mayor Ard
agreed to telephone Bonneville County Sheriff Stommel to discuss the need for a
curfew and to get an update on the County's plans.
The City Clerk was asked to color code a map of Ammon Meadows to show the results
of the survey regarding a change of zone from RPA to R-l. The survey was mailed

to all the owners of property in the subdivision on November 21, 1994.
thirteen surveys have been completed and returned.
Only
Michael Nye of Utah Power visited with the City Council. Councilman Maeser
inquired about the status of the economic development program introduced to the
Council several months ago. The Council expressed an interest in following through
with the program. Mr. Nye agreed to schedule the economic development
representative to attend the Ammon City Council meeting on February 2, 1995, at
8:00 P.M.
Reports: Public Works Director Wadsworth reported on the status of the new
equipment which is on order.
Attorney Anderson called attention to changes made by the 1994 legislature which
mandated a review of the Comprehensive Plan and Zoning Ordinances to accommodate
manufactured homes. The cities are mandated by July 1996 to have in place a
siting ordinance to allow manufactured homes on residential lots. Also, a local
resident has expressed interest in creating a manufactured home area. The
Association of Idaho Cities has a proposal for the 1995 legislature to modify the
law adopted last year, but the proposal is a clarification. It does not change the
law subsequently so there is no reason to wait for new legislation. Attorney
Anderson suggested a proposal be made to the Planning and Zoning Commission and to
have them initiate the process to get the required ordinance in place. Information
on the requirements was circulated. Attorney Anderson will send the information to
the Planning and Zoning Commission Chairman Dick Bybee.
Engineer Benton reported he had received a request regarding the bridal path in
Barbara Jean Estates. Some residents want to fence off the path, and others want
to use it to access their backyards. They were informed such debate is a civil
matter to be settled between the property owners.
The Ammon Town Center development is progressing slowly. City Clerk Jensen updated
the Council on revisions to election procedures. Claims were approved.
Councilman Crandall moved to adjourn the meeting, and the motion was seconded by
Councilman Loveland. The meeting was adjourned at 8:15 P.M.
