9/21/1999 Council Minutes CITY OF AMMON September 21,1999 Minutes of the Special Meeting of the Mayor, City Council, and Planning and Zoning Commission members: I The meeting was called to order by Mayor C. Bruce Ard at 7:10 P.M. in the City Building, 2135 South Ammon Road, Ammon, Idaho, with the following City Officials present: Mayor C. Bruce Ard Councilmember W. Lee Bean Councilmember Harvey L. Loveland Randy Waite, Planning and Zoning Commission Maxine Hardy, Planning and Zoning Commission I Mayor Ard opened the discussion on Ordinance No. 268, AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF AMMON, BONNEVILLE COUNTY, IDAHO. Except for the sections pertaining to manufactured housing, the ordinance is acceptable as drafted. There is a need to reach an agreement on the manufactured housing requirements because there are developers interested. It is important to have rules that give the City some control. Karen Anderson presented information that she obtained to compare the manufactured housing requirements of Bonneville County, City of Idaho Falls, and City of Ammon. She favored establishing a density. Engineer Manwill pointed out the various locations of manufactured home subdivisions and mobile home parks/courts in Bonneville County. He observed that manufactured home subdivisions appear to deteriorate faster than manufactured home courts. The probable reason is that a court is under one ownership, and the owner is interested in keeping up his investment. Attorney Anderson requested the Planning and Zoning Commission members to explain their concerns in order to get an idea of the direction to go with Ordinance No. 268. The ordinance, as drafted, does not address the recommendations of the Planning and Zoning Commission regarding manufactured housing. I Karen Anderson summarized the ideas of the Commission. There are too many things mixed together. The ordinance needs to be simplified. The definitions should be clarified. A manufactured home on a permanent foundation can be sited in any subdivision. Travel trailers require a separate zone or a special use permit. The draft of Ordinance No. 268 was reviewed section by section with the attorney. Interpretations were discussed and agreed upon. The attorney noted the recommendations in order to correct the ordinance prior to presentation for adoption. Councilmember Hall inquired if the City intends to change the public hearing procedures according to legislative amendments to the land use law. The law will allow entities to conduct only one public hearing for zoning matters. If a change is made, would the hearing be before the Planning and Zoning Commission or the City Council? The City Council needs to pass an ordinance to change to one public hearing. AT&T Cable Services (formerly TCI Cablevision) has requested renewal of their franchise agreement. Attorney Anderson was asked to review their request and to make recommendations to the City Council. Shirley Smith has requested permission to use space in the new Fire Station for meetings of her Girl Scout troop. Action on the request was deferred until the building is completed. I Jay Johnson is considering development of the Lawrence Ricks' property. If the City is interested in a park in that area, Johnson is willing to sell the City acreage at the same purchase price he has to pay for the property. Council member Crandall moved to approve the request of Bonneville Joint School District 93 for an extension of their Special Use Permit to use the trailer for a classroom at Sand Creek Middle School for a period of three school years. Council member Hall seconded the motion. Roll call vote: Crandall - Yes; Hall - Yes; Bean - Yes. The motion carried.
