A. CALL TO ORDER: Mayor Sean Coletti opened the meeting at 7:00 p.m. at the Ammon City Hall building located at
2135 South Ammon Road. Council Member Wheeler led the Pledge of Allegiance and Council Member Thompson
offered a prayer.

1. 2020-015R Creation of LID 5 (Bruce Patterson, Technology Director)
Technology Director, Bruce Patterson, discussed the process and timeline with Council for establishing LID #5
explaining the two resolutions being presented to Council and the next steps that would take place to create
the LID. Council discussed the description of the intended boundaries of the LID and the timeline intended for
the LID. Patterson reviewed the locations of existing service huts and which locations would need additional
service to install fiber.
Recommendation
Staff recommends approval of Resolution 2020-0015R and 2020-16R.
Summary of Analysis
1. The formation of Local Improvement Districts require specific public processes as outlined by law.
2. The adoption of Resolution 2020-0015R publically initiates the formation process.
4. The adoption of Resolution 2020-0016R authorizes the public notification process for property owners
5. Approval and adoption of these two resolutions simply starts the process, it does NOT create the LID.
the council to take public input on this matter during the regular meeting on January 7 th, 2021.
7. Only after receiving public input can the council vote on whether or not to create the LID. (Which would
likely be scheduled at the next regular meeting following the 1/21/21 meeting.)

Financial Impact
There will be some limited costs to the Fiber department to cover the cost of mailing out the public notices.
It was moved by Council Member Tibbitts and seconded by Council Member Wessel to approve Resolution
2020-015R, thereby initiating the potential formation of a 5th fiber optic improvement district. aƚƷźƚƓ ƦğƭƭĻƭ

2. 2020-016R Creation of LID 5 (Bruce Patterson, Technology Director)
It was moved by Council Member Tibbitts and seconded by Council Member Wessel to approve Resolution
2020-016R intention to create Fiber Optic LID #5. aƚƷźƚƓ

3. Public Works Purchase of Used 2018 John Deere Backhoe (Tracy Bono, City Engineer)
City Engineer, Tracy Bono, reviewed the intended purchase and how it would benefit both the Fiber and
Public Works departments and how the purchase would be funded by both departments.
Recommendation
Staff recommends approving the purchase of Used 2018 John Deere Backhoe
Summary of Analysis
1. Construction projects are increasing in both Public Works and Fiber.
2. The two departments have been trying to share Public Works limited equipment and lately there has been
a struggle with the demand.
3. Fiber needs a bigger piece of equipment to load trucks and haul material around the neighborhoods.
4. Current backhoe that Public Works owns is underpowered for our needs and has features that Public
hoes with its features will be a great fit for the Fiber
department. Features on the backhoe that will help fiber are: -Detachable front bucket that could accept a
pallet fork to allow Fiber to load and unload pipe, boxes, pallets of sod, etc,. -Auxiliary Hydraulics ran to the
front of the machine. They can use this to pull fiber into the conduits.
5. Found used 2018 John Deere backhoe with 629 hrs for $70,200.00. Fiber will pay $63,000 towards this
purchase.
Financial Impact
1. Have funds in Water and Wastewater to cover the difference.

a. EIRWWA Capacity Replacement Fees
Mayor Coletti informed Council that the cost per ERU would be increasing to properly fund
capacity and Council discussed the implications and the discussion taking place with EIRWWA.
Council and Staff reviewed the various improvements and increased capacity projects being
considered and discussed possible plans to improve service.

b. Ordinance 653 2018 International Building Code Adoption (Charles Allen, Building Official)
Building Official, Charles Allen, updated Council on the amendments to Building Code as adopted
by the Idaho State Legislature. Allen reviewed the changes with Council and will return for
approval to adopt the State approved Code at a future meeting.

a. Comprehensive Plan Committee Joint Meeting
Council was joined by members of the Planning and Zoning Commission to discuss the
Comprehensive Plan. A joint committee was formed to provide recommendations, the committee
was made up of two members of City Council and two members of the Planning and Zoning
Commission. The updates will move forward through Planning and Zoning before coming back to
Council for approval.
b. EIRWWA Discussion
Council was joined by Elizabeth Spaulding and Alan X from JUB Engineers to discuss conduct a brief
survey regarding the potential for an EIRWWA Sewer District. Spaulding reviewed the items to be
discussed and moved forward with the questions.

REPEALING AND REPLACING TITLE 7, CHAPTER 1, INTERNATIONAL BUILDING
CODE; REPEALING AND REPLACING TITLE 7, CHAPTER 3, INTERNATIONAL
RESIDENTIAL CODE; REPEALING AND REPLACING TITLE 7, CHAPTER 4, IDAHO
STATE PLUMBING CODE; REPEALING AND REPLACING CHAPTER 5, INTERNATIONAL
MECHANICAL CODE; REPEALING AND REPLACING TITLE 7, CHAPTER 7,
INTERNATIONAL FIRE CODE; REPEALING AND REPLACING CHAPTER 8,
INTERNATIONAL ENERGY CONSERVATION CODE; REPEALING AND REPLACING
CHAPTER 9, INTERNATIONAL FUEL GAS CODE; REPEALING AND REPLACING TITLE
7, CHAPTER 11, INTERNATIONAL EXISTING BUILDING CODE; CODES SHALL BE
ADOPTED AS WRITTEN TOGETHER WITH ANY AMENDMENTS OR REVISIONS TO THE
CODES INDICATED IN EACH CHAPTER; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL AND MAYOR OF THE CITY OF
AMMON, IDAHO THAT ORDINANCE 653 IS HEREBY ADOPTED ACCORDING TO THE
FOLLOWING:
Section 1. Title 7, Chapter 1, International Building Code is hereby repealed and replaced with Exhibit
A to this ordinance.
Section 2. Title 7, Chapter 3, International Residential Code is hereby repealed and replaced with
Exhibit B to this ordinance.
Section 4. Title 7, Chapter 4, Idaho State Plumbing Code is hereby repealed and replaced with Exhibit
C to this ordinance.
Section 5. Title 7, Chapter 5, International Mechanical Code is hereby repealed and replaced with
Exhibit D to this ordinance.
Section 6. Title 7, Chapter 7, International Fire Code is hereby repealed and replaced with Exhibit E to
this ordinance.
Section 7. Title 7, Chapter 8, International Energy Conservation Code is hereby repealed and replaced
with Exhibit F to this ordinance.
Section 8. Title 7, Chapter 9, International Fuel Gas Code is hereby repealed and replaced with Exhibit
G to this ordinance.
Section 9. Title 7, Chapter 11, International Existing Building Code is hereby repealed and replaced with
Exhibit H to this ordinance.
Section 10. Repeal of Conflicting Provisions.
All provisions of the current Code or ordinances of the City of Ammon which conflict
with the provisions of this ordinance are hereby repealed to the extent of such conflict.
Section 10. Severability.
This ordinance is hereby declared to be severable. Should any portion of this ordinance
be declared invalid by a court of competent jurisdiction, the remaining provisions shall
continue in full force and effect and shall be read to carry out the purpose(s) of the
ordinance before the declaration of partial invalidity.
Section 11. Effective Date.

(A) The approved edition of the 2018 International Building Code as adopted by the State of Idaho or
the Idaho Building Code Board, together with any amendments or revisions to the International
Building Code made by the Idaho Building Code Board through the negotiated rulemaking process,
is adopted as the official building code of the City of Ammon:
(B) Code on File: One (1) copy of the International Building Code, 2018 Edition, shall be duly certified
and retained by the City Clerk.
7-1-2: FEES: Fees for building permits and services related to this chapter shall be established by
resolution of the City Council, which may be amended and modified from time to time by resolution.
7-1- 3: PENALTY: Any violation of the provisions of this chapter shall be deemed a misdemeanor
and shall be subject to penalties prescribed for such violations under section 1-4-1 of this code. In
addition, a fine and daily fee shall be charged for failure to obtain a certificate of occupancy as required

7-4-4 Violations and Penalties
7-4-1: IDAHO STATE PLUMBING CODE ADOPTED:
(A) Plumbing Code Adopted: The Idaho State Plumbing Code (ISPC) together with the most
current Uniform Plumbing Code (UPC) as adopted by the State of Idaho Plumbing Board together with the
amendments thereto, as publish
Rules published in the IDAPA rules 07.02.03 through 07.02.07, except those portions that are deleted,
modified or amended by other provisions of this Chapter.

Section 103.4: Fees: Shall be amended to read as follows: Fees shall be
determined by a schedule of fees adopted by the City Council by resolution which may
be amended from time to time.
Chapter 3, General Regulations: 313.12.4: Delete
Chapter 4, Plumbing Fixtures and Fixture Fittings:
Section 402.4: Metered Faucets: Shall be amended to read as follows: Self-
closing or self-closing metering faucets may be installed.
Section 412.1: Shall be amended to read as follows: Plumbing fixtures shall be
provided for the type of building occupancy and the minimum number shown in the
Chapter 5, Water Heaters:
Section 508.5: Shall be amended to read as follows: Discharge from a relief
valve into water heater pan shall be allowed, provided that the pan connection and its
drain piping are sized at least one pipe size larger than the outlet of the relief valve.
Chapter 7: Sanitary Drainage:
Section 710.9: The following Exception shall be added: A single pump is
permitted for public use occupancies when the sump basin receives the discharge of not
more than one toilet and 10 other drainage fixture units.
Chapter 10, Traps and Interceptors:
Table 10-1: The footnote shall be amended to read as follows: The trap arm
lengths of water closets or similar fixtures which depend upon self-siphoning and re-
filling of their traps for proper operation shall be unlimited.
7-4-3: AMENDMENTS TO THE IDAPA RULES OF THE IDAHO STATE
PLUMBING CODE: Amendments to the IDAPA Rules as adopted in the Idaho State Plumbing Code shall
be as follows:
Rule 07.02.06, #08:
The following language shall be added to Section 504.1: Exception: The pressure
test may be omitted with the use of colored primer or glue.

The language deleted by this Rule shall be retained regarding the requirements of
the UPC regarding drainage piping of certain commercial kitchen equipment.
Rule 07.02.06, #29:
The language deleted by this Rule shall be retained regarding the original
requirements of the UPC regarding drainage of commercial kitchen food-preparation
sinks and food-handling fixtures.
7-4-4: VIOLATIONS AND PENALTIES: Any person who shall
violate any of the provisions of the Idaho State and Uniform Plumbing Code as
adopted by the City of Ammon or the Ammon City Code as it relates to the Idaho
State and Uniform Plumbing Code shall severally for each and every such
violation and noncompliance respectively, be guilty of a misdemeanor as allowed
in the Idaho State and Uniform Plumbing Code shall be charged as adopted in
section 1-4-1 of the City Code. The imposition of one penalty for any violation
shall not excuse the violation or permit it to continue and all such persons shall
be required to correct or remedy such violations or defects within a reasonable
time and when not otherwise specified. Each day that a violation continues after
due notice has been served shall be deemed a separate offense. A fine and daily
fee shall be charged for failure to obtain a certificate of occupancy as required by
this code and the International Building Code. Said fine shall be as adopted by
resolution of the City Council as provided for by ordinance.

7-5-1: INTERNATIONAL MECHANICAL CODE ADOPTED:
(A) Mechanical Code Adopted: The International Mechanical Code, 2018 Edition,
published by the International Conference of Building Officials and the International Association
of Plumbing and Mechanical Officials is hereby adopted as adopted by the State of Idaho as the
official code of the City, including all appendices, except those portions as are deleted, modified,
or amended by the provisions of this chapter.
(B) Code on File: One (1) copy of the International Mechanical Code, 2018 Edition, shall be duly
certified and retained by the City Clerk.
7-5-2: AMENDMENTS TO THE ADOPTED CODE: Amendments to Adopted Codes: That the
following amendments shall be applicable to the adopted International Mechanical Code:
a. Section 109.1 of the International Mechanical Code, 2018 Edition, shall be amended to read
as follows:
109.1 Application for appeal. A person shall have the right to appeal a decision of the code
official to the board of appeals. An application for appeal shall be based on a claim that the
true intent of this code or the rules legally adopted thereunder have been incorrectly
interpreted. The application shall be filed on a form obtained from the code official within
twenty (20) days after the notice was served.
7-5-3: FEES: Fees for building permits and services related to this chapter shall be established by
resolution of the City Council, which may be amended and modified from time to time by resolution.
7-5-4: PENALTY: Any violation of the provisions of this chapter shall be deemed a misdemeanor
and shall be subject to penalties prescribed for such violations under section 1-4-1 of this code.

INTERNATIONAL FIRE CODE
SECTION:
7-7-1: Adoption of International Fire Code

7-7-1: INTERNATIONAL FIRE CODE ADOPTED:
(A) The current approved edition of the International Fire Code as adopted by the State of Idaho, is
adopted as the official fire code of the City of Ammon.
(B) One (1) copy of the adopted International Fire Code, current Edition, shall be duly certified and
retained by the City Clerk
7-7-2: ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION.
(A) The International Fire Code shall be enforced by the Division of Fire Prevention, in the Fire
Department of the City, which is hereby established and which shall be operated under the
supervision of the Chief of the Fire Department.
(B) The Fire Marshal shall be in charge of the Division of Fire Prevention shall be appointed by the
Mayor with confirmation of the City Council upon recommendation from the Chief of the Fire
Department on the basis of investigation to determine his qualifications.
(C) The Chief of the Fire Department may detail such members of the Fire Department as inspectors
from time to time as necessary. The Chief of the Fire Department shall recommend to the Mayor
the employment of technical inspectors who, when such authorization is made, shall be selected
through an investigation to determine their fitness for the position. The examination shall be open
to members and non-members of the Fire Department, and appointments made after investigation
shall be for an indefinite term.
7-7-3: DEFINITIONS: For the purpose of this ordinance, certain words and terms are
defined as follows:
CHIEF OF THE DIVISION OF FIRE PREVENTION: Wherever the

International Fire Code, it shall be held to mean the Fire Chief, Fire Marshall or other
designated authority charged with the administration and enforcement of the code.

LIFE-SAFETY SYSTEM: Wherever the words Life-Safety System is used
in the International Fire Code, it shall be held to mean, Automatic fire-extinguishing
system, fire alarm and detection systems, fire pumps and related equipment.
7-7-4: NEW MATERIALS, PROCESSES, OR OCCUPANCIES WHICH MAY
REQUIRE PERMITS: The Mayor, Chief, and Fire Marshall shall act as a committee to determine
and specify, after giving affected persons an opportunity to be heard, any new materials, processes,
or occupancies which shall require permits, in addition to those now enumerated in said code.
7-7-5: VIOLATIONS:

(A) Any person who shall violate any of the provisions of this code hereby adopted or fail to comply
therewith, or who shall violate or fail to comply with any order made there under, or who shall
build in violation of any detailed statement or specifications or plans submitted and approved
there under, or any certificate or permit issued there under, and from which no appeal has been
taken, or who shall fail to comply with such order as affirmed or modified by the Mayor and City
Council or by the court of competent jurisdiction, within the time fixed herein, shall severally for
each and every such violation and noncompliance respectively, be guilty of a misdemeanor as
provided for in section 1-4-1 of this code. The imposition of one penalty for any violation shall
not excuse the violation or permit it to continue and all such persons shall be required to correct
or remedy such violations or defects within a reasonable time and when not otherwise specified.
(B) The application of the above penalty shall not be held to prevent the enforced removal of prohibited
conditions.
7-7-6: FEES: Fees for building permits and services related to this chapter shall be established by
resolution of the City Council, which may be amended and modified from time to time by resolution.
EXCEPTION: Offices or businesses operated by the State of Idaho or the Federal Government shall be
exempt from the fire inspection fee. Fire inspections shall continue to be provided by the Fire Department.

RESOLUTION NO. 2020-017R
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF AMMON, IDAHO, ESTABLISHING THE
DATES FOR ALL REGULAR CITY COUNCIL, PLANNING AND ZONING, AND TRAFFIC COMMISSION MEETINGS
FOR 2021.
WHEREAS, regular meetings of the City Council shall be held on the first and third Thursday of each
month at 7:00 p.m., and the second Thursday at 4:30 p.m. at Ammon City Hall located at 2135 South Ammon
Road, Ammon, Idaho. This schedule may vary by Council order; and,
WHEREAS, regular meetings of the Planning and Zoning Commission shall be held on the first
Wednesday of each month at 7:00 p.m. at Ammon City Hall located at 2135 South Ammon Road, Ammon,
Idaho. This schedule may vary by Commission order; and,
WHEREAS, regular meetings of the Traffic Commission shall be held on the second Wednesday at
9:00 a.m. at Ammon City Hall located at 2135 South Ammon Road, Ammon, Idaho. This schedule may vary by
Commission order; and,
WHEREAS, pursuant to Idaho Code § 67-2343(1), any public agency that holds meetings at regular
intervals of at least once per calendar month scheduled in advance over the course of the year may satisfy
this meeting notice by giving meeting notices at least once each year of its regular meeting schedule; and,
WHEREAS, the City has determined that listing all regular meetings of the Council and Commissions
to be held in 2021 would be beneficial to the residents of and visitors to the City of Ammon.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF AMMON,
IDAHO that the regular meetings of the City Council for 2021 are attached as Exhibit A. Regular Meetings
of the Planning and Zoning Commission for 2021 are attached as Exhibit B. Regular Meetings of the
Traffic Commission for 2021 are attached as Exhibit C.
