A.CALL TO ORDER: Council President Slack opened the meeting at 7:00 p.m. at the Ammon City Hall building
located at 2135 South Ammon Road. Council Member Thompson led the Pledge of Allegiance and Council
Member Wessel offered a prayer.

Council discussed items within the Exhibit A and reviewed with Staff for clarification. Specifically,
questions about items purchased for Ammon Days and whether or not they could be returned. Staff
explained that any items that could be returned would be and other items would be used in future
years. Council also reviewed the rebilling process for the Tennis and Pickleball Courts. A new
company completed the construction after buying out the originally contracted company.
It was moved by Council Member Wheeler and seconded by Council Member Wessel to approve the
consent agenda. Motion passes unanimously with vote by roll call

Lighting District Board. Motion passes unanimously with vote by roll call

There were no members of the public present to comment on the Lighting District Budget and no
comment was received prior to the meeting. Finance Director Jennifer Belfield reported that there
was no change in the Lighting District for the coming fiscal year.
Council President Slack closed the Public Hearing at this time.
It was moved by Council Member Wheeler and seconded by Council Member Thompson to end the
Lighting District Board and return to regular Council activity. Motion passes unanimously with vote by roll

F.PUBLIC COMMENT REGARDING ITEMS NOT ON AGENDA (5-minute limit)
Council President Slack reminded those present for comment that comments related to upcoming public
hearings or items still open for consideration could not be heard at this time. Slack informed those present
that future public hearings for open items would be the proper time to present comments.
Stephanie Gifford, 4699 E Sunnyside Rd, brought forward two requests to Council. Gifford noted that having
a stream of meetings was very helpful for citizens to participate in local government. She hoped that Council
would make effort to continue the video streaming process even after restrictions on gathering took place.
Gifford began to bring forward another item regarding a public hearing that had taken place at a recent
Planning and Zoning meeting., she was reminded by Staff that pending hearings or issues pending action by
the Council could not be brought forward during public comment. Ms. Gifford asked Council for the
opportunity for an additional public hearing on open items.
Council, Staff, and Counsel discussed the limitations on comment regarding pending applications and items
set to come forward before Council. Counsel Hall suggested that open items ought to be brought forward
when said item was listed as an action item on future agendas. Council President Slack added that,
historically, Council had allowed comment on items on the agenda when a request was made from the
public.
Tom Hunsaker, 2925 Carolyn Ln, informed Council of coworker who tested positive for COVID-19 and
reminded Council and Staff of the importance of maintaining the six-foot separation for extended periods of
time even when masks were being worn.
Stephanie Affleck, 4651 E Sunnyside Rd, advised Council that current Comprehensive Plans were not in line
with input coming from Planning and Zoning commissioners and their goals differed from those of Council
and encouraged Council to attend those meetings or listen to recordings of meetings. Counsel Hall reminded
Council Members that attending those meetings was discouraged so as to keep their neutrality for future
decisions. Ms. Affleck asked if Council Members could review recordings and minutes from closed issues,
Counsel Hall said that they could. Ms. Affleck asked Council to do that and consider the positions of Planning
and Zoning Commissioners in relation to existing City Plans and Code and the positions of Council Members.
Rod Harris, 3585 Ross Ave, brought up his concerns regarding the installation of water meters in his
neighborhood. Mr. Harris detailed the problems that had come forward during the installation, including
varying sizes of water mains in his neighborhood. Mr. Harris stated that he had been in contact with Jim Key
but had seen no further action on the issue. Mr. Harris asked if Council had been made aware of the issue,
Council expressed that they were not aware. Harris continued with concerns regarding the meters that had
been installed and if the installation location changes the line to which the City is responsible for issues.
Harris explained that he believed the meters had been installed incorrectly and there would be issues in the
future with possible leaks in the water lines and the determination of who would be responsible for repairs to
meter pits. Counsel Hall advised Council and Staff to take note of the issues presented by Mr. Harris and
consult internally for potential fixes. Finally, Mr. Harris expressed concern over the check valves installed with
new meters and what the implications would be for homeowners in Ammon. Council and Staff discussed the
related codes for installation and asked that Staff spend some time looking into the issues. Council thanked
Mr. Harris for his input.
G.PUBLIC HEARINGS:
1.2020-026 Fiscal Year 2021 City of Ammon Budget
There were no members of the public present to comment on the budget and no comment had been
received prior to the meeting. Belfield informed Council that there had been a slight change to the
revenue portion of the budget. Belfield reviewed the changes noting that the final numbers for tax

revenue had been reported on August 1 and impacted the numbers. Because the originally
published amount was lower than the new amount, Belfield recommended an additional publication
and public hearing to review the updated numbers and finalize the budget. Belfield and City
Administrator Micah Austin noted that the City Levy would lower for the fifth year in a row and
would remain one of the smallest levies in the region. Council discussed questions on the budget with
Staff. In particular, the Interdepartmental transfers present in each budget were explained for
Council. Austin detailed the steps taken by departments to balance out the budget and the transfer
of funds in question. Council then asked what the implications on the budget were for the transition
of the Fire Department to the County Fire District. Austin explained the tax implications and that the
Department would remain in the City Budget for the coming fiscal year with a contract to be voted on
in later in this meeting.
Recommendation - Staff Recommends to support the FY 2021 budgets, take the 3% increase to
property taxes, and $4 forgone.
Summary of Analysis
1. All 10 of the Lighting Districts are similar to last year. Next year there will be some additional
subdivisions and poles installed, so next year there will be updates.
2. June 11 Work Session all department heads attended the meeting and we all discussed the details
of the Ammon budget.
3. July 9 Work Session the budgets were presented for general approval, and the binders were
provided.
4. The only difference from the July 9 printing to now is the property taxes. When I was preparing the
newspaper publication, I noticed the property tax number was not fully updated. I updated it from
$2,964,819 to $3,064,592. After publishing, we received the final numbers from the County. I would
like to republish the property taxes for the full $3,086,963. If approved, we would have another
public hearing on September 3 to take the 3% increase to the property taxes and the $4 forgone.
5. If we did take the 3% increase and forgone, our levy rate would update to 0.002548809, reducing
for the 5th year in a row. The difference to a resident on a $100,000 taxable value (meaning home is
valued at $200,000 and
$20.73. The property taxes paid would be $254.88.

Financial Impact
The budget allocates funds for priorities and level of service.
All GL numbers will be impacted by the budget.
The Water and Street funds are hopeful to do some capital projects, that will bring their cash balance
below the desired investment policy levels.
Council President Slack closed the Public Hearing at this time and returned into normal business.

Austin reviewed the appointments as they were presented within the resolution. Austin reviewed the
existing members of the Board, their term limits, and any changes.
Recommendation
Approval of Resolution 2020-0010R
Summary of Analysis
1. The Ammon URA Board has one vacancy on the board. Jeff Miller has indicated to Mayor Coletti
that he would like to serve on the board.
2. George Watkins has served on the Ammon URA since 1994. He has indicated that he would like to
continue serving on the board.
Financial Impact
There is no financial impact.
It was moved by Council Member Tibbitts and seconded by Council Member Wessel to approve Resolution
2020-010R. Motion passes unanimously with vote by roll call
2.Contract for Services Bonneville County Fire District (Micah Austin, City Administrator)
Austin reviewed with Council the need for the Contract at hand. Zones. Commissioners. Chief Hyde
discussed the Contract and income still set to come in during the next fiscal year. Hyde also added
that the Wildfire trucks were currently in Utah assisting in a firefight.
Recommendation
City staff recommends approval.
Update from July 16, 2020 City Council Meeting
1. City staff inquired with the State Tax Commission on when the Fire District would receive property
tax revenues. According to Idaho Code 63-807, districts that annex an area after January 1 of any
given year are prohibited from levying property tax on the annexed area during the same year. In
other words, the Fire District will not receive any tax revenues from properties in the City of Ammon
until January 2022.
2. For this reason, city staff and fire district staff are recommending to the City Council a Contract for
Services with the Fire District for Fiscal Year 2021. The contract for services is for the Fire District to
provide fire and rescue services to the City of Ammon for Fiscal Year 2021
3. The total contract amount is $1,036,383. This amount is equal to the amount that had been
budgeted for the Fire Department for Fiscal Year 2021 if the city had not annexed into the Fire
District. Staff recommends approval.
Background on Previous Decision to Join the Bonneville County Fire District
1. On July 9, 2020, the City Council deliberated joining the Fire District, hearing testimony from the
Ammon Fire Department and other city staff. After deliberation, the City Council chose not to join
the Fire District at that time, based on concerns the Fire Department employees had with the
transition process.
2. Since the last meeting on July 9, the Fire Department staff has worked with the Fire District to
resolve their concerns. At the meeting on July 16, Chief Hyde will provide an update to the City
Council and a recommendation.

3. In April 2020, the City Council discussed joining the Fire District and directed staff to seek public
comment on the topic.
4. On April 13, 2020, Mayor Coletti mailed a letter to all residents inviting them to participate in
public hearings on joining the Fire District.
5. On April 13, 2020, the City of Ammon issued a press release briefing discussing the idea and
social media websites.
6. On May 7, 2020 and May 21, 2020, the City Council held public hearings to obtain comment on
joining the Bonneville County Fire District. At the first public hearing, two comments were voiced in
favor of joining the district. No comments were received at the second public hearing.
7. On June 4, 2020, the Ammon City Council directed staff to proceed with planning efforts to join the
Bonneville County Fire District.
8. A committee of City of Ammon representatives and Fire District representatives has met three
times in the last four weeks to resolve important issues and move the effort forward as directed by
the City Council. The resolutions and agreement attached to this staff report are the results of this
12. The attorneys for both the City of Ammon and the Fire District have drafted
resolutions for both entities to adopt and an agreement that more fully lines out the obligations of
both parties before, after, and during the transition process. 13. The resolution and the agreement
are attached to this staff report. The committee has reviewed and approved the resolutions and the
agreements.
Financial Impact
The contract for services obligates the City of Ammon to paying $1,036,38.00 to the Fire District in
Fiscal Year 2021.

Contract for Services with the Bonneville County Fire District and grant Mayor Coletti signing authority.

I.DISCUSSION ITEMS:
1.Staff Items
Chief Hyde updated Council on the potential need for a replacement of a concrete pad for the Fire
Station. He is working through bids but has money in his budget to pay for the replacement and will
present final information to Council at a future meeting.
Belfield reminded Council that open enrollment was taking place until September 15 for any changes
to insurance information.
Administrator Austin updated Council on the First Responders Grant through the State. Austin
outlined the change in numbers coming from the State and compared them to property tax
information for future years. Austin spoke to the compounding impact on the levy and budget based
on claiming the Grant.

Council reviewed items brought forward by citizens in the last few weeks.

Mayor Coletti discussed the opportunity to create a citizen review committee to discuss
improvements that need to be made with the Ammon Pool. Council discussed the options. Coletti
also reported on seven library boxes that will be installed throughout the City for use by the public.

concerns with the proposed contract as the request was for a per meal funding with no cap on the

dollar amount. Austin reported that he had asked the Senior Center for an updated request and had
not received information back.

2.Contract for Services with Ronald McDonald House Charities of Idaho
Austin presented the contract brought forth by the Ronald McDonald House Charity for current fiscal
year funding for $500 to support a summer drive-in movie series at the Motor-Vu Drive-In Theater.
Austin recommended that the contract be approved.

3.Authorization of Idaho State Department of Commerce CARES Broadband Grants
Technology Director Bruce Patterson gave a background to Council on the proposed grants to move
forward. Patterson noted that the funding was mainly for establishing a wireless network throughout
the City but parts could be used for the existing Fiber network. The total funding will amount to
$875,000. The funds will also decrease costs for future Fiber LID and networks. Because the projects
must be completed by December of 2020, it was important to move forward with action as quickly as
possible.

authorization of the of Idaho State Department of Commerce CARES Broadband Grants. aƚƷźƚƓ ƦğƭƭĻƭ

1.EIRWWA District Options
Mayor Coletti updated Council on the recent joint work session with other members of EIRWWA on
the subject of seeking and RFP for privatization of the EIRWWA system. Coletti noted that other
entities are interested in seeking a District option over the option to privatize. Council discussed the
difficulties and steps that would need to be considered should the District option be pursued. Council
discussed the pros and cons of privatization and districting and what steps would be taken to move
the process forward.
2.Administrator Austin updated Council on a property outside of the City limits that is interested in
annexing into the City. Council discussed the proposed land and what areas of the impact area and
comprehensive plan would be impacted as well as the options for annexing the location.

Development is: Will the change encourage the most appropriate use of the land, and will rezoning it to R-1 and commercial
be parallel with strategies that strengthen our community, so that people in our communities can thrive? The answer is no.
First if you have a moment, drive by the land yourself the address to the farm house is 4561 E Sunnyside Road and the land just
north of it is where they have stated they want about 69 homes. You will see, not only is this parcel just a stone throw away
from the intersection, of Sunnyside and Crowley. It has no other outlets then Crowley.
If a traffic study was conducted, as required (which it was not been done). It would show that medium density residential is the
wrong zone for this small acreage. The developer provided a plot map showing 69 homes. 69 homes roughly mean at least 160
cars. These cars will all exit onto Crowley very close to an intersection. When clocked by myself (Stephanie) and my son for an
hour, the intersection had 25-30 cars per minute. This traffic was all only coming from the west.
This intersection does not have the common intersection traffic. It has a lot that crosses it, not just home owners up the
foothill, but large trucks delivering trash, supplies, and windmill parts. During the winter the large trucks wait by the
intersection until the roads are plowed. People also use this road as a route to get to recreational places and it is used all year
round.
This is one intersection where building the infrastructure MUST come first before development, or lives will be
taken.
I have always heard when it comes to buying a home; the most three important item is Location, Location, and Location. The
location of this land is not suitable for the developer’s plans. So while we don’t want to tell someone what to do with their
land, the location is a factor.
The Developer has been telling everyone, the commercial zoning is being “pushed by the city.” PLEASE STOP! PLEASE! Why
would you bring commercial into residential? There is residential on all side of the land, meaning that a court could call this
illegal spot zoning if commercial was placed here. Please see the diagram below – it shows the parcel has low density homes
on all sides.

The plan violates the Policies Based on Existing Land Use Patterns. (Please See 2018 City of Ammon Comprehensive Plan:
Chapter 10 Pages 21-22). In Exhibit aboveit shows the 17.9 acres in a yellow outline and how the parcel borders private
property with lots size from 3 to 15 acers. The homes across the street are also one acre or more. The homes around the
parcel are on larger lots, most with at least an acre of land. When you travel as far as half a mile from the parcel you will find
homes defined as low density. The rezoning request of R-1 violates the character of the neighborhood. Low density is a natural
feature of this area. Many in this community moved to this area to be in a low density community. We feel strongly about
open space, our investment in our land, and in our homes. We have the right to enjoy low air and noise pollution and don’t
mind a longer drive into town. Our right to have our land surrounded by low density community is found not just in the 2018
City of Ammon Comprehensive Plan, but in Idaho Code 67-6502 “(h) To ensure that the development on land is commensurate
with the physical characteristics of the land and (d) To ensure that the important environmental features of the City and Area
of Impact are protected.”
The comprehensive plan states that a buffer area must be put in between residential and commercial. Again, with this location
you could not provide an adequate buffer, and what would be left would be little to build on.

Lastly, the Comprehensive map shows all four corners being
commercial. There is a barn from the 1800s there. If you plan to tear
that down for commercial, I believe that would be a mistake. There is
very little history in Ammon!
As concerned neighbors of 45th/Crowley and Sunnyside road would
support annexation; however, we are STRONGLY OPPOSED to the land
being rezoned to R-1 and any commercial zoning. Please add our
testimony for the public hearing on August 20, 2020. Our property
comprises almost the entire eastern border of the land proposal.

I
the City recently passed an ordinance requiring all new subdivisions being annexed into the City
will have pressurized irrigation installed for the purpose of watering yards and not using culinary
water pumped out of the ground. With this ordinance the demand on the culinary water system
is very minimum. An additional study that Keller Associates performed after the passing of the
ordination showed that the system has the capacity to add almost 7,000 more homes and stay
under the water rights. With this information I determined that we could adequately supply the
property.
